Open Peer Review for Evaluating Academic Legal Publications: The " Antidote " to an " Ill " Blind Peer Review

Numerous peer-reviewed law journals, in particular Latin-American ones, stand out for their general use of blind methods to assess the substantive quality of academic articles. Nevertheless , this traditional peer review model is considered ill (i.e. poor-quality) across disciplines due to different technical and social issues. The cause seems to be the anonymity between the actors involved. Then, open peer review models have emerged as an antidote to combat the main symptoms that the blind model presents, namely, lack of transparency during the process and absence of reviewers' accountability. However, thus far law journals have not adopted an open system yet. Moreover, neither theoretical nor empirical research has been conducted about its potential use. This article presents an in-depth analysis of the pros and cons of both the traditional and the open identities review models in Science, Technology, Engineering and Mathematics (STEM) disciplines – in which the latter has been broadly applied. This paper compares the experience of STEM disciplines in relation to both of the methods and use the insights from this comparison to examine the legal discipline. The author specifically argues that unmasking the identities of authors and evaluators may be a suitable way to counteract only some of the flaws that the blind model has entailed in the evaluation of academic legal publications, therefore a mixed method could be a fairer alternative for current blind-peer-reviewed law journals. The author concludes by providing recommendations for further research.

The aim of this paper is twofold: 1) to identify the evaluative speech acts, either positive or negative, contained in a corpus of 30 English-written medical book reviews published in The British Medical Journal in the period 2000-2009; 2) to analyze the linguistic-rhetorical strategies used to convey this evaluation. Our main results illustrate that various mitigating strategies are used not only to soften criticism, but also to help maintain social harmony and solidarity with the reviewees. Moreover, negative evaluation is on many occasions voiced at aspects outside the book reviewed, which would mean that apart from showing their expertise in the field tackled, book reviewers also want to discuss certain issues of their concern and to put forward their cultural background.

Literary theorists and cultural sociologists alike acknowledge that there are no universal standards for appraising the value of a book. Yet, book critics regularly pronounce the literary merits and failures of novels in their reviews. Research on cultural criticism has shed considerable light on how reviewers are able to assess the meaning and value of novels in the absence of objective indicators of literary quality by relying on different cultural ‘‘tools’’. This study examines how critics use authors’ race and ethnicity as a tool for constructing the value of literary fiction. Based on analysis of 265 book reviews from The New York Times Book Review and The New Yorker magazine, I find that reviewers use racial and ethnic identifiers to: (1) establish the authenticity of the novels, (2) classify works into ethnic genres, and (3) nominally identify international literary talent. I also present data on what influence racial and ethnic identification has for critics’ overall assessment of the books under review.

Writing for Publication

A group of higher education faculty members from different colleges and departments were participating in a 3-day professional development institute on writing for professional publication. The pressure to publish was on at their institution, newly categorized as a university. Prior to the mid-morning break on the fi rst day, the presenter asked the participants to write their concerns about publishing on Post-it notes and then read and categorized them before the group reconvened. The great majority of the participants were worried about their ability to fulfi ll the scalating expectations for faculty. Only a few had published previously and they ondered if they were capable of writing well enough to publish their work. As away to allay their fears, the presenter offered to assess a short writing sample from each participant that evening and return it the next day.
