Royal insider says Princess Kate photo scandal shows "wheels are coming off" Kensington Palace PR

London —  Three days after an image of Catherine, the Princess of Wales, and her children was dropped by international photo agencies over photo manipulation, one veteran royal watcher told CBS News on Tuesday that Kensington Palace just keeps "digging themselves deeper into this mess, frankly, that they've created."

In January, it was announced that Kate, as the princess is commonly known, would be having a planned abdominal surgery and taking time to heal privately until Easter on March 31. After she wasn't seen in public for some time, speculation began to grow online about her whereabouts and well-being.

When the family photo of Kate and her three kids was published on her and her husband's social media pages on Sunday, the date of U.K. Mother's Day, it was immediately scrutinized, and people quickly noticed some clear signs that it had been altered.

It appeared the image had been edited in a number of places, with one of Kate's hands unusually blurred and a zipper, a skirt and some tiles appearing misaligned. On Monday morning, Kate issued a brief apology for causing confusion and admitted to editing the image.

"The palace did always say, 'We're not going to give you any health updates on [Kate's] condition. She's going to have this operation, and she'll be back,'" CBS News contributor Tina Brown, author of the book "The Palace Papers," said Tuesday of the messaging from the palace. "She is indeed [entitled to privacy] and should have it. The problem is that when you released the picture, it is a health update. The picture is a health update saying, 'Look at me, look at us, I'm perfectly fine.' So, of course the world descends on that picture to dissect it."

Brown speculated that releasing the original unaltered image, which media outlets have requested and many online have called for, but Kensington Palace has declined to do, would most likely be impossible.

"I'm deeply skeptical that there was an 'original'" Brown said on "CBS Mornings." "I think it's a jigsaw of different pictures."

Brown said a short public appearance by Kate — even just a brief one via Zoom — would help calm public scrutiny.

"At the end of her life, Queen Elizabeth II , she had bone cancer. And in the last eight months of her life, she was on Zoom. She managed to come out onto that balcony and hold onto that stick. People didn't realize that she was actually wheelchair bound in the last six months of her life. The public never saw that, but that was what it was. So why they can't simply have Kate on a sort of, 50-second Zoom, saying, 'I'm here, I'm fine.' Bam. That's the end of it. The kind of hiding that they're doing, it seems excessive to me," Brown said. "I think all she needs to do is wave from a car window. That's really all she needs to do. And smile. And it's puzzling that that doesn't happen."

CBS News reached out to Buckingham Palace for confirmation of Queen's Elizabeth II's condition prior to her death in September 2022  and was told "any such details of her majesty Queen Elizabeth's health or condition were not confirmed or guided in any way." The palace has never said she had bone cancer or used a wheelchair, though it did say she had "mobility issues." Queen Elizabeth's death certificate says she died of "old age." A 2022 biography of Queen Elizabeth by Gyles Brandreth, reportedly a close friend of the late Queen's husband, Prince Phillip, said he had heard she had myeloma.

Brown said Kensington Palace was going through a staffing transition, and that could be the reason for some of the issues.

"It's possible that this was a transitional bad staffing situation, where no one is really properly paying attention, but clearly the public is going to look at a hand with no wedding ring and say, 'Where is it?'" Brown said. "I think that the wheels are coming off in terms of the sort of press situation there at the palace."

Brown added that, in today's world, a public relations problem cannot be handled by simply retreating from the public eye.

"This old idea, really, that you can completely disappear, it just doesn't work. It didn't work in [Princess] Diana's day," Brown said. "I do think [Kate] clearly feels ill and depleted, and she wants this time. But I also think, you know, there's been so much strain and stress on her. She's been trying to say, 'Can I just recover quietly and in peace?' just like Diana tried. And they won't let you do it."

What happens when a lawless judge and a terrible appeals court embrace the dopiest First Amendment claim you’ve ever heard out of pure spite toward a Democratic president? That would be Murthy v. Missouri , a brain-meltingly dumb case that the Supreme Court was unfortunate enough to hear oral arguments in on Monday. Murthy poses a question so asinine that to ask it is to answer it: Can government officials encourage social media companies to moderate certain content that they deem harmful—most importantly, disinformation about COVID-19 in the middle of the pandemic?

Yes, of course they can: The First Amendment does not gag public officials from urging Facebook or the Washington Post or anyone else to publish or not publish certain information, especially when it contains dangerous lies about a once-in-a-century pandemic that could exacerbate the crisis. The First Amendment bars government censorship, not government persuasion, and the Biden administration planted itself on the latter side of that bright line. At least six justices grasped this basic constitutional principle on Monday. Several of them used arguments to highlight how this inane case illustrates so much of what’s wrong with the judiciary today, and hinted at the dangers it could pose to American democracy in the future. That we should pay attention to. The rest was an unfortunate sideshow.

They filed their complaint in the Monroe Division of the Western District of Louisiana, where—surprise!—they were guaranteed to draw a Trump appointee, Terry Doughty, the one judge hearing cases in that division. Judge Doughty has a record of issuing nationwide injunctions against the Biden administration on the basis of dubious legal and factual analysis. Most notably, he issued a nationwide bar against Biden’s vaccine mandate for health care workers in an opinion riddled with anti-vax nonsense (which the Supreme Court reversed ).

Doughty, in other words, was certain to rule against Biden in the social media case. Even still, the opinion he handed down on July 4, 2023, was a humiliating mess of contradictions, fabrications , and (ironically) misinformation . Doughty adopted the plaintiffs’ theory that the administration “coerced” social media companies into removing “conservative” speech about COVID, including posts promoting hydroxychloroquine and rejecting the efficacy of vaccines. He accused government officials of launching a “coordinated campaign” to silence conservatives by forcing private companies to take down anti-vax content, as well as false claims about election fraud. And he issued one of the most sweeping injunctions in the history of the American legal system, prohibiting any employee—including Homeland Security, the State Department, the Department of Justice, and the FBI—from “engaging in any communication of any kind with social-media companies” encouraging content moderation.

Doughty, it turns out, grievously butchered the record to reach his conclusion. An exhaustive analysis by Mike Masnick proves that Doughty consistently misrepresented testimony and other evidence in the record to construct a conspiracy theory with zero basis in reality. He distorted emails and other exchanges to make them look coercive when they were nothing of the sort, cherry-picking and rearranging quotations to put them in a censorious light. Yet the hard-right U.S. Court of Appeals for the 5 th Circuit, where law goes to die , affirmed Doughty’s conclusions and upheld much of his injunction (while narrowing it in part). That move sent the administration racing to the Supreme Court for an emergency stay, which it granted in October, over the dissents of Justices Samuel Alito, Neil Gorsuch, and Clarence Thomas. Monday’s arguments confirmed that a majority is prepared to side with Biden on the merits.

The justices did not sound happy to have the case before them. Justice Sonia Sotomayor scolded Louisiana Solicitor General Benjamin Aguiñaga (a former Alito clerk) for his lack of candor. “I have such a problem with your brief,” she told him. “You omit information that changes the context of some of your claims. You attribute things to people who it didn’t happen to.” Aguiñaga was unable to defend Doughty’s more extreme deceptions. So he had to fall back on what Justice Elena Kagan called an “extremely expansive” argument: the notion that “encouraging people to suppress their own speech” violates the First Amendment, even if it isn’t coercive. Kagan drew upon her past work in the executive branch to explain that, actually, government officials do this all the time . “I’ve had some experience encouraging press to suppress their own speech,” Kagan told Aguiñaga. Example: “You just wrote a bad editorial. Here are the five reasons you shouldn’t write another one.” Is that really unconstitutional?

Justice Brett Kavanaugh, a former White House staff secretary, also provided a real-world perspective after Alito fumed that officials had been too mean to the platforms and would never treat the traditional press so sharply. Kavanaugh gave Alito a reality check: “I’d assumed, thought, [and] experienced government press people throughout the federal government who regularly call up the media and berate them,” he told Deputy Solicitor General Brian Fletcher, who defended the administration. “You said the anger was unusual. I wasn’t entirely clear on that from my own experience.” Translation: Government employees yell at members of the media all the time. The media can accept or reject their requests. That is how it works .

But did Biden officials berate social media employees? Only on a few rare occasions. Here’s what really happened: The platforms in question, most prominently Facebook and Twitter, invited the government to help them identify and remove the most toxic disinformation. At the time, as Fletcher explained, these companies were eager to present themselves as “partners” with the administration in its push for COVID vaccination. Officials could “flag” questionable content, but the platforms made their own judgment calls, without any demonstrable fear of retaliation. Everyone agrees that the government violates free speech when it explicitly coerces companies into censoring expression under the threat of punishment. But, Fletcher persuasively argued, no such thing happened here.

That left Aguiñaga to lean on the theory that the government contravenes the First Amendment when it merely “encourages” specific content moderation. Justice Amy Coney Barrett, a stickler for legible rules, sounded borderline aghast at this baggy, boundless standard; she lobbed a series of hypotheticals at Aguiñaga that showed he was pushing a meaningless and impracticable test. Chief Justice John Roberts tried to help Aguiñaga understand that multiple agencies with competing agendas may pressure platforms in contradictory directions; doesn’t that “dilute the concept of coercion significantly?” (Aguiñaga just sounded confused.) Kavanaugh pointed out that the plaintiffs’ position could prevent officials from urging the press to safeguard national security by, for instance, asserting that a forthcoming article might imperil the troops.

Even Gorsuch, who started out sympathetic to Aguiñaga, was exasperated by the end, complaining that Doughty’s “universal injunction” was part of the “epidemic” that had to be stopped. Only Alito and Thomas sounded like surefire votes for the plaintiffs after nearly two hours of arguments, and Thomas’ heart was not fully in it. Alito stood alone in his increasingly uncontrolled and seething aggrievement .

The pandemic may be over, but Murthy remains a hugely relevant case. Perhaps most obviously, it is a cautionary tale about the extremism of Trump judges like Doughty, who keep issuing these lawless injunctions at the behest of red-state politicians, and the 5 th Circuit, which keeps upholding them. A disproportionate number of the Supreme Court’s cases this term emerge from the 5 th Circuit, which keeps appeasing the Trump-appointed zealots attempting to seize unimaginable amounts of power from the democratic branches. The chief justice is attempting to crack down on the kind of judge-shopping that occurred here, but the fight is just beginning. The evident frustration of Roberts, Kavanaugh, Barrett, and even Gorsuch on Monday suggests that a majority of the court is fed up with this political manipulation of the judiciary by rogue judges with undisguised partisan loyalties.

So, yes, SCOTUS is likely to reach the right result in Murthy . Alarmingly, though, so much damage has already been done. In light of Doughty’s injunction, the federal government shut down all of its efforts to combat disinformation, fearful of judicial sanctions. Bad actors have exploited this development to flood the internet with lies about the upcoming 2024 election. If foreign entities attempt to interfere with the election via social media, the Biden administration will have few tools left to fight them. It is just too late to revive the various task forces that worked with platforms before Doughty disbanded them last year. For the Murthy plaintiffs, then, a Supreme Court defeat may not matter much. They have already done immense damage to truth and transparency on the internet. And at this late date, the worst of it cannot be undone.

Large language models use a surprisingly simple mechanism to retrieve some stored knowledge

Large language models, such as those that power popular artificial intelligence chatbots like ChatGPT, are incredibly complex. Even though these models are being used as tools in many areas, such as customer support, code generation, and language translation, scientists still don’t fully grasp how they work.

In an effort to better understand what is going on under the hood, researchers at MIT and elsewhere studied the mechanisms at work when these enormous machine-learning models retrieve stored knowledge.

They found a surprising result: Large language models (LLMs) often use a very simple linear function to recover and decode stored facts. Moreover, the model uses the same decoding function for similar types of facts. Linear functions, equations with only two variables and no exponents, capture the straightforward, straight-line relationship between two variables.

The researchers showed that, by identifying linear functions for different facts, they can probe the model to see what it knows about new subjects, and where within the model that knowledge is stored.

Using a technique they developed to estimate these simple functions, the researchers found that even when a model answers a prompt incorrectly, it has often stored the correct information. In the future, scientists could use such an approach to find and correct falsehoods inside the model, which could reduce a model’s tendency to sometimes give incorrect or nonsensical answers.

“Even though these models are really complicated, nonlinear functions that are trained on lots of data and are very hard to understand, there are sometimes really simple mechanisms working inside them. This is one instance of that,” says Evan Hernandez, an electrical engineering and computer science (EECS) graduate student and co-lead author of a paper detailing these findings .

Hernandez wrote the paper with co-lead author Arnab Sharma, a computer science graduate student at Northeastern University; his advisor, Jacob Andreas, an associate professor in EECS and a member of the Computer Science and Artificial Intelligence Laboratory (CSAIL); senior author David Bau, an assistant professor of computer science at Northeastern; and others at MIT, Harvard University, and the Israeli Institute of Technology. The research will be presented at the International Conference on Learning Representations.

Finding facts

Most large language models, also called transformer models, are neural networks . Loosely based on the human brain, neural networks contain billions of interconnected nodes, or neurons, that are grouped into many layers, and which encode and process data.

Much of the knowledge stored in a transformer can be represented as relations that connect subjects and objects. For instance, “Miles Davis plays the trumpet” is a relation that connects the subject, Miles Davis, to the object, trumpet.

As a transformer gains more knowledge, it stores additional facts about a certain subject across multiple layers. If a user asks about that subject, the model must decode the most relevant fact to respond to the query.

If someone prompts a transformer by saying “Miles Davis plays the. . .” the model should respond with “trumpet” and not “Illinois” (the state where Miles Davis was born).

“Somewhere in the network’s computation, there has to be a mechanism that goes and looks for the fact that Miles Davis plays the trumpet, and then pulls that information out and helps generate the next word. We wanted to understand what that mechanism was,” Hernandez says.

The researchers set up a series of experiments to probe LLMs, and found that, even though they are extremely complex, the models decode relational information using a simple linear function. Each function is specific to the type of fact being retrieved.

For example, the transformer would use one decoding function any time it wants to output the instrument a person plays and a different function each time it wants to output the state where a person was born.

The researchers developed a method to estimate these simple functions, and then computed functions for 47 different relations, such as “capital city of a country” and “lead singer of a band.”

While there could be an infinite number of possible relations, the researchers chose to study this specific subset because they are representative of the kinds of facts that can be written in this way.

They tested each function by changing the subject to see if it could recover the correct object information. For instance, the function for “capital city of a country” should retrieve Oslo if the subject is Norway and London if the subject is England.

Functions retrieved the correct information more than 60 percent of the time, showing that some information in a transformer is encoded and retrieved in this way.

“But not everything is linearly encoded. For some facts, even though the model knows them and will predict text that is consistent with these facts, we can’t find linear functions for them. This suggests that the model is doing something more intricate to store that information,” he says.

Visualizing a model’s knowledge

They also used the functions to determine what a model believes is true about different subjects.

In one experiment, they started with the prompt “Bill Bradley was a” and used the decoding functions for “plays sports” and “attended university” to see if the model knows that Sen. Bradley was a basketball player who attended Princeton.

“We can show that, even though the model may choose to focus on different information when it produces text, it does encode all that information,” Hernandez says.

They used this probing technique to produce what they call an “attribute lens,” a grid that visualizes where specific information about a particular relation is stored within the transformer’s many layers.

Attribute lenses can be generated automatically, providing a streamlined method to help researchers understand more about a model. This visualization tool could enable scientists and engineers to correct stored knowledge and help prevent an AI chatbot from giving false information.

In the future, Hernandez and his collaborators want to better understand what happens in cases where facts are not stored linearly. They would also like to run experiments with larger models, as well as study the precision of linear decoding functions.

“This is an exciting work that reveals a missing piece in our understanding of how large language models recall factual knowledge during inference. Previous work showed that LLMs build information-rich representations of given subjects, from which specific attributes are being extracted during inference. This work shows that the complex nonlinear computation of LLMs for attribute extraction can be well-approximated with a simple linear function,” says Mor Geva Pipek, an assistant professor in the School of Computer Science at Tel Aviv University, who was not involved with this work.

Bragg Says Newly Disclosed Papers in Trump Case Contain Little of Value

A week after agreeing to a brief delay, Manhattan’s district attorney, Alvin L. Bragg, said his office’s criminal prosecution of Donald J. Trump should begin April 15 as scheduled.

The Manhattan district attorney’s office said in court papers Thursday that a large cache of newly disclosed documents contained little that might influence or delay the criminal trial of Donald J. Trump, which is scheduled to begin in mid-April.

In a surprising move, the district attorney, Alvin L. Bragg, agreed last week to allow a short delay in the trial to give Mr. Trump’s lawyers time to review the records. The documents had been turned over by federal prosecutors who had previously investigated Michael Cohen, the former president’s longtime fixer who is expected to be a key witness in Mr. Bragg’s prosecution.

Mr. Trump’s lawyers had cast the documents as a potential game-changing development in the intensely litigated case, which had been set to go to trial on Monday. But in Thursday’s filing, Mr. Bragg’s office played down the documents’ import, though it said its review was continuing.

“The people now have good reason to believe that this production contains only limited materials relevant to the subject matter of this case and that have not previously been disclosed to defendant,” the office said in the filing, adding: “The overwhelming majority of the production is entirely immaterial, duplicative or substantially duplicative of previously disclosed materials.”

It said that the trial’s currently scheduled start date — now set for April 15 — provides “a more than reasonable amount of time for defendant to review the information provided.”

Mr. Trump’s lawyers have asked the judge in the case, Juan M. Merchan, to dismiss the charges entirely or delay the trial until the summer and penalize the district attorney. A hearing before Justice Merchan is scheduled for Monday.

That same day, Mr. Trump faces a deadline to post a half-billion dollar bond in his civil fraud case in New York, which was brought by the state’s attorney general and led to a judge’s finding that the former president is liable for inflating his net worth. If he fails to secure the bond — and his lawyers have said it would be a “practical impossibility” — the attorney general can move to collect a $454 million judgment from Mr. Trump.

It could be quite painful for the former president. The attorney general, Letitia James, could freeze some of his bank accounts and potentially seek to seize some of his New York properties. Although it could be difficult to seize his assets, public records show that Ms. James has formally posted the civil judgment against Mr. Trump in Westchester County, a preliminary step needed to stake a claim to his private estate and golf club there.

The deadline in the civil case and the hearing in the criminal one come as Mr. Trump contends with a dizzying array of legal entanglements. He faces four criminal indictments, including charges for his role in trying to subvert democracy after the 2020 election.

In the Manhattan case, the lawyers have blamed Mr. Bragg’s prosecutors for the belated disclosure. The documents in question came from the office of the U.S. attorney for the Southern District of New York, which obtained a guilty plea from Mr. Cohen in 2018.

Mr. Bragg’s office has denied responsibility for the delay, noting that it was Mr. Trump’s lawyers who waited until early this year to subpoena the documents from the Southern District.

Some of the recently disclosed records relate to Mr. Cohen’s phones. Mr. Bragg’s prosecutors argued that they had originally asked for the data, but federal prosecutors denied the request as “unduly burdensome.” When Mr. Trump requested the records this year, federal prosecutors obliged, authorizing disclosure “under the extraordinary circumstances of this case.”

Mr. Bragg’s prosecutors argued that much of the other information produced by the federal government was irrelevant to the district attorney’s case and instead related to other investigations into Mr. Cohen.

Mr. Trump is on the precipice of becoming the first former American president to be tried criminally, the result of an indictment by a Manhattan grand jury almost exactly a year ago .

The case centers on a hush-money payment Mr. Cohen made in the lead-up to the 2016 presidential election to a porn star, Stormy Daniels, who said she had an affair with Mr. Trump. The district attorney has argued that the cover-up cheated voters of the chance to fully assess Mr. Trump’s candidacy.

Mr. Trump, who is again the presumptive Republican nominee for president, has denied the charges, casting the case as a politically motivated hit job by Mr. Bragg, a Democrat. He has also denied an affair with Ms. Daniels, who has said that she and the former president slept together once in 2006 . She later tried to sell her story, leading to the payment from Mr. Cohen in exchange for her silence.

The Trump campaign’s communications director, Steven Cheung, blasted Mr. Bragg’s filing, saying he and his office “are still trying to explain away why they obfuscated and lied about these incredibly late disclosures.”

“No amount of dishonesty from their team can overshadow truth and transparency,” Mr. Cheung said.
