Developing a Thesis Statement

Many papers you write require developing a thesis statement. In this section you’ll learn what a thesis statement is and how to write one.

Keep in mind that not all papers require thesis statements . If in doubt, please consult your instructor for assistance.

What is a thesis statement?

A thesis statement . . .

  • Makes an argumentative assertion about a topic; it states the conclusions that you have reached about your topic.
  • Makes a promise to the reader about the scope, purpose, and direction of your paper.
  • Is focused and specific enough to be “proven” within the boundaries of your paper.
  • Is generally located near the end of the introduction ; sometimes, in a long paper, the thesis will be expressed in several sentences or in an entire paragraph.
  • Identifies the relationships between the pieces of evidence that you are using to support your argument.

Not all papers require thesis statements! Ask your instructor if you’re in doubt whether you need one.

Identify a topic

Your topic is the subject about which you will write. Your assignment may suggest several ways of looking at a topic; or it may name a fairly general concept that you will explore or analyze in your paper.

Consider what your assignment asks you to do

Inform yourself about your topic, focus on one aspect of your topic, ask yourself whether your topic is worthy of your efforts, generate a topic from an assignment.

Below are some possible topics based on sample assignments.

Sample assignment 1

Analyze Spain’s neutrality in World War II.

Identified topic

Franco’s role in the diplomatic relationships between the Allies and the Axis

This topic avoids generalities such as “Spain” and “World War II,” addressing instead on Franco’s role (a specific aspect of “Spain”) and the diplomatic relations between the Allies and Axis (a specific aspect of World War II).

Sample assignment 2

Analyze one of Homer’s epic similes in the Iliad.

The relationship between the portrayal of warfare and the epic simile about Simoisius at 4.547-64.

This topic focuses on a single simile and relates it to a single aspect of the Iliad ( warfare being a major theme in that work).

Developing a Thesis Statement–Additional information

Your assignment may suggest several ways of looking at a topic, or it may name a fairly general concept that you will explore or analyze in your paper. You’ll want to read your assignment carefully, looking for key terms that you can use to focus your topic.

Sample assignment: Analyze Spain’s neutrality in World War II Key terms: analyze, Spain’s neutrality, World War II

After you’ve identified the key words in your topic, the next step is to read about them in several sources, or generate as much information as possible through an analysis of your topic. Obviously, the more material or knowledge you have, the more possibilities will be available for a strong argument. For the sample assignment above, you’ll want to look at books and articles on World War II in general, and Spain’s neutrality in particular.

As you consider your options, you must decide to focus on one aspect of your topic. This means that you cannot include everything you’ve learned about your topic, nor should you go off in several directions. If you end up covering too many different aspects of a topic, your paper will sprawl and be unconvincing in its argument, and it most likely will not fulfull the assignment requirements.

For the sample assignment above, both Spain’s neutrality and World War II are topics far too broad to explore in a paper. You may instead decide to focus on Franco’s role in the diplomatic relationships between the Allies and the Axis , which narrows down what aspects of Spain’s neutrality and World War II you want to discuss, as well as establishes a specific link between those two aspects.

Before you go too far, however, ask yourself whether your topic is worthy of your efforts. Try to avoid topics that already have too much written about them (i.e., “eating disorders and body image among adolescent women”) or that simply are not important (i.e. “why I like ice cream”). These topics may lead to a thesis that is either dry fact or a weird claim that cannot be supported. A good thesis falls somewhere between the two extremes. To arrive at this point, ask yourself what is new, interesting, contestable, or controversial about your topic.

As you work on your thesis, remember to keep the rest of your paper in mind at all times . Sometimes your thesis needs to evolve as you develop new insights, find new evidence, or take a different approach to your topic.

Derive a main point from topic

Once you have a topic, you will have to decide what the main point of your paper will be. This point, the “controlling idea,” becomes the core of your argument (thesis statement) and it is the unifying idea to which you will relate all your sub-theses. You can then turn this “controlling idea” into a purpose statement about what you intend to do in your paper.

Look for patterns in your evidence

Compose a purpose statement.

Consult the examples below for suggestions on how to look for patterns in your evidence and construct a purpose statement.

  • Franco first tried to negotiate with the Axis
  • Franco turned to the Allies when he couldn’t get some concessions that he wanted from the Axis

Possible conclusion:

Spain’s neutrality in WWII occurred for an entirely personal reason: Franco’s desire to preserve his own (and Spain’s) power.

Purpose statement

This paper will analyze Franco’s diplomacy during World War II to see how it contributed to Spain’s neutrality.
  • The simile compares Simoisius to a tree, which is a peaceful, natural image.
  • The tree in the simile is chopped down to make wheels for a chariot, which is an object used in warfare.

At first, the simile seems to take the reader away from the world of warfare, but we end up back in that world by the end.

This paper will analyze the way the simile about Simoisius at 4.547-64 moves in and out of the world of warfare.

Derive purpose statement from topic

To find out what your “controlling idea” is, you have to examine and evaluate your evidence . As you consider your evidence, you may notice patterns emerging, data repeated in more than one source, or facts that favor one view more than another. These patterns or data may then lead you to some conclusions about your topic and suggest that you can successfully argue for one idea better than another.

For instance, you might find out that Franco first tried to negotiate with the Axis, but when he couldn’t get some concessions that he wanted from them, he turned to the Allies. As you read more about Franco’s decisions, you may conclude that Spain’s neutrality in WWII occurred for an entirely personal reason: his desire to preserve his own (and Spain’s) power. Based on this conclusion, you can then write a trial thesis statement to help you decide what material belongs in your paper.

Sometimes you won’t be able to find a focus or identify your “spin” or specific argument immediately. Like some writers, you might begin with a purpose statement just to get yourself going. A purpose statement is one or more sentences that announce your topic and indicate the structure of the paper but do not state the conclusions you have drawn . Thus, you might begin with something like this:

  • This paper will look at modern language to see if it reflects male dominance or female oppression.
  • I plan to analyze anger and derision in offensive language to see if they represent a challenge of society’s authority.

At some point, you can turn a purpose statement into a thesis statement. As you think and write about your topic, you can restrict, clarify, and refine your argument, crafting your thesis statement to reflect your thinking.

As you work on your thesis, remember to keep the rest of your paper in mind at all times. Sometimes your thesis needs to evolve as you develop new insights, find new evidence, or take a different approach to your topic.

Compose a draft thesis statement

If you are writing a paper that will have an argumentative thesis and are having trouble getting started, the techniques in the table below may help you develop a temporary or “working” thesis statement.

Begin with a purpose statement that you will later turn into a thesis statement.

Assignment: Discuss the history of the Reform Party and explain its influence on the 1990 presidential and Congressional election.

Purpose Statement: This paper briefly sketches the history of the grassroots, conservative, Perot-led Reform Party and analyzes how it influenced the economic and social ideologies of the two mainstream parties.

Question-to-Assertion

If your assignment asks a specific question(s), turn the question(s) into an assertion and give reasons why it is true or reasons for your opinion.

Assignment : What do Aylmer and Rappaccini have to be proud of? Why aren’t they satisfied with these things? How does pride, as demonstrated in “The Birthmark” and “Rappaccini’s Daughter,” lead to unexpected problems?

Beginning thesis statement: Alymer and Rappaccinni are proud of their great knowledge; however, they are also very greedy and are driven to use their knowledge to alter some aspect of nature as a test of their ability. Evil results when they try to “play God.”

Write a sentence that summarizes the main idea of the essay you plan to write.

Main idea: The reason some toys succeed in the market is that they appeal to the consumers’ sense of the ridiculous and their basic desire to laugh at themselves.

Make a list of the ideas that you want to include; consider the ideas and try to group them.

  • nature = peaceful
  • war matériel = violent (competes with 1?)
  • need for time and space to mourn the dead
  • war is inescapable (competes with 3?)

Use a formula to arrive at a working thesis statement (you will revise this later).

  • although most readers of _______ have argued that _______, closer examination shows that _______.
  • _______ uses _______ and _____ to prove that ________.
  • phenomenon x is a result of the combination of __________, __________, and _________.

What to keep in mind as you draft an initial thesis statement

Beginning statements obtained through the methods illustrated above can serve as a framework for planning or drafting your paper, but remember they’re not yet the specific, argumentative thesis you want for the final version of your paper. In fact, in its first stages, a thesis statement usually is ill-formed or rough and serves only as a planning tool.

As you write, you may discover evidence that does not fit your temporary or “working” thesis. Or you may reach deeper insights about your topic as you do more research, and you will find that your thesis statement has to be more complicated to match the evidence that you want to use.

You must be willing to reject or omit some evidence in order to keep your paper cohesive and your reader focused. Or you may have to revise your thesis to match the evidence and insights that you want to discuss. Read your draft carefully, noting the conclusions you have drawn and the major ideas which support or prove those conclusions. These will be the elements of your final thesis statement.

Sometimes you will not be able to identify these elements in your early drafts, but as you consider how your argument is developing and how your evidence supports your main idea, ask yourself, “ What is the main point that I want to prove/discuss? ” and “ How will I convince the reader that this is true? ” When you can answer these questions, then you can begin to refine the thesis statement.

Refine and polish the thesis statement

To get to your final thesis, you’ll need to refine your draft thesis so that it’s specific and arguable.

  • Ask if your draft thesis addresses the assignment
  • Question each part of your draft thesis
  • Clarify vague phrases and assertions
  • Investigate alternatives to your draft thesis

Sample Assignment

Choose an activity and define it as a symbol of American culture. Your essay should cause the reader to think critically about the society which produces and enjoys that activity.

  • Ask The phenomenon of drive-in facilities is an interesting symbol of american culture, and these facilities demonstrate significant characteristics of our society.This statement does not fulfill the assignment because it does not require the reader to think critically about society.
Drive-ins are an interesting symbol of American culture because they represent Americans’ significant creativity and business ingenuity.
Among the types of drive-in facilities familiar during the twentieth century, drive-in movie theaters best represent American creativity, not merely because they were the forerunner of later drive-ins and drive-throughs, but because of their impact on our culture: they changed our relationship to the automobile, changed the way people experienced movies, and changed movie-going into a family activity.
While drive-in facilities such as those at fast-food establishments, banks, pharmacies, and dry cleaners symbolize America’s economic ingenuity, they also have affected our personal standards.
While drive-in facilities such as those at fast- food restaurants, banks, pharmacies, and dry cleaners symbolize (1) Americans’ business ingenuity, they also have contributed (2) to an increasing homogenization of our culture, (3) a willingness to depersonalize relationships with others, and (4) a tendency to sacrifice quality for convenience.

This statement is now specific and fulfills all parts of the assignment. This version, like any good thesis, is not self-evident; its points, 1-4, will have to be proven with evidence in the body of the paper. The numbers in this statement indicate the order in which the points will be presented. Depending on the length of the paper, there could be one paragraph for each numbered item or there could be blocks of paragraph for even pages for each one.

Complete the final thesis statement

As you move through the process of crafting a thesis, you’ll need to remember four things:

  • Context matters! Think about your course materials and lectures. Try to relate your thesis to the ideas your instructor is discussing.
  • As you go through the process described in this section, always keep your assignment in mind . You will be more successful when your thesis (and paper) responds to the assignment than if it argues a semi-related idea.
  • Your thesis statement should be precise, focused, and contestable ; it should predict the sub-theses or blocks of information that you will use to prove your argument.
  • Make sure that you keep the rest of your paper in mind at all times. Change your thesis as your paper evolves, because you do not want your thesis to promise more than your paper actually delivers.

In the beginning, the thesis statement was a tool to help you sharpen your focus, limit material and establish the paper’s purpose. When your paper is finished, however, the thesis statement becomes a tool for your reader. It tells the reader what you have learned about your topic and what evidence led you to your conclusion. It keeps the reader on track–well able to understand and appreciate your argument.

When you set out to write an essay, there has to be some kind of point to it, right? Otherwise, your essay would just be a big jumble of word salad that makes absolutely no sense. An essay needs a central point that ties into everything else. That main point is called a thesis statement, and it’s the core of any essay or research paper.

You may hear about Master degree candidates writing a thesis, and that is an entire paper–not to be confused with the thesis statement, which is typically one sentence that contains your paper’s focus. 

Read on to learn more about thesis statements and how to write them. We’ve also included some solid examples for you to reference.

Typically the last sentence of your introductory paragraph, the thesis statement serves as the roadmap for your essay. When your reader gets to the thesis statement, they should have a clear outline of your main point, as well as the information you’ll be presenting in order to either prove or support your point. 

The thesis statement should not be confused for a topic sentence , which is the first sentence of every paragraph in your essay. If you need help writing topic sentences, numerous resources are available. Topic sentences should go along with your thesis statement, though.

Since the thesis statement is the most important sentence of your entire essay or paper, it’s imperative that you get this part right. Otherwise, your paper will not have a good flow and will seem disjointed. That’s why it’s vital not to rush through developing one. Step 1: Decide what kind of paper you’re writing

When you’re assigned an essay, there are several different types you may get. Argumentative essays are designed to get the reader to agree with you on a topic. Informative or expository essays present information to the reader. Analytical essays offer up a point and then expand on it by analyzing relevant information. Thesis statements can look and sound different based on the type of paper you’re writing. For example:

  • Argumentative: The United States needs a viable third political party to decrease bipartisanship, increase options, and help reduce corruption in government.
  • Informative: The Libertarian party has thrown off elections before by gaining enough support in states to get on the ballot and by taking away crucial votes from candidates.
  • Analytical: An analysis of past presidential elections shows that while third party votes may have been the minority, they did affect the outcome of the elections in 2020, 2016, and beyond.

Step 2: Figure out what point you want to make

Once you know what type of paper you’re writing, you then need to figure out the point you want to make with your thesis statement, and subsequently, your paper. In other words, you need to decide to answer a question about something, such as:

  • What impact did reality TV have on American society?
  • How has the musical Hamilton affected perception of American history?
  • Why do I want to major in [chosen major here]?

If you have an argumentative essay, then you will be writing about an opinion. To make it easier, you may want to choose an opinion that you feel passionate about so that you’re writing about something that interests you. For example, if you have an interest in preserving the environment, you may want to choose a topic that relates to that. 

If you’re writing your college essay and they ask why you want to attend that school, you may want to have a main point and back it up with information, something along the lines of:

“Attending Harvard University would benefit me both academically and professionally, as it would give me a strong knowledge base upon which to build my career, develop my network, and hopefully give me an advantage in my chosen field.”

Step 3: Determine what information you’ll use to back up your point

Once you have the point you want to make, you need to figure out how you plan to back it up throughout the rest of your essay. Without this information, it will be hard to either prove or argue the main point of your thesis statement. If you decide to write about the Hamilton example, you may decide to address any falsehoods that the writer put into the musical, such as:

“The musical Hamilton, while accurate in many ways, leaves out key parts of American history, presents a nationalist view of founding fathers, and downplays the racism of the times.”

Once you’ve written your initial working thesis statement, you’ll then need to get information to back that up. For example, the musical completely leaves out Benjamin Franklin, portrays the founding fathers in a nationalist way that is too complimentary, and shows Hamilton as a staunch abolitionist despite the fact that his family likely did own slaves. 

Step 4: Revise and refine your thesis statement before you start writing

Read through your thesis statement several times before you begin to compose your full essay. You need to make sure the statement is ironclad, since it is the foundation of the entire paper. Edit it or have a peer review it for you to make sure everything makes sense and that you feel like you can truly write a paper on the topic. Once you’ve done that, you can then begin writing your paper.

When writing a thesis statement, there are some common pitfalls you should avoid so that your paper can be as solid as possible. Make sure you always edit the thesis statement before you do anything else. You also want to ensure that the thesis statement is clear and concise. Don’t make your reader hunt for your point. Finally, put your thesis statement at the end of the first paragraph and have your introduction flow toward that statement. Your reader will expect to find your statement in its traditional spot.

How to Generate a Thesis Statement if the Topic is Assigned

Almost all assignments, no matter how complicated, can be reduced to a single question. Your first step, then, is to distill the assignment into a specific question. For example, if your assignment is, “Write a report to the local school board explaining the potential benefits of using computers in a fourth-grade class,” turn the request into a question like, “What are the potential benefits of using computers in a fourth-grade class?” After you’ve chosen the question your essay will answer, compose one or two complete sentences answering that question.

Q: “What are the potential benefits of using computers in a fourth-grade class?” A: “The potential benefits of using computers in a fourth-grade class are . . .”
A: “Using computers in a fourth-grade class promises to improve . . .”

The answer to the question is the thesis statement for the essay.

How to Generate a Thesis Statement if the Topic is not Assigned

Even if your assignment doesn’t ask a specific question, your thesis statement still needs to answer a question about the issue you’d like to explore. In this situation, your job is to figure out what question you’d like to write about.

A good thesis statement will usually include the following four attributes:

  • take on a subject upon which reasonable people could disagree
  • deal with a subject that can be adequately treated given the nature of the assignment
  • express one main idea
  • assert your conclusions about a subject

Let’s see how to generate a thesis statement for a social policy paper.

Brainstorm the topic . Let’s say that your class focuses upon the problems posed by changes in the dietary habits of Americans. You find that you are interested in the amount of sugar Americans consume.

You start out with a thesis statement like this:

Sugar consumption.

This fragment isn’t a thesis statement. Instead, it simply indicates a general subject. Furthermore, your reader doesn’t know what you want to say about sugar consumption.

Narrow the topic . Your readings about the topic, however, have led you to the conclusion that elementary school children are consuming far more sugar than is healthy.

You change your thesis to look like this:

Reducing sugar consumption by elementary school children.

This fragment not only announces your subject, but it focuses on one segment of the population: elementary school children. Furthermore, it raises a subject upon which reasonable people could disagree, because while most people might agree that children consume more sugar than they used to, not everyone would agree on what should be done or who should do it. You should note that this fragment is not a thesis statement because your reader doesn’t know your conclusions on the topic.

Take a position on the topic. After reflecting on the topic a little while longer, you decide that what you really want to say about this topic is that something should be done to reduce the amount of sugar these children consume.

You revise your thesis statement to look like this:

More attention should be paid to the food and beverage choices available to elementary school children.

This statement asserts your position, but the terms more attention and food and beverage choices are vague.

Use specific language . You decide to explain what you mean about food and beverage choices , so you write:

Experts estimate that half of elementary school children consume nine times the recommended daily allowance of sugar.

This statement is specific, but it isn’t a thesis. It merely reports a statistic instead of making an assertion.

Make an assertion based on clearly stated support. You finally revise your thesis statement one more time to look like this:

Because half of all American elementary school children consume nine times the recommended daily allowance of sugar, schools should be required to replace the beverages in soda machines with healthy alternatives.

Notice how the thesis answers the question, “What should be done to reduce sugar consumption by children, and who should do it?” When you started thinking about the paper, you may not have had a specific question in mind, but as you became more involved in the topic, your ideas became more specific. Your thesis changed to reflect your new insights.

How to Tell a Strong Thesis Statement from a Weak One

Remember that your thesis needs to show your conclusions about a subject. For example, if you are writing a paper for a class on fitness, you might be asked to choose a popular weight-loss product to evaluate. Here are two thesis statements:

There are some negative and positive aspects to the Banana Herb Tea Supplement.

This is a weak thesis statement. First, it fails to take a stand. Second, the phrase negative and positive aspects is vague.

Because Banana Herb Tea Supplement promotes rapid weight loss that results in the loss of muscle and lean body mass, it poses a potential danger to customers.

This is a strong thesis because it takes a stand, and because it's specific.

2. A strong thesis statement justifies discussion.

Your thesis should indicate the point of the discussion. If your assignment is to write a paper on kinship systems, using your own family as an example, you might come up with either of these two thesis statements:

My family is an extended family.

This is a weak thesis because it merely states an observation. Your reader won’t be able to tell the point of the statement, and will probably stop reading.

While most American families would view consanguineal marriage as a threat to the nuclear family structure, many Iranian families, like my own, believe that these marriages help reinforce kinship ties in an extended family.

This is a strong thesis because it shows how your experience contradicts a widely-accepted view. A good strategy for creating a strong thesis is to show that the topic is controversial. Readers will be interested in reading the rest of the essay to see how you support your point.

3. A strong thesis statement expresses one main idea.

Readers need to be able to see that your paper has one main point. If your thesis statement expresses more than one idea, then you might confuse your readers about the subject of your paper. For example:

Companies need to exploit the marketing potential of the Internet, and Web pages can provide both advertising and customer support.

This is a weak thesis statement because the reader can’t decide whether the paper is about marketing on the Internet or Web pages. To revise the thesis, the relationship between the two ideas needs to become more clear. One way to revise the thesis would be to write:

Because the Internet is filled with tremendous marketing potential, companies should exploit this potential by using Web pages that offer both advertising and customer support.

This is a strong thesis because it shows that the two ideas are related. Hint: a great many clear and engaging thesis statements contain words like because , since , so , although , unless , and however .

4. A strong thesis statement is specific.

A thesis statement should show exactly what your paper will be about, and will help you keep your paper to a manageable topic. For example, if you're writing a seven-to-ten page paper on hunger, you might say:

World hunger has many causes and effects.

This is a weak thesis statement for two major reasons. First, world hunger can’t be discussed thoroughly in seven to ten pages. Second, many causes and effects is vague. You should be able to identify specific causes and effects. A revised thesis might look like this:

I. What is a Thesis?

The thesis (pronounced thee -seez), also known as a thesis statement, is the sentence that introduces the main argument or point of view of a composition (formal essay, nonfiction piece, or narrative). It is the main claim that the author is making about that topic and serves to summarize and introduce that writing that will be discussed throughout the entire piece. For this reason, the thesis is typically found within the first introduction paragraph.

II. Examples of Theses

Here are a few examples of theses which may be found in the introductions of a variety of essays :

In “The Mending Wall,” Robert Frost uses imagery, metaphor, and dialogue to argue against the use of fences between neighbors.

In this example, the thesis introduces the main subject (Frost’s poem “The Mending Wall”), aspects of the subject which will be examined (imagery, metaphor, and dialogue) and the writer’s argument (fences should not be used).

While Facebook connects some, overall, the social networking site is negative in that it isolates users, causes jealousy, and becomes an addiction.

This thesis introduces an argumentative essay which argues against the use of Facebook due to three of its negative effects.

During the college application process, I discovered my willingness to work hard to achieve my dreams and just what those dreams were.

In this more personal example, the thesis statement introduces a narrative essay which will focus on personal development in realizing one’s goals and how to achieve them.

III. The Importance of Using a Thesis

Theses are absolutely necessary components in essays because they introduce what an essay will be about. Without a thesis, the essay lacks clear organization and direction. Theses allow writers to organize their ideas by clearly stating them, and they allow readers to be aware from the beginning of a composition’s subject, argument, and course. Thesis statements must precisely express an argument within the introductory paragraph of the piece in order to guide the reader from the very beginning.

IV. Examples of Theses in Literature

For examples of theses in literature, consider these thesis statements from essays about topics in literature:

In William Shakespeare’s “ Sonnet 46,” both physicality and emotion together form powerful romantic love.

This thesis statement clearly states the work and its author as well as the main argument: physicality and emotion create romantic love.

In The Scarlet Letter, Nathaniel Hawthorne symbolically shows Hester Prynne’s developing identity through the use of the letter A: she moves from adulteress to able community member to angel.

In this example, the work and author are introduced as well as the main argument and supporting points: Prynne’s identity is shown through the letter A in three ways: adulteress, able community member, and angel.

John Keats’ poem “To Autumn” utilizes rhythm, rhyme, and imagery to examine autumn’s simultaneous birth and decay.

This thesis statement introduces the poem and its author along with an argument about the nature of autumn. This argument will be supported by an examination of rhythm, rhyme, and imagery.

V. Examples of Theses in Pop Culture

Sometimes, pop culture attempts to make arguments similar to those of research papers and essays. Here are a few examples of theses in pop culture:

America’s food industry is making a killing and it’s making us sick, but you have the power to turn the tables.

The documentary Food Inc. examines this thesis with evidence throughout the film including video evidence, interviews with experts, and scientific research.

Blackfish Official Trailer #1 (2013) - Documentary Movie HD

Orca whales should not be kept in captivity, as it is psychologically traumatizing and has caused them to kill their own trainers.

Blackfish uses footage, interviews, and history to argue for the thesis that orca whales should not be held in captivity.

VI. Related Terms

Just as a thesis is introduced in the beginning of a composition, the hypothesis is considered a starting point as well. Whereas a thesis introduces the main point of an essay, the hypothesis introduces a proposed explanation which is being investigated through scientific or mathematical research. Thesis statements present arguments based on evidence which is presented throughout the paper, whereas hypotheses are being tested by scientists and mathematicians who may disprove or prove them through experimentation. Here is an example of a hypothesis versus a thesis:

Hypothesis:

Students skip school more often as summer vacation approaches.

This hypothesis could be tested by examining attendance records and interviewing students. It may or may not be true.

Students skip school due to sickness, boredom with classes, and the urge to rebel.

This thesis presents an argument which will be examined and supported in the paper with detailed evidence and research.

Introduction

A paper’s introduction is its first paragraph which is used to introduce the paper’s main aim and points used to support that aim throughout the paper. The thesis statement is the most important part of the introduction which states all of this information in one concise statement. Typically, introduction paragraphs require a thesis statement which ties together the entire introduction and introduces the rest of the paper.

VII. Conclusion

Theses are necessary components of well-organized and convincing essays, nonfiction pieces, narratives , and documentaries. They allow writers to organize and support arguments to be developed throughout a composition, and they allow readers to understand from the beginning what the aim of the composition is.

Once you've read the story or novel closely, look back over your notes for patterns of questions or ideas that interest you. Have most of your questions been about the characters, how they develop or change?

For example: If you are reading Conrad's The Secret Agent , do you seem to be most interested in what the author has to say about society? Choose a pattern of ideas and express it in the form of a question and an answer such as the following: Question: What does Conrad seem to be suggesting about early twentieth-century London society in his novel The Secret Agent ? Answer: Conrad suggests that all classes of society are corrupt. Pitfalls: Choosing too many ideas. Choosing an idea without any support.

Once you have some general points to focus on, write your possible ideas and answer the questions that they suggest.

For example: Question: How does Conrad develop the idea that all classes of society are corrupt? Answer: He uses images of beasts and cannibalism whether he's describing socialites, policemen or secret agents.

To write your thesis statement, all you have to do is turn the question and answer around. You've already given the answer, now just put it in a sentence (or a couple of sentences) so that the thesis of your paper is clear.

For example: In his novel, The Secret Agent , Conrad uses beast and cannibal imagery to describe the characters and their relationships to each other. This pattern of images suggests that Conrad saw corruption in every level of early twentieth-century London society.

Now that you're familiar with the story or novel and have developed a thesis statement, you're ready to choose the evidence you'll use to support your thesis. There are a lot of good ways to do this, but all of them depend on a strong thesis for their direction.

For example: Here's a student's thesis about Joseph Conrad's The Secret Agent . In his novel, The Secret Agent , Conrad uses beast and cannibal imagery to describe the characters and their relationships to each other. This pattern of images suggests that Conrad saw corruption in every level of early twentieth-century London society. This thesis focuses on the idea of social corruption and the device of imagery. To support this thesis, you would need to find images of beasts and cannibalism within the text.

While Sandel argues that pursuing perfection through genetic engineering would decrease our sense of humility, he claims that the sense of solidarity we would lose is also important.

This thesis summarizes several points in Sandel’s argument, but it does not make a claim about how we should understand his argument. A reader who read Sandel’s argument would not also need to read an essay based on this descriptive thesis.  

Broad thesis (arguable, but difficult to support with evidence) 

Michael Sandel’s arguments about genetic engineering do not take into consideration all the relevant issues.

This is an arguable claim because it would be possible to argue against it by saying that Michael Sandel’s arguments do take all of the relevant issues into consideration. But the claim is too broad. Because the thesis does not specify which “issues” it is focused on—or why it matters if they are considered—readers won’t know what the rest of the essay will argue, and the writer won’t know what to focus on. If there is a particular issue that Sandel does not address, then a more specific version of the thesis would include that issue—hand an explanation of why it is important.  

Arguable thesis with analytical claim 

While Sandel argues persuasively that our instinct to “remake” (54) ourselves into something ever more perfect is a problem, his belief that we can always draw a line between what is medically necessary and what makes us simply “better than well” (51) is less convincing.

This is an arguable analytical claim. To argue for this claim, the essay writer will need to show how evidence from the article itself points to this interpretation. It’s also a reasonable scope for a thesis because it can be supported with evidence available in the text and is neither too broad nor too narrow.  

Arguable thesis with normative claim 

Given Sandel’s argument against genetic enhancement, we should not allow parents to decide on using Human Growth Hormone for their children.

This thesis tells us what we should do about a particular issue discussed in Sandel’s article, but it does not tell us how we should understand Sandel’s argument.  

Questions to ask about your thesis 

  • Is the thesis truly arguable? Does it speak to a genuine dilemma in the source, or would most readers automatically agree with it?  
  • Is the thesis too obvious? Again, would most or all readers agree with it without needing to see your argument?  
  • Is the thesis complex enough to require a whole essay's worth of argument?  
  • Is the thesis supportable with evidence from the text rather than with generalizations or outside research?  
  • Would anyone want to read a paper in which this thesis was developed? That is, can you explain what this paper is adding to our understanding of a problem, question, or topic?

Thesis Statement

Definition of thesis statement.

A thesis statement is a statement that occurs at the end of the introduction , after the background information on the topic. The thesis statement is connected with the background information through a transition , which could be a full sentence , or a simple transition word, such as therefore, because, but etc.

The thesis statement is called the “heart of the essay .” The idea of an essay without a thesis statement is akin to a body without its heart. It also is called the “central point” or the “core” of an essay. It is comprised of evidences that the writer uses to elaborate on his topic further. Each of these evidences is then elaborated and discussed in the body paragraphs .

If there are three body paragraphs, the thesis statement must have three evidences, and should it have more than three body paragraphs, may be additional evidences. In argumentative essays, three evidences support the topic, while the fourth evidence is against it. The same is the case of persuasive essays. This applies to five-paragraph essays, but in case of a longer essay, the thesis statement could make use of more than one sentence.

There is a slight controversy over the placement of a thesis statement. Some writers and professors argue that it could be placed in the first paragraph at the end, while others feel that, in longer essays, it is not possible to give background information in just one paragraph. As background information takes two or three paragraphs, the thesis statement is kept slightly larger, having two or three sentences, and is placed at the end of the second or third paragraph. However, in a five-paragraph essay, the thesis statement is always placed at the end of the introduction, after the background information.

Qualities of a Good Thesis Statement

  • It must have evidences.
  • It should be interesting.
  • It should be limited.
  • It should be manageable.
  • It should be researchable.

Difference Between a Thesis Statement and Topic

Sometimes students confuse a thesis statement with a topic, mistaking the thesis statement as the very topic of the essay they are going to read. However, it must be kept in mind that a thesis statement is not a topic, but a brief explanation of the topic in a way that sets the direction of the essay. It predicts the path the essay will take, and tells readers how the essay is going to be organized, and what each part contains.

The topic, however, is a general idea of the essay. It is a specific topic, which has been organized by the thesis statement. The thesis statement in turn elaborates evidences to support to the topic.

Examples of Good and Bad Thesis Statements

  • Bad Thesis Statement – “Social media is proving a good marketing tool.”
  • Good Thesis Statement – “Social media is proving to be, not only a better marketing tool, but also a source of advertisement for short and medium enterprises intending to expand their consumer base.”

Examples of Thesis Statements in Literature

Example #1:  dream on (by mark krikorian in national review online ).

“The core principal behind this amnesty proposal is that it is amid at those who have grown up here and are, psychologically and emotionally, Americans.”

This is the first sentence of the second paragraph. The second sentence further elaborates this thesis. It is placed in the second paragraph because the first paragraph introduces the controversial DREAM Act. As the writer is going to argue against the bill, he has stated his argument as to why he is going to oppose it. This is a very compact thesis statement with various implicit counter arguments.

Example #2: Editorial (by The Washington Post)

“There is no doubt that the attacks profoundly affected our country’s policy, politics, economics, society and even collective psychology. Moreover, in addition to sharing the immediate experience of September 9/11, Americans have dealt with its consequences in the years since.”

This is the best thesis statement with clear evidences in it. It is not as complicated as other thesis statements usually are.

Example #3: I Have a Dream (by Martin Luther King)

“In a sense we’ve come to our nation’s capital to cash a check. When the architects of our republic wrote the magnificent words of the Constitution and the Declaration of Independence, they were signing a promissory note to which every American was to fall heir. This note was a promise that all men, yes, black men as well as white men, would be guaranteed the ‘unalienable Rights’ of ‘Life, Liberty and the pursuit of Happiness.’ It is obvious today that America has defaulted on this promissory note, insofar as her citizens of color are concerned. Instead of honoring this sacred obligation, America has given the Negro people a bad check, a check which has come back marked ‘insufficient funds’.”

This is one of the best examples of long thesis statements. It highlights what Martin Luther King is going to speak about. It comes after three paragraphs of background information.

Function of Thesis Statement

A good thesis statement is the heart of an essay. It gives a gist of the thoughts a writer expresses in his essay. It determines the shape of the essay, predicts its content, and foreshadows its events. It narrates the whole story in just one sentence, provided the essay is a short one. Without a thesis statement, an essay is just a written piece, not an organized and well-connected essay

8.4: Creating and Revising a Thesis Statement

HOW CAN I CREATE A THESIS?

TOPIC + OPINION + SO WHAT? = THESIS

Step 1 : Brainstorm Topics

Here are some questions that could help you:

  • What in the text inspired, confused, angered, excited, annoyed, and/or surprised you?
  • What in the text was important for you to understand or you feel others should be aware of?
  • What does the prompt/assignment ask you to focus on and explore?

Brainstorm the issues, ideas, and themes raised in the reading (create at least 15 for a range of options):

Step 2 : Select a topic

Choose one of the topics that most interest you and you want to explore further:

Step 3 : Create complex questions about your topic

Create complex questions to be answered with opinion, not facts or yes/no answers. Here are some question formats that could help you: How is (topic) connected to (outside issue)? How do the flaws in the author’s arguments on (topic) result in (outcome)? What angles on (topic) have been overlooked? How can we apply the information about (topic)? How did/will (effect) occur because/if (cause) happened or will happen? How can (problem) be addressed or changed for (topic)?

Step 4 : Answer your best question with your opinion.

This creates a rough thesis statement.

Step 5 : Ask yourself “so what?” So what is the impact, importance, outcomes, or larger implications?

This strengthens and deepens your thesis statement.

Step 6 : Using your answer with its significance, write a 1-2 sentence thesis statement.

This refines and focuses your thesis statement.

Step 7 : Test the thesis by seeing if you can gather good evidence to support it.

Go through the main text(s) you are writing on and list all the passages (using page numbers) that directly prove and/or illustrate your argument: List potential outside evidence, such as research, outside sources, real-life examples, personal knowledge, personal examples that could possibly further prove and/or illustrate your argument: If you cannot find strong or sufficient evidence, then rethink your thesis statement.

Step 1 : Brainstorm Topics Here are some questions that could help you:

Reading and writing as dangerous

How is control of human beings connected to writing and reading?

Why were the slaveholders so fearful of slaves learning to read and write?

When has reading lead to violence and uprising?

What about becoming educated leads to Douglass’s despair?

Slaves were controlled by not being able to read and write because they could not learn by reading the arguments and experiences of others and from history what is fair, just and reasonable and what is not.

So what? We should be concerned because in certain parts of the world today, what the public can read and write is controlled and as a result the rights of the people are violated and they are powerless or ignorant of this.

The control and limitations over reading and writing during slavery sought to make slaves like Douglass ignorant, powerless, and more easily controlled, and this control over literacy and education is still happening in the world today.

Go through the main text(s) you are writing on and list all the passages (using page numbers) that directly prove and/or illustrate your argument:

  • Douglass discovers that “… education and slavery were incompatible with each other.” (1)
  • On page 2 it describes how Douglass read in “The Columbian Orator” how a slave used logic and persuasive argument so well that his master freed him (shows education can lead to change).
  • Reading and education makes one intolerant of injustice: “The more I read, the more I was led to abhor and detest my enslavers” (2).
  • Douglass says: “…that very discontentment which Master Hugh had predicted would follow my learning to read had already come, to torment and sting my soul to unutterable anguish. As I writhed under it, I would at times feel that learning to read had been a curse rather than a blessing. It had given me a view of my wretched condition, without the remedy. It opened my eyes to the horrible pit, but to no ladder upon which to get out. In moments of agony, I envied my fellow-slaves for their stupidity” (2) (But Douglass did not give up and later was instrumental in abolishing slavery)

List potential outside evidence, such as research, outside sources, real-life examples, personal knowledge, personal examples that could possibly further prove and/or illustrate your argument:

  • Mukhtar Mai in her memoir In the Name of Honor , tells how as a woman in Pakistan, she was not allowed to learn to read and write. As a result, when she was publically gang raped in 2002 by members of a more powerful clan, she went to the police and they wrote down an incorrect statement of the account so after years of going through the court system, the men were acquitted. Since then she has learned to read and write, she has started schools to educate girls, and remains today an outspoken advocate for women’s rights.
  • In Alex S. Jones’s Losing the News: The Future of the News that Feeds Democracy he argues that in the United States we are losing funding and support for investigative journalism so Americans are getting sound bites of news and no real understanding of what is going on politically or financially so we don’t protest and don’t understand the sources for the larger societal problems like the recent financial collapse.
  • Jonathan Kozol in Savage Inequalities , looks at different cities and sees how many of the urban poor, most of whom are black and Latino, are not given an equal education because school funding is based on income and property tax. As a result, there is an enormous dropout rate and many of these kids can barely read and write.

HOW CAN I REVISE AND STRENGTHEN A THESIS?

Changing ineffective thesis statements to effective ones:.

1. A strong thesis statement takes a stand: your thesis needs to show your conclusions about a subject.

WEAK THESIS: Douglass makes the interesting point that there are some negative and positive aspects to reading.

This is a weak thesis statement. It fails to take a stand and the words interesting and negative and positive aspects are vague.

STRONGER THESIS:

2. A strong thesis statement justifies discussion: your thesis should indicate the point of the discussion.

WEAK THESIS: Christians practiced slavery in the United States.

This is a weak thesis statement because it merely states a fact, so your reader won’t be able to tell the point of the statement.

3. A strong thesis statement expresses one main idea: Readers need to be able to see that your paper has one main point. If your thesis statement expresses more than one idea, then you might confuse your readers about the subject of your paper.

WEAK THESIS: People should not follow unjust laws and showing strong determination is what helped Douglass to be successful.

This is a weak thesis statement because the reader can’t decide whether the paper is about unjust laws or strong determination. To revise the thesis, the relationship between the two ideas needs to become clearer. STRONGER THESIS:

4. A strong thesis statement is specific: A thesis statement should show exactly what your paper will be about and the argument should be narrow enough to be concretely proven.

WEAK THESIS: Slavery in the United States damaged many lives.

This is a weak thesis statement for two reasons. First, slavery can’t be discussed thoroughly in a short essay. Second, damaged is vague and many lives is very general. You should be able to identify specific causes and effects. STRONGER THESIS:

College Writing: Parts of the Essay

The three-story thesis.

You have no doubt been drilled on the need for a thesis statement and its proper location at the end of the introduction. And you also know that all of the key points of the paper should clearly support the central driving thesis. Indeed, the whole model of the five-paragraph theme hinges on a clearly stated and consistent thesis. However, some students are surprised—and dismayed—when some of their early college papers are criticized for not having a good thesis. Their professor might even claim that the paper doesn’t have a thesis when, in the author’s view it clearly does. So, what makes a good thesis in college?

  • A good thesis is non-obvious . High school teachers needed to make sure that you and all your classmates mastered the basic form of the academic essay. Thus, they  were mostly concerned that you had a clear and consistent thesis, even if it was something obvious like “sustainability is important.” A thesis statement like that has a wide-enough scope to incorporate several supporting points and concurring evidence, enabling the writer to demonstrate his or her mastery of the five-paragraph form. Good enough! When they can, high school teachers nudge students to develop arguments that are less obvious and more engaging. College instructors, though, fully expect you to produce something more developed.
  • A good thesis is arguable . In everyday life, “arguable” is often used as a synonym for “doubtful.” For a thesis, though, “arguable” means that it’s worth arguing: it’s something with which a reasonable person might disagree. This arguability criterion dovetails with the non-obvious one: it shows that the author has deeply explored a problem and arrived at an argument that legitimately needs 3, 5, 10, or 20 pages to explain and justify. In that way, a good thesis sets an ambitious agenda for a paper. A thesis like “sustainability is important” isn’t at all difficult to argue for, and the reader would have little intrinsic motivation to read the rest of the paper. However, an arguable thesis like “sustainability policies will inevitably fail if they do not incorporate social justice,” brings up some healthy skepticism. Thus, the arguable thesis makes the reader want to keep reading.
  • A good thesis is well specified . Some student writers fear that they’re giving away the game if they specify their thesis up front; they think that a purposefully vague thesis might be more intriguing to the reader. However, consider movie trailers: they always include the most exciting and poignant moments from the film to attract an audience. In academic papers, too, a well specified thesis indicates that the author has thought rigorously about an issue and done thorough research, which makes the reader want to keep reading. Don’t just say that a particular policy is effective or fair; say what makes it is so. If you want to argue that a particular claim is dubious or incomplete, say why in your thesis.
  • A good thesis includes implications . Suppose your assignment is to write a paper about some aspect of the history of linen production and trade, a topic that may seem exceedingly arcane. And suppose you have constructed a well supported and creative argument that linen was so widely traded in the ancient Mediterranean that it actually served as a kind of currency. [1]   That’s a strong, insightful, arguable, well specified thesis. But which of these thesis statements do you find more engaging?
Version A: Linen served as a form of currency in the ancient Mediterranean world, connecting rival empires through circuits of trade. Version B: Linen served as a form of currency in the ancient Mediterranean world, connecting rival empires through circuits of trade. The economic role of linen raises important questions about how shifting environmental conditions can influence economic relationships and, by extension, political conflicts.

Putting your claims in their broader context makes them more interesting to your reader and more impressive to your professors who, after all, assign topics that they think have enduring significance. Finding that significance for yourself makes the most of both your paper and your learning.

How do you produce a good, strong thesis? And how do you know when you’ve gotten there? Many instructors and writers find useful a metaphor based on this passage by Oliver Wendell Holmes, Sr. [2] :

There are one-story intellects, two-story intellects, and three-story intellects with skylights. All fact collectors who have no aim beyond their facts are one-story men. Two-story men compare, reason, generalize using the labor of fact collectors as their own. Three-story men idealize, imagine, predict—their best illumination comes from above the skylight.

The biggest benefit of the three-story metaphor is that it describes a process for building a thesis. To build the first story, you first have to get familiar with the complex, relevant facts surrounding the problem or question. You have to be able to describe the situation thoroughly and accurately. Then, with that first story built, you can layer on the second story by formulating the insightful, arguable point that animates the analysis. That’s often the most effortful part: brainstorming, elaborating and comparing alternative ideas, finalizing your point. With that specified, you can frame up the third story by articulating why the point you make matters beyond its particular topic or case.

For example, imagine you have been assigned a paper about the impact of online learning in higher education. You would first construct an account of the origins and multiple forms of online learning and assess research findings about its use and effectiveness. If you’ve done that well, you’ll probably come up with a well considered opinion that wouldn’t be obvious to readers who haven’t looked at the issue in depth. Maybe you’ll want to argue that online  learning is a threat to the academic community. Or perhaps you’ll want to make the case that online learning opens up pathways to college degrees that traditional campus-based learning does not. In the course of developing your central, argumentative point, you’ll come to recognize its larger context; in this example, you may claim that online learning can serve to better integrate higher education with the rest of society, as online learners bring their educational and career experiences together.

To outline this example:

  • First story : Online learning is becoming more prevalent and takes many different forms.
  • Second story : While most observers see it as a transformation of higher education, online learning is better thought of an extension of higher education in that it reaches learners who aren’t disposed to participate in traditional campus-based education.
  • Third story : Online learning appears to be a promising way to better integrate higher education with other institutions in society, as online learners integrate their educational experiences with the other realms of their life, promoting the freer flow of ideas between the academy and the rest of society.

Here’s another example of a three-story thesis: [4]  

  • First story : Edith Wharton did not consider herself a modernist writer, and she didn’t write like her modernist contemporaries.
  • Second story : However, in her work we can see her grappling with both the questions and literary forms that fascinated modernist writers of her era. While not an avowed modernist, she did engage with modernist themes and questions.
  • Third story : Thus, it is more revealing to think of modernism as a conversation rather than a category or practice.

Here’s one more example:

  • First story : Scientists disagree about the likely impact in the U.S. of the light brown apple moth (LBAM) , an agricultural pest native to Australia.
  • Second story : Research findings to date suggest that the decision to spray pheromones over the skies of several southern Californian counties to combat the LBAM was poorly thought out.
  • Third story : Together, the scientific ambiguities and the controversial response strengthen the claim that industrial-style approaches to pest management are inherently unsustainable.

A thesis statement that stops at the first story isn’t usually considered a thesis. A two-story thesis is usually considered competent, though some two-story theses are more intriguing and ambitious than others. A thoughtfully crafted and well informed three-story thesis puts the author on a smooth path toward an excellent paper.

The Organizational Statement

Sometimes, an organization statement will be used in conjunction with a thesis.  An organizational statement is a map that tells readers what they should expect to read in an essay.  It introduces the two or three main pieces of evidence that the author will use to support the essay’s position. While not required in a thesis, organizational statements can make for stronger thesis statements.

An organizational statement can take the form of a separate sentence or can be attached to a thesis in a single sentence, as seen in the examples below. The organizational elements appear in bold text: 

Movies produced in the mid-1950s used obsessive behavior to depict teenage romance as something dangerous that should be avoided.  Obsessive behavior was viewed as rebellious, uncontrollable, and harmful , both to the teenagers and to the people who loved them.
Since obsessive behavior was viewed as rebellious, uncontrollable, and dangerous , movies produced in the mid-1950s used it to depict teenage romance as something that should be avoided for the sake of young adults and the people who loved them.

Notice how the second version, above, strengthens the original thesis by appearing as part of the same sentence.  

Evidence in the body of an essay should be presented in the same order in which it appears in an organizational statement. In the example above, it means the paper would have to discuss rebelliousness, an uncontrollable nature, and danger (as they relate to obsessive teenage romance in film) in that order .

Ways to Revise Your Thesis

You can cut down on irrelevant aspects and revise your thesis by taking the following steps:

  • Pinpoint and replace all nonspecific words, such as people , everything , society , or life , with more precise words in order to reduce any vagueness. Working thesis: Young people have to work hard to succeed in life. Revised thesis: Recent college graduates must have discipline and persistence in order to find and maintain a stable job in which they can use and be appreciated for their talents. The revised thesis makes a more specific statement about success and what it means to work hard. The original includes too broad a range of people and does not define exactly what success entails. By replacing those general words like people and work hard , the writer can better focus his or her research and gain more direction in his or her writing.
  • Clarify ideas that need explanation by asking yourself questions that narrow your thesis. Working thesis: The welfare system is a joke. Revised thesis: The welfare system keeps a socioeconomic class from gaining employment by alluring members of that class with unearned income, instead of programs to improve their education and skill sets. A joke means many things to many people. Readers bring all sorts of backgrounds and perspectives to the reading process and would need clarification for a word so vague. This expression may also be too informal for the selected audience. By asking questions, the writer can devise a more precise and appropriate explanation for joke . The writer should ask himself or herself questions similar to the 5WH questions. (See Chapter 8 “The Writing Process: How Do I Begin?” for more information on the 5WH questions.) By incorporating the answers to these questions into a thesis statement, the writer more accurately defines his or her stance, which will better guide the writing of the essay.
  • Who is not paying the teachers enough?
  • What is considered “enough”?
  • What is the problem?
  • What are the results
  • Which teenage girls?
  • What constitutes “too” sexualized?
  • Why are they behaving that way?
  • Where does this behavior show up?
  • What are the repercussions?

Trump trial in "hush money" case gets underway with opening statements and first witness

Jurors in former President Donald Trump's criminal trial in New York got their first glimpse Monday of the arguments both sides plan to make over the course of the historic proceedings, with the prosecution and defense teams presenting their opening statements as Trump looked on.

Prosecutors also called their first witness to the stand: David Pecker, the former CEO of American Media Inc., or AMI, the parent company of the National Enquirer. The state alleges Pecker helped Trump during the 2016 campaign by burying negative stories about him and attacking his rivals.

Pecker testified for less than a half hour before the court adjourned for the day. He will resume testimony on Tuesday, after a hearing over whether Trump should be held in contempt of court for defying a gag order imposed by the judge in the case.

Trump is charged with 34 felony counts of falsifying business records, allegedly to cover up a "hush money" payment before the 2016 election. He has pleaded not guilty. An attorney from Manhattan District Attorney Alvin Bragg's office said the reimbursements were part of a scheme that amounted to "election fraud, pure and simple." Trump's lawyer argued that his client did not commit a crime, and said he has been charged on flimsy evidence from an untrustworthy key witness.

Arriving at the courthouse, Trump claimed the trial was "election interference" and part of an effort to keep him off the campaign trail. He called the case a "witch hunt" and "a shame."

The proceedings are not being televised, since New York law doesn't allow recording of criminal proceedings. CBS News had reporters in the courtroom and in a nearby overflow room watching the trial.

Prosecutors' opening statement

Lawyers from Bragg's office had 40 minutes to present their opening statements, and Trump's attorneys had 25 minutes. Matthew Colangelo, a member of Bragg's team, kicked things off for the prosecution, laying out the central allegations in the case. 

Just days before the 2016 election, Trump's attorney at the time, Michael Cohen, paid $130,000 to adult film star Stormy Daniels to buy her silence about an alleged sexual encounter she said she had with Trump years earlier. Trump denies the encounter.

Colangelo said Cohen made the payment "at the defendant's direction, and did it to influence the election." He portrayed the payment as part of a scheme concocted by Trump, Cohen and Pecker to bury negative stories about Trump and attack his rivals. The plan was hatched at a meeting at Trump Tower in 2015, Colangelo said.

"Together they conspired to influence the 2016 presidential election," Colangelo told the jury , saying Pecker agreed to act as Trump's "eyes and ears" during the 2016 campaign.

Colangelo laid out the "catch and kill" tactic allegedly used by Pecker and Dylan Howard, the Enquirer's editor, to shield Trump from negative stories. The practice involved buying the rights to someone's story and then declining to publish the account, effectively keeping it hidden. They also used the Enquirer to publish unflattering stories about Trump's rivals.

Prosecutors allege AMI, the Enquirer's parent company, employed the "catch and kill" tactic twice before the payment to Daniels. One instance involved a $150,000 payment to a former Playboy model to secure the rights to her story. The model, Karen McDougal, also alleged an affair with Trump, which he denies. Colangelo told jurors they would hear a recording of Cohen promising to set up a shell company to buy the rights to McDougal's story from the Enquirer to reimburse Pecker for the purchase.

In the weeks leading up to the 2016 election, Daniels' lawyer approached the Enquirer about selling the rights to her story as well, Colangelo said. Howard put the lawyer in touch with Cohen, who negotiated the $130,000 payment, according to prosecutors. Colangelo said Trump hoped to delay the deal until after the election, and then not pay at all. Cohen ultimately transferred the money to Daniels' attorney just days before Election Day.

"This was a planned, coordinated, long-running conspiracy to influence the 2016 election to help Donald Trump get elected," Colangelo told the jury. "It was election fraud, pure and simple."

Trump reimbursed Cohen for the payment in 12 monthly installments during the first year of his presidency, portraying them as checks for ongoing legal services in an illegal scheme to conceal their true purpose, according to prosecutors. Cohen ultimately received $420,000 — more than double the $130,000 payment to Daniels.

"Donald Trump was a very frugal businessman. He believed in pinching pennies. He believed in watching every dollar. He believed in negotiating every bill. He ran the Trump Organization with total control. You'll hear testimony about his relentless focus on the bottom line. With Cohen and the 'catch and kill' deal, he didn't negotiate the price down, he doubled it," Colangelo said. "And you'll hear evidence that the Trump Organization was not in the practice of paying twice what they owed for anything."

The defense's statement

Todd Blanche, an attorney for Trump, delivered the defense's opening statement after Colangelo. He said the jury is "going to learn that this was not a payback."

"Think for a moment of what the People just told you. President Trump did not pay Mr. Cohen back $130,000. President Trump paid Michael Cohen $420,000," Blanche said, as Trump watched him. "Would a frugal businessman, would a man who 'pinches pennies,' repay a $130,000 debt to the tune of $420,000?"

He said the $35,000 that Cohen received each month was for his services as Trump's personal attorney, not as reimbursement for the Daniels payment. He argued that Trump "had nothing to do with the 34 pieces of paper ... except that he signed them in the White House, while he was running the country." Each charge in the indictment refers to a record created to document a payment to Cohen.

"There's nothing wrong with trying to influence an election. It's called democracy. They've put something sinister on this idea, as if it was a crime," Blanche continued. "President Trump fought back like he always does, and like he's entitled to do. To protect his family, his reputation and his brand. And that is not a crime."

Blanche said Cohen is "obsessed" with Trump and has been for "many, many years." He argued that Cohen decided "to blame President Trump for all of his problems" when he was arrested on federal charges in 2018.

"He has talked extensively about his desire to see President Trump go to prison. He has talked extensively about his desire to see President Trump's family go to prison," Blanche said.

"He has a goal, and obsession, with getting Trump," he continued, adding later, "I submit to you that he cannot be trusted."

Blanche later noted that Cohen has lied under oath, and said Daniels had a grudge against Trump after not being cast on "The Apprentice" in 2007. Blanche claimed Daniels has profited from her allegations.

"I'll also say something else about her testimony: it doesn't matter," Blanche said, telling jurors she has "no idea" about the alleged crimes at the center of the case. "Her testimony, while salacious, does not matter."

Finally, he turned to the "catch and kill" tactic, saying it's not illegal and not a conspiracy.

"It's not a scheme, unless a scheme means something that doesn't matter, that's not illegal, that's not against the law," Blanche said.

David Pecker's testimony

On the stand, Pecker testified broadly about AMI's operations and Howard's role as editor in chief of the National Enquirer. Pecker left the company in 2020.

Under questioning by prosecutor Joshua Steinglass, Pecker said he had final say over what Steinglass described as particularly "juicy" stories.

"We used checkbook journalism," Pecker said, describing how editors were empowered to spend up to $10,000 on sourcing for stories, but that larger expenses "would have to be vetted and brought up to me for approval."

Pecker confirmed that Howard "kind of ran the network of sources for all of AMI's publications." 

"As an editor of a tabloid magazine, you develop over the years a group of sources, and the sources might be the people who work in hotels, the people who work for lawyers, people who work for various different aspects a celebrity might be using — for example, like a limousine service."

Pecker said he had heard that Howard is now living in his native Australia, with a spinal condition that makes international travel impossible.

After less than 30 minutes, Merchan adjourned the court for the day, and implored jurors not to discuss the case outside the courthouse.

"Please put the case out of your mind," he said. "Don't think about it. Don't talk about it. And don't read anything about it."

WASHINGTON − At landmark arguments Thursday in Donald Trump's longshot Supreme Court bid for presidential immunity, his test case is Richard Nixon.

After Nixon avoided criminal charges from Watergate through a presidential pardon, he set the standard for whether presidents can face lawsuits.

An Air Force weapons analyst had sued Nixon, claiming he’d been fired in retaliation for telling Congress about massive cost overruns in the Defense Department.

A closely divided Supreme Court said in 1982 Nixon couldn’t be held liable for official actions because civil suits would be too distracting for a president and make him unnecessarily cautious when carrying out his responsibilities.

Now the Supreme Court will hear oral arguments April 25 on whether that same logic should apply to Trump’s attempt to throw out the federal criminal charges he he attempted to steal the 2020 election.

Many experts think the justices are likely to reject Trump’s claim of absolute immunity. But even if they do, how long it takes them to issue an opinion and whether a majority finds that presidents have some immunity will determine if Trump can be tried before the November election.

“The first and most important pivotal question is whether the court will rule in a way that allows the case to then continue immediately,” said Harry Litman, a former U.S. attorney and deputy assistant attorney general.

Trump trial already delayed

The Supreme Court’s decision to hear the appeal of the presumptive GOP nominee has already diminished the chances that a trial that was supposed to start in March can be completed before the election.

The delay has critics charging that the court may have already granted Trump immunity if there’s no trial and Trump wins the election, putting him in a position to get rid of the Justice Department’s case against him.  

“I think there have been some absolutely indefensible choices on the part of the United States Supreme Court that have effectively immunized Donald Trump,” New York University law professor Melissa Murray said at a recent event sponsored by the Brennan Center for Justice at New York University.

But Stanley Brand, a former House general counsel who has represented Trump aides in legal fights, said there’s no expectation in criminal law that cases involving candidates need to fit within an election schedule.

“The notion that the criminal justice system is designed to give the electorate a reason to vote or not to vote is a complete abomination and distortion of what the criminal justice system is about,” Brand said. “The criminal justice system is never about what the public thinks. It’s about the defendant’s rights and whether the government has met its burden.”

New territory for Supreme Court

The Supreme Court is deciding a novel question because Trump is the first president – former or current – to be criminally charged.

In the case before the high court , Trump is accused of trying to overturn the 2020 election by spreading lies about election fraud and attempting to persuade state officials, his vice president and Congress to prevent the certification of the legitimate results. (The case is separate from criminal charges he faces in state courts in New York and Georgia and in federal court in Florida .)

Trump hopes the 1982 Supreme Court decision, Nixon v. Fitzgerald, will save him. In that ruling, the court said presidents are immune both while in office and after from civil damages for official acts, including those on the “outer perimeter of a president’s official responsibilities.”

`President Trump has become citizen Trump'

Trump wants that same protection extended to criminal cases. Otherwise, his lawyers argue, the threat of future prosecution and imprisonment “would become a political cudgel to influence the most sensitive and controversial presidential decisions, taking away the strength, authority, and decisiveness of the presidency.”

“A denial of criminal immunity would incapacitate every future president with de facto blackmail and extortion while in office, and condemn him to years of post-office trauma at the hands of political opponents,” his lawyers told the court in their main brief previewing their oral argument.

The federal district judge overseeing Trump’s trial and the D.C. Circuit Court of Appeals didn’t buy it.

"For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant," the unanimous three-judge panel of the appeals court wrote in a resounding rejection of Trump’s claim.

Even if Trump’s actions were done in his official capacity, rather than in his personal one as a candidate , the public’s interest in the enforcement of criminal laws is significant, the court said. And that’s particularly true in a case involving a presidential election, they wrote.

Special prosecutor Jack Smith argues that the fact that President Gerald Ford pardoned Nixon shows that presidents have never expected to be immune from criminal prosecution.

`A hard case to game out'

Alex Reinert, a criminal law expert at the Benjamin N. Cardozo School of Law in New York City, said the Supreme Court likely agreed to hear Trump’s appeal because of how important the issue of presidential immunity is.

Reinert, who clerked for former Justice Stephen Breyer, said the justices will try to probe what level of immunity would balance the rule of law against the need for presidential protection against baseless and harassing prosecutions.

“I think it's a hard case to game out,” he said. “But I do think it comes down to the outer boundaries of the rules that the court thinks is going to be manageable ... and supportable. It's got to be a principled line that’s judicially manageable, that the court thinks won't have too many negative downstream consequences. But I do think there's a lot of leeway there for the court to figure out what the best rule is.”

Others hope the court will issue a narrow ruling specific to Trump’s case and not take the time to explore other scenarios.

“Donald Trump has articulated an outrageous, unprecedented, and ahistorical assertion of absolute immunity,” said former Obama White House ethics czar Norm Eisen. “The Supreme Court need not stray into other questions just because Trump has made it easy for them. They should decide this case.”

Tough to go to trial before election

If the Supreme Court rules that presidents enjoy criminal immunity only in specific circumstances, Trump wants the protection to spread as broadly as possible and wants the court to direct that any “fact-based” test be applied through additional proceedings before his trial can start.  

Justice Department special counsel Jack Smith has told the court any qualifications it puts on immunity should not delay the trial.

If the justices agree with Smith, a trial could start before the election though may not finish, Reinert estimates.

“I think it would take a lot to get to a trial before November,” he said. “But I do think it’s possible.”

Not a fast process

John Yoo, a former Justice Department official under George W. Bush, expects Trump’s broad immunity argument to fail but thinks Trump can still fight some of the charges.

“I think the court will deny immunity but then let him proceed to make his substantive attacks on the indictment,” Yoo said during a Federalist Society preview of the case.

Brand said even run-of-the-mill, white collar cases he’s been involved in can take years to go to trial.

“The expectation has been created that this is a fast process,” he said. “Generally, it’s not.”

P rosecutors in Donald Trump's criminal trial in New York used their opening statement to lay out a bold — and potentially risky — thesis: "Trump orchestrated a criminal scheme to corrupt the 2016 presidential election."

Why it matters: Manhattan District Attorney Alvin Bragg wants his case — widely considered the weakest of the four indictments Trump faces — to be viewed beyond the context of a sordid, years-old sex scandal.

The big picture: These dueling narratives will color each side's presentations as a jury of 12 New Yorkers considers whether to convict a former president for the first time in U.S. history.

  • To the prosecution, Trump's alleged scheme to pay hush money to cover up negative stories during his 2016 campaign was "election fraud, pure and simple."
  • To the defense, the 34 charges Trump faces for falsifying business records "are really just 34 pieces of paper" — a simple dispute over "bookkeeping."

Zoom in: The prosecution alleges that Trump, his former lawyer Michael Cohen and tabloid publisher David Pecker hatched a conspiracy in 2016 to "catch and kill" stories that could have damaged Trump's campaign.

  • Those included alleged affairs with adult film star Stormy Daniels and former Playboy model Karen McDougal, as well as an uncorroborated claim that Trump fathered a child out of wedlock with an ex-employee.
  • "Another story about sexual infidelity, especially with a porn star, on the heels of the 'Access Hollywood' tape, could have been devastating to his campaign," Colangelo said, referencing the 2005 recording of Trump boasting about grabbing women without their consent.

The other side: Blanche — declaring that Trump is "cloaked in innocence" — took repeated digs at the credibility of Cohen and Daniels, who are expected to be witnesses for the prosecution.

  • "Michael Cohen wanted a job in the [Trump] administration. He didn't get one," Blanche said, calling Trump's former fixer a "criminal" who's "obsessed" with the idea of sending Trump to jail.
  • "Daniels saw her chance to make a lot of money, $130,000, against Trump," Blanche said of the former adult film star, forecasting her testimony "salacious" but irrelevant to the charges.

The bottom line: Unlike his cases in Georgia and D.C., Trump has not been charged with crimes related to election interference in New York.

  • Bragg insists that's not necessary to prosecute the "cover-up," but opening statements made one thing clear: A conviction will require the jury to believe that Trump was willing to lie his way to victory in 2016.

Former president Donald Trump is digging in against a potential ban of TikTok that is moving through Congress — and seeking to blame President Biden for it — even though Trump sought to outlaw the social media application when he was in the White House.

“Just so everyone knows, especially the young people, Crooked Joe Biden is responsible for banning TikTok,” Trump said Monday in a post on his Truth Social platform. He accused Biden of wanting to help Facebook become more powerful and possibly meddle in elections to hurt Republicans.

Trump’s post came two days after the House, as part of a broad foreign aid package , passed legislation that would force TikTok’s China-based parent company to sell the application within about a year or face a national ban. Biden endorsed the package and last month said he would sign an earlier version of the TikTok legislation that the House passed.

“As far as TikTok is concerned, we’re banning them from the United States,” Trump said in July 2020 .

But Trump’s public stance on the social media app swung in the other direction in recent months, with the former president arguing in March that a TikTok ban would only empower Facebook, which he has called “an enemy of the people.” Trump’s post on Monday appeared to be the first time he explicitly referenced Biden while railing against proposals to force a TikTok sale.

Asked for comment on Trump’s post, Biden’s reelection campaign referred to the White House, which denied it was working to shut down TikTok.

“We’ve been clear: we do not want to ban apps like TikTok,” White House spokesperson Robyn Patterson said in a statement. “What we want — and what the legislation we support would do — is ensure that TikTok becomes owned by an American company so that our and our children’s sensitive personal data stays here instead of going to China and so that Americans’ understandings and views can’t be manipulated by algorithms potentially controlled by the [People’s Republic of China].”

Trump accused Biden of wanting to shut down TikTok to “help his friends over at Facebook” become more powerful and “be able to continue to fight, perhaps illegally, the Republican Party.” Under the bill passed on a 360-58 vote by the House Saturday, TikTok’s owner would have up to 360 days to divest, meaning any ban is not likely to happen until after Election Day.

The chamber in March passed an earlier version of the bill trying to force a TikTok sale on a shorter timeline, but it has languished in the Senate. The latest proposal’s attachment to the foreign aid package could boost its chances in the upper chamber.

Trump’s reversal on TikTok raised questions about his relationship with Jeff Yass, a Republican megadonor from Pennsylvania who is also a TikTok investor. Trump, who is working to cultivate more heavyweight GOP donors as Biden builds a large fundraising advantage , met earlier this year with Yass but said afterward that they did not discuss TikTok.

A former top aide in Trump’s White House, Kellyanne Conway, is advocating for TikTok in Congress and has spoken to Trump about the importance of defending the application, The Washington Post reported last month . Conway is being paid by the Club for Growth, the conservative group that counts Yass as one of its biggest donors.

Trump has called TikTok a national security threat but also touted its popularity, saying in a March interview with CNBC that there is “a lot of good and there’s a lot of bad with TikTok.”

“As you know, I was at a point where I could have gotten it done if I wanted to,” Trump said, suggesting he ultimately wanted to leave the matter to Congress. “I sort of said, ‘You guys decide, you make that decision,’ because it’s a tough decision to make. Frankly, there are a lot of people on TikTok that love it.”

Manhattan prosecutors delivered a raw recounting of Donald J. Trump’s seamy past on Monday as they debuted their case against him to jurors, the nation and the world, reducing the former president to a co-conspirator in a plot to cover up three sex scandals that threatened his 2016 election win.

Their opening statement was a pivotal moment in the first prosecution of an American president, a sweeping synopsis of the case against Mr. Trump, who watched from the defense table, occasionally shaking his head. Moments later, Mr. Trump’s lawyer delivered his own opening, beginning with the simple claim that “President Trump is innocent,” then noting that he is once again the presumptive Republican nominee and concluding with an exhortation for jurors to “use your common sense.”

The jury of 12 New Yorkers who will weigh Mr. Trump’s legal fate before millions of voters decide his political future also heard brief testimony from the prosecution’s leadoff witness, David Pecker, a former tabloid publisher who was close with Mr. Trump. Mr. Pecker, who ran The National Enquirer, testified that his supermarket tabloids practiced “checkbook journalism.” In this case, prosecutors say, he bought and buried stories that could have imperiled Mr. Trump’s 2016 campaign.

The flurry of activity on the landmark trial’s first formal day captivated jurors, many of whom jotted notes as they followed along.

And it sent nervous energy through a Lower Manhattan courthouse as bomb-sniffing dogs, the U.S. Secret Service and the police patrolled the dingy building. The spectacle was a vivid reminder of the proceeding’s unprecedented nature: A courthouse accustomed to cycling through trials of murderers, fraudsters and felons of all types now had its first former president.

On Monday, the trial ended early and with little fanfare, to accommodate the Passover holiday and a juror’s emergency dental appointment.

But it began in striking fashion, with the judge, Juan M. Merchan, determining what prosecutors could ask of Mr. Trump should he take the witness stand in his own defense. In a victory for the prosecution, the judge ruled that they could question him about three civil trials he lost over the last year — including a fraud case in which a different judge found him liable for conspiring to inflate his net worth, and penalized him hundreds of millions of dollars.

Matthew Colangelo , a senior aide to the Manhattan district attorney, Alvin L. Bragg, then seized on what he called a conspiracy in the criminal case. Over the course of a 45-minute opening, as Mr. Bragg watched from the front row, Mr. Colangelo calmly walked the jury through the prosecution’s argument that Mr. Trump orchestrated the plot to corrupt the 2016 election.

The scheme, he explained, involved hush-money deals with three people who had salacious stories to sell: a porn star, a Playboy model and a doorman at one of Mr. Trump’s buildings.

Mr. Trump, who faces up to four years in prison, directed allies to buy those people’s silence to protect his candidacy, Mr. Colangelo explained. Mr. Pecker took care of the model and the doorman, while Michael D. Cohen, Mr. Trump’s former fixer who is set to be the prosecution’s star witness, paid off the porn star.

After taking the White House, Mr. Colangelo added, Mr. Trump agreed to “cook the books” to cover up Mr. Cohen’s $130,000 payment to the porn star, Stormy Daniels. When Mr. Trump reimbursed Mr. Cohen, Mr. Colangelo said, Mr. Trump and his company falsified internal records, disguising the repayments as routine legal expenses.

Mr. Trump faces 34 felony counts of falsifying business records, one for each false check, ledger and invoice.

The former president lied “over and over and over” again, Mr. Colangelo emphatically said, casting him as a conniving criminal.

But Mr. Trump’s lawyer Todd Blanche sought to undercut the prosecution’s lofty rhetoric with a more innocuous distillation of the case, calling it a “business records violation” that wasn’t.

Instead, he said, it was “just 34 pieces of paper.”

Who Are Key Players in the Trump Manhattan Criminal Trial?

The first criminal trial of former President Donald J. Trump is underway. Take a closer look at central figures related to the case.

The opening statements offered dueling interpretations of a case that has transfixed much of the political and legal worlds. Mr. Bragg, in essence, has put Mr. Trump’s 2016 campaign on trial during the heart of the 2024 election.

A year ago, Mr. Bragg was the first prosecutor to indict Mr. Trump. Three other indictments followed in three other cities, on charges that he plotted to overturn his 2020 election loss and mishandled classified records once he was no longer president. But with those cases delayed, Mr. Bragg’s trial may be the only one that Mr. Trump will face before Election Day.

In Monday’s opening statement, Mr. Colangelo unspooled a scathing account of events surrounding Mr. Trump’s insurgent run for the White House.

It began in summer 2015, soon after Mr. Trump announced his candidacy, with a meeting among Mr. Trump, Mr. Pecker and Mr. Cohen. They met at the candidate’s Midtown Manhattan headquarters, where they hatched what the prosecutor called “the Trump Tower conspiracy.”

The plan was to watch out for any damaging stories about Mr. Trump — and then hide them from voters.

Such stories arose swiftly. Soon, Mr. Pecker bought the silence of the doorman, whose story about Mr. Trump fathering a child out of wedlock turned out to be false.

Then came the Playboy model, Karen McDougal, who said she had an affair with Mr. Trump while he was married. The National Enquirer again stepped in, buying the rights to her story and then never publishing it, a practice known in the tabloid business as “catch and kill.”

The third and most legally problematic deal — the $130,000 payoff to Ms. Daniels — took shape in the campaign’s waning weeks.

Ms. Daniels threatened to go public with her decade-old story of sex with Mr. Trump just as his campaign was reeling from the release of the “Access Hollywood” recording, in which Mr. Trump boasts about grabbing women’s genitals.

“The campaign went into immediate damage control mode to blunt the impact of the tape,” Mr. Colangelo said, and that included keeping Ms. Daniels quiet. “Another story about sexual infidelity, especially with a porn star, on the heels of the ‘Access Hollywood’ tape, could have been devastating to his campaign.”

Once Mr. Trump was elected and had to repay Mr. Cohen, he and his company falsified the records to cover it up, Mr. Colangelo said.

“He wanted to conceal his and others’ criminal conduct,” Mr. Colangelo told the jury, arguing that the falsification “shows just how important it was to him to hide the true nature of Cohen’s illegal payment to Ms. Daniels and the overall election conspiracy.”

Mr. Blanche, for his part, disputed that any accusations amounted to election interference. “I have a spoiler alert: There’s nothing wrong with trying to influence an election,” he said. “It’s called democracy. They put something sinister on this idea as if it were a crime. You’ll learn it’s not.”

Mr. Trump is not formally charged with election interference, but the accusation underpins the case.

In New York, falsifying business records is a felony if a defendant did so to conceal another crime. And in this case, Mr. Trump is accused of violating a state law by engaging in “conspiracy to promote or prevent election.” The case could rest upon that assertion.

The judge has allowed prosecutors to discuss the two other hush-money deals, which they will use to bolster the idea that the plot was meant to elect Mr. Trump, not just to protect him and his family from humiliation.

“It was election fraud, pure and simple,” Mr. Colangelo declared.

Prosecutors at hush money trial say Trump led 'porn star payoff' scheme to 'corrupt' 2016 election

Donald Trump "orchestrated a criminal scheme to corrupt the 2016 presidential election," a prosecutor told jurors Monday during opening statements in the first criminal trial of a former president.

"This case is about a criminal conspiracy and a cover-up,” prosecutor Matthew Colangelo told the 12-person jury and six alternates. Trump, he said, conspired to corrupt the 2016 presidential election by scheming with his lawyer Michael Cohen and David Pecker, who was the publisher of the National Enquirer at the time.

“Then, he covered up that criminal conspiracy by lying in his New York business records over and over and over again,” Colangelo said.

Pecker was called as the prosecution's first witness following opening statements from both sides. Trump's lawyer Todd Blanche told the jury his client was not guilty because no crime was committed.

Trump, who had his eyes closed for periods during the morning proceedings, seemed much more engaged when his old ally and friend Pecker was taking the stand. Trump craned his neck when Pecker walked in, almost as if to see whether Pecker would meet his eye. Trump also poked at his attorney Emil Bove and whispered something as Pecker, 72, got situated, and he leaned forward attentively when he began testifying.

Pecker did not get to his relationship with Trump by the time the court day ended. The proceedings ended early because a juror had an emergency dental appointment.

Trump told reporters afterward that the case was "unfair" and launched into an attack against Cohen, who's expected to be called as witness.

"When are they going to look at all the lies that Cohen did in the last trial? He got caught lying in the last trial. Pure lying," Trump said, apparently referring to Cohen's statement in the civil fraud case against Trump that he lied under oath during part of his 2018 guilty plea. "When are they going to look at that?” Trump said.

The comments are likely to come up at a hearing Tuesday morning, when Manhattan District Attorney Alvin Bragg's office is scheduled to argue that Trump has repeatedly violated a partial gag order barring him from making "public statements about known or reasonably foreseeable witnesses concerning their potential participation in the investigation or in this criminal proceeding."

Prosecutors have said Cohen and Pecker, the longtime former publisher of the Enquirer, are central figures in the alleged scheme to bury claims from women who said they had had affairs with Trump.

Colangelo told the jurors they will hear about a 2015 meeting at Trump Tower with Trump, Cohen and Pecker. Both Cohen and Pecker had specific roles to play in the scheme, Colangelo said. “Cohen’s job really was to take care of problems for the defendant,” he said. “He was Trump’s fixer.” Pecker, meanwhile, would act as “the eyes and ears” for Trump and would let him and Cohen know about any allegations that could hurt his campaign.

The DA alleges the three conspired to hide “damaging information from the voting public.” That included allegations from a former Playboy model named Karen McDougal who said she had a 10-month sexual relationship with Trump that ended in April 2007. Pecker’s AMI agreed to pay her $150,000 in a deal to essentially buy her silence — a practice that was referred to as “catch and kill.” Trump has denied McDougal's claims.

The situation took on a greater sense of urgency for Trump in October 2016. That's when The Washington Post published the " Access Hollywood " tape, which caught Trump on a hot mic saying he could grope women without their consent because "when you're a star, they let you do it."

Judge Juan Merchan barred the DA from playing the tape for the jury for fear it would be too prejudicial, but he did allow prosecutors to use a transcript of Trump's remarks.

Colangelo said the impact of the tape was “immediate and explosive.”

“The defendant and his campaign were concerned that it would irrevocably damage him with female voters,” he said, and "the campaign went into immediate damage control mode."

It was around that time that the Enquirer heard that adult film actress Stormy Daniels was interested in coming forward with a claim that she had a sexual encounter with Trump in 2006. Trump was "adamant" he didn't want that claim, which he denies, to become public for fear it would be "devastating" to his campaign, Colangelo said.

Cohen then struck a deal to buy Daniels' silence for $130,000, Colangelo said.

"It was election fraud, pure and simple," Colangelo said, adding “We’ll never know, and it doesn’t matter, if this conspiracy was a difference maker in the close election.”

Colangelo said the Trump Organization, Trump’s company, couldn’t cut Cohen a check with the memo “reimbursement for porn star payoff” so "they agreed to cook the books" and make it look like the reimbursement was income.

"The defendant said in his business records that he was paying Cohen for legal services pursuant to a retainer agreement. But, those were lies. There was no retainer agreement," Colangelo said.

“It was instead what they thought was a clever way to pay Cohen back without being too obvious about it,” he said. But what they did was a crime, Colangelo said. “Donald Trump is guilty of 34 counts of falsifying business records in the first degree,” he concluded.

Trump's attorney Blanche countered in his opening statement that his client hasn’t committed any crimes. “The story you just heard, you will learn, is not true,” he said. "President Trump is innocent. President Trump did not commit any crimes."

He said the only thing Trump did was sign checks for legal services rendered by his lawyer.

“The invoice is processed, somebody at Trump Tower generated a check, the check was ultimately signed, and there was a record in the ledger,” Blanche said. “He’s the only signatory on his personal checking account, which is why he signed the check.

"So what on Earth is a crime? What’s a crime, of what I just described?” Blanche said. "None of this is a crime," he said, adding that nondisclosure agreements like the one Daniels signed are legal.

As for the election interference argument, Blanche said, “I have a spoiler alert: There’s nothing wrong with trying to influence an election. It’s called democracy.”

In a preview of his trial strategy, Blanche also attacked Daniels' and Cohen's character and credibility. He accused Daniels, whom he described as "extremely biased," of trying to "extort" Trump, a word that the judge ordered stricken from the record. Blanche then said what Daniels had been threatening to do by going public with her allegation was "sinister" and "damaging to [Trump] and damaging to his family.”

Blanche also said Daniels' testimony, while salacious, doesn't matter because she doesn't know anything about how Cohen was repaid.

The bulk of Blanche's attacks were reserved for Cohen, who pleaded guilty in 2018 to numerous crimes, including some that he said he carried out on Trump's behalf.

“Michael Cohen was obsessed with President Trump. He’s obsessed with President Trump, even to this day,” Blanche said, calling him a "convicted felon" and a "convicted liar."

“He has talked extensively about his desire to see President Trump go to prison,” Blanche said, including in public on Sunday.

He told the jurors that if they listen to the evidence, they'll return "a very swift not guilty verdict."

Cohen said in a statement afterward, “The facts will come out at the time of trial that contradicts Todd Blanche’s mischaracterizations of me.”

Trump faces 34 counts of falsifying business records related to the hush money payment to Daniels. Trump, who has pleaded not guilty , could face up to four years in prison if he is convicted.

On his way into the courtroom Monday morning, he told reporters: “It’s a very, very sad day in America. I can tell you that.”

The day got off to a rough start for Trump, with Merchan, the judge, ruling that if he winds up taking the stand in his own defense, prosecutors can cross-examine him about another New York judge's finding that he and his business committed "persistent" fraud and violated a gag order, juries' finding him civilly responsible for sexual abuse and defamation in the E. Jean Carroll cases and a settlement in a case that found he used his now- shuttered foundation to improperly further his campaign in the 2016 election. Trump's attorneys had argued that all of those topics should be out of bounds.

Trump didn't show concern — he sat with his eyes closed through much of Merchan's ruling. He briefly opened his eyes when the jury was brought in for the judge's instructions and then closed them again.

Bragg was sitting in the front row of the courtroom ahead of opening statements.

Cohen, Daniels and McDougal are also expected to testify during the trial, which is estimated to take six weeks.

The jury consists of seven men and five women. The final day of jury selection, Friday, was particularly intense , as some potential jurors broke down in tears and said they were too anxious to be seated. They were excused. A man also set himself on fire outside the courthouse.

Trial proceedings Tuesday will be abbreviated, ending at 2 p.m. ET because of the Passover holiday.

The case, brought by the Manhattan district attorney, Alvin Bragg, hinges on a $130,000 payment that Trump’s former lawyer and fixer, Michael Cohen , made to Daniels to keep her story under wraps. Bragg contends that Trump masked the true nature of the payment in business records, by describing repayments to Cohen as lawful legal expenses.

In his opening statements on Monday, the prosecutor Matthew Colangelo told jurors that Trump invited his friend Pecker to a meeting at Trump Tower in summer 2015. Trump had recently thrown his hat into the ring for the 2016 Republican nomination, and Colangelo said Trump, Cohen and Pecker hatched a plan to keep damaging information about Trump out of the press.

According to the prosecution, Pecker agreed to run damaging information in the National Enquirer about opponents – including an item claiming, falsely, that Senator Ted Cruz had family connections to the JFK assassination – as well as buying up negative stories for the express purpose of preventing them from being published.

Colangelo said this “catch-and-kill” campaign was geared towards helping Trump’s 2016 election campaign.

He mentioned an earlier payment to Karen McDougal, the Playboy model who claimed to have had an affair with Trump. “Pecker will also testify that $150,000 was way more than AMI would normally pay for this kind of story, but he discussed it with Donald Trump and he discussed it with Michael Cohen, and he agreed on the deal with the understanding what Trump would find a way to pay AMI back,” Colangelo said. “The company coordinated directly with the candidate.”

He also read out a transcript of Trump’s infamous comments , caught on a hot mic, on the set of the Access Hollywood television show, where Trump bragged he could sexually assault women because he was famous. Colangelo quoted Trump saying : “Just kiss. I don’t even wait. And when you’re a star, they let you do it. You can do anything … Grab ’em by the pussy. You can do anything.”

Noting that the video was released to the public in October 2016, one month before election day, Colangelo said: “The campaign went into immediate damage control mode” and tried to frame the remarks as “locker room talk” – but were terrified the Daniels allegation would show that his boorish behavior extended to actions, not just talk.

“Another story about infidelity, with a porn star, on the heels of the Access Hollywood tape, would have been devastating to his campaign,” Colangelo said.

Cohen was therefore tasked with handling the payment to Daniels, for $130,000, which Trump is alleged to have repaid to him after the election in checks that were listed in business records as legal services. Colangelo said that was a lie. “The defendant was paying him back for an illegal payment to Stormy Daniels on the eve of the election.

“He wanted to conceal his and others’ criminal conduct.”

“Look, no politician wants bad press, but the evidence at trial will show that this wasn’t spin or communication strategy,” Colangelo said. “This was a planned, coordinated, long-running conspiracy to influence the 2016 election, to help Donald Trump get elected through illegal expenditures – to silence people with something bad to say about his behavior,” Colangelo said.

“It was election fraud, pure and simple.”

Colangelo added that “we’ll never know” whether this conspiracy made the difference “in a close election”.

Cohen, who pleaded guilty in 2018, is expected to be one of the prosecution’s star witnesses. Trump has denied having a sexual encounter with Daniels and insists payments to Cohen were above-board legal expenses.

In the defense’s opening statements, Trump’s attorney Todd Blanche said as much: “President Trump is innocent. President Trump did not commit any crimes. The Manhattan district attorney should never have brought this case.”

Blanche made an effort to humanize Trump, while also repeatedly calling him “President Trump”. “He’s, in some ways, larger than life. But he’s also here in this courtroom doing what any of us would do – defending himself,” he said. “He’s also a man, he’s a husband, he’s a father, he’s a person who’s just like you and just like me.”

Blanche argued that Trump was unaware about the specifics of the hush-money payments because he left it all to Cohen. Trump had nothing to do with the 34 checks other than to sign them, Blanche said.

He added: “There’s nothing wrong with trying to influence an election. It’s called democracy.” Prosecutors, he said, “they put something sinister on this idea, as if it was a crime. You’ll learn: it’s not.”

He defended Trump’s attempt to address Daniels’s “sinister” allegations, calling it an attempt to try to “embarrass President Trump, to embarrass his family, because as the people alluded to at that time, there were all kinds of salacious allegations going around about President Trump, and it was damaging to him and it was damaging to his family”.

“You will hear during this trial President Trump fought back – like he always does – like he’s entitled to do to protect his family, his reputation, and his brand – that is not a crime.”

He attacked Cohen, alleging he wanted a job in the Trump administration but did not get one, and saying “he’s obsessed with President Trump, even to this day” to the extent of having multiple podcasts over Trump and waxing enthusiastic about the possibility of his former boss’ conviction. Cohen, he noted, was found to have lied under oath, further undermining his reliability.

As for Daniels, he dismissed her role in the trial as immaterial: “It doesn’t matter. What I mean by that is, I expect you will learn that Ms Daniels doesn’t have any idea. She doesn’t know anything about the charge, 34 counts in this case. She has no idea what Michael Cohen wrote on the invoice … her testimony, while salacious, does not matter.”

He concluded by emphasizing that catch-and-kills of the kind arranged by Trump, Cohen and Pecker of the National Enquirer are not illegal. “This sort of thing happens regularly, where newspapers [make] decisions about what to publish, where to publish, how to publish,” Blanche said. “It happens with politicians, famous people, wealthy people.”

As for Pecker, in brief questioning before the court adjourned, he was asked about his power to control coverage at the National Enquirer – setting up later prosecution efforts to prove he was integral to the catch-and-kill conspiracy. Pecker confirmed the paper paid for stories. “Being in the publishing industry for 40 years, I realized early in my career that the only thing that was important is the cover of a magazine, so when the editors produced the story or prepared a cover, we would have a meeting and they would present to me what the story would be, what the concept was, what the cost was going to be,” he said.

Trump, who has appeared mostly dour throughout the proceedings and fell asleep briefly at several points last week, looked very attentive to and focused on Pecker’s testimony, conferring repeatedly with his lawyers and taking notes on the yellow legal pad in front of him.

The New York City case is just one of several criminal proceedings against Trump. He faces federal charges in relation to the January 6 insurrection, as well as his handling of classified documents at his Mar-a-Lago home. In Georgia, he faces state-level charges related to allegedly trying to subvert 2020 election results.

Trump is nonetheless poised to land the Republican presidential nomination this summer after easily defeating his party rivals.
