Focus on financing

Not budgeting enough for marketing is another common mistake. “You need to build in a marketing budget both pre- and post-opening,” Cella said. At least three months before opening, you need to market to prescribers and the community, explaining when you will open and what services your pharmacy will offer. Then, budget for grand opening events and for the rest of the year.

Learn and revise your plan

After your pharmacy opens, review the plan at least quarterly. Compare where you are with what you expected and make adjustments. “Your business plan should not be created and shelved,” Cella said. “It’s a living document that needs to be changed and massaged as your business grows.”

A plan participant, individually, and on behalf of other participants, recently filed a class action complaint against Johnson and Johnson (“J&J”) and the individual members of the Pension & Benefits Committee (“Committee”). The complaint alleges that J&J and the Committee breached their ERISA fiduciary duties by mismanaging the J&J prescription-drug benefit program. 

Under ERISA, fiduciaries are required to act “with the care, skill, prudence, and diligence under the circumstances then prevailing that a prudent man acting in a like capacity and familiar with such matters would use in the conduct of an enterprise of a like character and with like aims.”  The complaint alleges that J&J and the Committee failed this duty of prudence by not making diligent efforts to: (i) negotiate favorable contract pricing terms with prescription drug vendors; (ii) regularly conduct requests for proposals to compare pharmacy service providers; and (iii) ensure the plan’s prescription drug program does not funnel participants towards higher cost prescription drug options. As a result, the complaint alleges plan participants were harmed by paying higher premiums and cost sharing from the impact of inflated prescription drug costs on the plan. One example cited in the complaint is that Express Scripts, the plan’s pharmacy benefit manager, charged the plan over $10,000 for a 90-pill prescription that could have been purchased without insurance for approximately $28. 

This complaint is a reminder to welfare benefit plan sponsors and committee members that they must be diligent in discharging their fiduciary duties. Plan sponsors should review their welfare benefit committee charter to confirm that it appropriately delegates responsibility. The committee will want to conduct regular RFPs to ensure they are getting the best value for the plan participants. Although many plan fiduciaries utilize a third-party service provider or consultant for this process, as the complaint points out, fiduciaries cannot simply rely on the advice of third-party service providers, consultants, or experts. Instead, they must exercise independent, prudent, and impartial fiduciary judgment. Fiduciaries must also do their due diligence to identify any conflicts of interest that a third-party service provider or consultant may have that would prevent them from providing advice solely for the benefit of the plan participants. For example, the complaint alleges that the method the J&J plan used to compensate its pharmacy benefit manager incentivized it to direct participants towards more expensive prescription drugs.   

Finally, recent laws such as the Consolidated Appropriations Act and No Surprises Act have allowed welfare benefit plan fiduciaries to gain greater access to plan expense information.  As this complaint shows, however, that greater access to information may increase the scrutiny that plan fiduciaries are under to responsibly manage their plans. Kroger Announces Plan to Sell Specialty Pharmacy Business to Elevance Health

Grocery-store chain  Kroger ( KR ) is selling its specialty pharmacy business to U.S. health insurer Elevance Health ( ELV ).

Kroger didn’t disclose the financial details of the deal, which it said is expected to close in the second half of 2024. The specialty pharmacy business serves patients with chronic illness that requires complex care, according to the grocery-store firm. 

Kroger said the specialty pharmacy business is separate from its in-store retail pharmacies and The Little Clinic business, which aren't part of the transaction.

The deal comes after the Federal Trade Commission last month sued to block the merger between Kroger and Albertsons ( ACI ), arguing the tie-up would put upward pressure on already elevated food prices.

The regulator said last month that the two companies had offered to divest "several hundred stores and select other assets" to C&S Wholesale Grocers to secure antitrust approval for their merger .

The deal, a $24.6 billion transaction, was announced in 2022 and could create a chain of 5,000 stores.

And the industry is projected to grow nearly 2.5% between 2023 and 2030, leaving plenty of opportunity for new businesses..

But competition in the bar industry can be fierce. You need to know your clientele, competitors, and how you’ll stand out if you want to succeed. Not to mention mapping out all the details of your financials and operations. 

Luckily, you can cover all of that (and more) by writing a business plan.

Financial plan

The sections you need will vary depending on why you’re writing a business plan and what you intend to do with it . 

Suppose it’s to manage your operations and not something you expect anyone outside of the business to read. In that case, consider keeping it to a few pages and skipping sections like the executive summary.

If you’re applying for a loan, then you’ll need a more formal plan that includes all the sections listed above.

  • The 6 elements of an effective bar business plan

Executive summary

Your executive summary is a short, high-level overview of your entire plan. 

The summary should give readers a sense of what factors will make your bar successful. That could include securing a high-visibility location, partnering with a chef who will oversee meal preparation, or negotiating deals with brewers to get their beers in your bar.

If you’re seeking a bank loan for your bar, the lender will read your executive summary first. In all likelihood, they won’t read any further unless the executive summary grabs their attention. 

So, make it clear and convincing.

Market analysis

The market analysis may be the most important part of your entire business plan. 

It’s where you carefully research and document:

  • Who your target customers are
  • What they want
  • What other establishments they may consider

Start by identifying the size of your market . Focus on the number of potential customers above the legal drinking age in your area. Then, segment these customers based on demographics such as age, income level, and lifestyle preferences. 

Then look into who you will be competing with. List and research other bars as well as indirect competition from restaurants, clubs, and even grocery stores that sell beer or home entertainment options.

Here are a few examples of what this process will look like:

Bar customer segmentation

If you find there are a lot of college students and younger adults near your bar location, you should cater your offerings to their tastes. But if you’re near office buildings or event venues, you may want to focus on older customers with more disposable income.

Will you offer a more diverse drink menu, better food, or a unique theme? Explain how these factors will set your bar apart and attract customers. Or, if your area lacks a certain type of bar, such as a sports bar or a high-end cocktail lounge, describe how filling this gap in the market will serve as your competitive advantage.

Marketing and sales strategy

Your market analysis gives you insights into potential customers. Your marketing and sales strategy is where you use those insights to get those customers in your door.

As you looked around at your competitive landscape, maybe you gained some insight into how your ideal customers discover new bars — through social media, online reviews, local event listings, or word-of-mouth.

Start by developing marketing strategies that are tailored to those channels . Consider tactics like:

  • Creating engaging social media content showcasing your unique drinks, events and ambiance.
  • Partnering with local businesses or events to increase visibility.
  • Introducing special promotions to encourage repeat visits and attract new customers.
  • Hosting themed nights or events to create buzz and attract specific customer segments.

In your business plan, document how you will implement these efforts and the resources required. 

Operations plan

The operations section of your business plan is where you detail the day-to-day requirements for running the bar smoothly. Start by describing your physical space and key equipment, such as:

  • Beverage dispensing systems
  • Glassware and utensils

Specify the types and number of each that you’ll need. Then you can address staffing needs, describing the roles of bartenders, servers, and support staff. Document in your plan that you’ll have a staffing strategy to cover peak hours.

You should also cover inventory management. Describe how you’ll stock alcoholic and non-alcoholic beverages, ingredients for cocktails and food. Be sure to spend time discussing supply chains for sourcing these ingredients.

Document the types of technology you’re using, like point-of-sale systems, inventory tracking, or customer reservation platforms. 

Finally, ensure that your operations plan demonstrates how you will comply with any licensing, health and safety regulations and that you have a plan for ensuring responsible customer behavior.

Business overview

The overview should fill in any gaps the reader may have, including:

  • The name of your bar
  • When it was founded (if it’s an existing business)
  • The inspiration behind the business

You should include the background and qualifications of key team members here. Include their experience in the bar industry and any other experience that’s relevant to their position.

If you’re running an existing bar, discuss previous achievements like revenue milestones, recognitions, or community events you’ve hosted.

You don’t need a deep financial background to run a successful business. But it’s important to develop projections for how you expect the bar to perform. If you’re starting a new bar, consider that you’ll need to pay upfront costs like equipment, supplies, licenses and rent.

Then there are the ongoing costs like employee salaries, marketing, and continuing to keep your shelves stocked.

Making educated guesses about the future will help you determine what’s working, and where you should make adjustments as you run your business.

Include sales and expense forecasts in your plan. The financial section also should include a cash flow statement , income statement , and balance sheet .

Remember, no one knows exactly how the future will pan out — these projections are your baseline for how you think the business will do, and you’ll adjust them over time as you update your plan with actual results.

Researchers Call for Regulation of Microbiome Tests

Scientific research has linked a person’s microbiome to everything from gut and mental health to immunity and predisposition to cancer. This research comes at a time when there is a burgeoning interest in wellness and alternative medicine, which has fueled consumers’ curiosity about the composition of their own microbiomes.

This curiosity has led to a growing demand for direct-to-consumer (DTC) microbiome testing services. While the companies marketing these services claim to tell customers whether their microbiomes (gut, vaginal, skin…) are “healthy,” researchers from the University of Maryland, Baltimore Schools of Law, Medicine, and Pharmacy question the tests’ accuracy.

In a unique multidisciplinary collaboration, the researchers call for greater regulation of these products in a Perspectives article published March 15 in Science. Diane Hoffmann, JD, MS , Director of the Law and Health Care Program and the Jacob A. France Professor of Health Care Law at the University of Maryland Francis King Carey School of Law , led the collaboration.

The perspective is the result of a National Institutes of Health-funded study that consisted of consultations with experts in food and drug law, microbiome sciences, gastroenterology, gynecology, government regulations, and bioethics as well as focus groups with clinicians and consumers using the products.

DTC microbiome testing services identify which microorganisms are present along with their relative abundance in a fecal or vaginal sample that the consumer collects. In some cases, the test may describe the metabolic functions of the microbes observed.

“There is a perception among consumers that these products will give them a real medical diagnosis and a way to treat an ‘unbalanced’ microbiome,” said Jacques Ravel, PhD , co-author and Acting Director of the Institute for Genome Sciences and Professor of Microbiology and Immunology at the University of Maryland School of Medicine (UMSOM). “There is no scientifically agreed-upon definition of a ‘healthy’ microbiome; the microbiome is dynamic and changes frequently; there is no clinical proof that these products work; and no standardization in the processes involved.”

For consumers—who often suffer from diseases such as inflammatory bowel disease (IBD) or bacterial vaginosis (BV)—that means shelling out a lot of money for a test without a guarantee of useful or actionable medical information—and then often further investing in what companies tell them will help improve their microbiome, such as nutritional supplements including probiotics and prebiotics, or special diets. None of these interventions have been clinically validated or had their claims evaluated by the U.S. Food and Drug Administration (FDA).

“In addition to the cost, these tests could do real harm by convincing a person to delay medical care and substitute supplements for prescription medications,” added Dr. Ravel, who studies the vaginal microbiome.

“We’re calling for federal regulators with oversight of these testing companies to set standards for the analytical validity of their tests and require them to report on their performance,” said Hoffmann. “Additionally, the FDA needs to determine if DTC microbiome tests are general wellness tests or if they make diagnostic claims that could harm consumers. If it is determined that these are diagnostic tests, then FDA regulation will be required.”

In addition to the FDA, the authors write that government bodies like the National Institute of Standards and Technology (NIST) should set standards for the tests, including laboratory methods so that test results are accurate, can be trusted, and are comparable across labs; the Centers for Medicare and Medicaid Services (CMS) under the Clinical Laboratory Improvements Amendments (CLIA) should regulate the analytical validity of the tests, including the testing methods and algorithms used to formulate a report and should require the testing companies to adopt agreed upon standards and report their performance.

“We need further research and clinical evaluation before any of these companies can claim a relationship between a test result and a person’s health, or if dietary changes and supplements can improve the microbiome and someone’s health,” said Hoffman.

“There are more than 60,000 pharmacies in the United States, and these are the source for at least some of supplements that testing companies recommend,” said Frank Palumbo, PhD, JD , Professor Emeritus of Practice, Sciences, and Health Outcomes Research at the University of Maryland School of Pharmacy . “Pharmacists should be made aware of the issues these unregulated laboratory tests present, since they are in a position to counsel customers who buy these supplements.”

All the authors agree that claims these testing companies make are premature and that additional clinical research and peer-validation is necessary before consumers can have confidence in the results. Additional co-authors were Erik von Rosenvinge, MD , Professor of Medicine in the Division of Gastroenterology & Hepatology at UMSOM and Chief of Gastroenterology at the VA Maryland Health Care System; Mary-Claire Roghmann, MD, MS , Professor of Epidemiology and Public Health at UMSOM, and Daniel McDonald, PhD, Scientific Director of the American Gut Project and the Microsetta Initiative at the University of California San Diego.

About the Institute for Genome Sciences

The Institute for Genome Sciences' (IGS) has been part of the University of Maryland School of Medicine (UMSOM) since 2007. IGS scientists work in diverse areas, applying genomics and systems biology approaches to better understand health issues in premature infants, women, and transgender people; to improve vaccine development; to study evolutionary biology; and to understand cancer, parasitic, fungal, and infectious diseases, as well as identifying the underpinnings of aging, brain development, addiction, and mental health.
