Freedom: America's Evolving and Enduring Idea

Eric Foner is DeWitt Clinton Professor of History at Columbia University and a former president of the OAH. He is the author of numerous books, including Free Soil, Free Labor, Free Men (1970); Reconstruction: America's Un. nished Revolution (1988); The Story of American Freedom (1998); and Who Owns History? (2002). His most recent publication is a survey textbook , Give Me Liberty!: An American History (2005) .

N o idea is more central to American identity—that is, Americans' conception of themselves as a people and a nation—than freedom. The central term in our political vocabulary, freedom—or liberty, with which it is almost always used interchangeably—is deeply embedded in the documentary record of our history and the language of everyday life. The Declaration of Independence lists liberty among mankind's inalienable rights; the Constitution announces as its purpose to secure liberty's blessings. The United States fought the Civil War to bring about a new birth of freedom, World War II for the Four Freedoms, the Cold War to defend the Free World. The current war in Iraq has been given the title “Operation Iraqi Freedom.” Americans' love of freedom has been represented by liberty poles, caps, and statues, and acted out by burning stamps and burning draft cards, running away from slavery, and demonstrating for the right to vote. Obviously, other peoples also cherish freedom, but the idea does seem to occupy a more prominent place in public and private discourse in the United States than elsewhere. “Every man in the street, white, black, red or yellow,” wrote the educator and statesman Ralph Bunche in 1940, “knows that this is ‘the land of the free’… [and] ‘the cradle of liberty’” ( 1).

Freedom of Speech

Freedom of speech—the right to express opinions without government restraint—is a democratic ideal that dates back to ancient Greece. In the United States, the First Amendment guarantees free speech, though the United States, like all modern democracies, places limits on this freedom. In a series of landmark cases, the U.S. Supreme Court over the years has helped to define what types of speech are—and aren’t—protected under U.S. law.

The ancient Greeks pioneered free speech as a democratic principle. The ancient Greek word “parrhesia” means “free speech,” or “to speak candidly.” The term first appeared in Greek literature around the end of the fifth century B.C.

During the classical period, parrhesia became a fundamental part of the democracy of Athens. Leaders, philosophers, playwrights and everyday Athenians were free to openly discuss politics and religion and to criticize the government in some settings.

First Amendment

In the United States, the First Amendment protects freedom of speech.

The First Amendment was adopted on December 15, 1791 as part of the Bill of Rights—the first ten amendments to the United States Constitution . The Bill of Rights provides constitutional protection for certain individual liberties, including freedoms of speech, assembly and worship.

The First Amendment doesn’t specify what exactly is meant by freedom of speech. Defining what types of speech should and shouldn’t be protected by law has fallen largely to the courts.

In general, the First Amendment guarantees the right to express ideas and information. On a basic level, it means that people can express an opinion (even an unpopular or unsavory one) without fear of government censorship.

It protects all forms of communication, from speeches to art and other media.

Flag Burning

While freedom of speech pertains mostly to the spoken or written word, it also protects some forms of symbolic speech. Symbolic speech is an action that expresses an idea.

Flag burning is an example of symbolic speech that is protected under the First Amendment. Gregory Lee Johnson, a youth communist, burned a flag during the 1984 Republican National Convention in Dallas, Texas to protest the Reagan administration.

The U.S. Supreme Court , in 1990, reversed a Texas court’s conviction that Johnson broke the law by desecrating the flag. Texas v. Johnson invalidated statutes in Texas and 47 other states prohibiting flag burning.

When Isn’t Speech Protected?

Not all speech is protected under the First Amendment.

Forms of speech that aren’t protected include:

  • Obscene material such as child pornography
  • Plagiarism of copyrighted material
  • Defamation (libel and slander)
  • True threats

Speech inciting illegal actions or soliciting others to commit crimes aren’t protected under the First Amendment, either.

The Supreme Court decided a series of cases in 1919 that helped to define the limitations of free speech. Congress passed the Espionage Act of 1917, shortly after the United States entered into World War I . The law prohibited interference in military operations or recruitment.

Socialist Party activist Charles Schenck was arrested under the Espionage Act after he distributed fliers urging young men to dodge the draft. The Supreme Court upheld his conviction by creating the “clear and present danger” standard, explaining when the government is allowed to limit free speech. In this case, they viewed draft resistant as dangerous to national security.

American labor leader and Socialist Party activist Eugene Debs also was arrested under the Espionage Act after giving a speech in 1918 encouraging others not to join the military. Debs argued that he was exercising his right to free speech and that the Espionage Act of 1917 was unconstitutional. In Debs v. United States the U.S. Supreme Court upheld the constitutionality of the Espionage Act.

Freedom of Expression

The Supreme Court has interpreted artistic freedom broadly as a form of free speech.

In most cases, freedom of expression may be restricted only if it will cause direct and imminent harm. Shouting “fire!” in a crowded theater and causing a stampede would be an example of direct and imminent harm.

In deciding cases involving artistic freedom of expression the Supreme Court leans on a principle called “content neutrality.” Content neutrality means the government can’t censor or restrict expression just because some segment of the population finds the content offensive.

Free Speech in Schools

In 1965, students at a public high school in Des Moines, Iowa , organized a silent protest against the Vietnam War by wearing black armbands to protest the fighting. The students were suspended from school. The principal argued that the armbands were a distraction and could possibly lead to danger for the students.

The Supreme Court didn’t bite—they ruled in favor of the students’ right to wear the armbands as a form of free speech in Tinker v. Des Moines Independent School District . The case set the standard for free speech in schools. However, First Amendment rights typically don’t apply in private schools.

The Story of American Freedom is a 1998 historical nonfiction book by famed American historian Eric Foner. The book chronicles how the American values of freedom and liberty have been applied during various periods, from the American Revolution to the rebirth of conservatism of the 1980s and 1990s. Foner’s work is essentially a history of freedom in the United States, but it focuses primarily on how the concept of freedom has been limited, contested, and expanded throughout the nation’s history. Foner establishes three primary themes in his work: the meanings of freedom , the social conditions that make freedom possible , and the boundaries of freedom . Published by W.W. Norton & Company Inc., The Story of American Freedom was listed as a New York Times Notable Book of the Year in 1998.

Across 13 chapters, Foner establishes the idea that American freedom has been a contested concept rather than a fixed definition or a predetermined belief. The earliest ideas of American freedom were those derived from British liberty dictating a strict obedience to law and the puritanical notion that freedom was a spiritual condition rather than a political one. Freedom became democratized with the Revolution, but it was a contradictory concept because of the compromises placed in the Constitution that assured the existence of slavery for decades to come. Slavery is the primary focus throughout the first section of the book, as Foner examines how the language of freedom and liberty used during the Revolution was taken up by enslaved people and abolitionists to call for emancipation. The competing visions of free labor , or wage labor, in the North and slave labor in the South shifted the meaning of freedom in the years leading to the Civil War.

In the Gilded Age , the Progressive Era , and the years surrounding World War I, the meaning of freedom shifted once again to take on a strong economic element. In the middle chapters of the book, Foner examines the battles between labor and employers that arose over issues concerning workers’ rights and laissez-faire capitalism. The eras of the New Deal, World War II, the Cold War, and the turbulent 1960s redrew the boundaries of freedom, but the changes required the role of an activist federal government. Whereas freedom of the 1960s meant removing limitations and boundaries, the rebirth of conservatism in the 1980s and 1990s showed that it can also mean the opposite. Foner’s history of freedom provides the context for the social and political movements that have taken place and the crises that have been overcome throughout American history.

How have the legacies of slavery shaped the struggle for freedom?

The 13th Amendment to the U.S. Constitution, ratified in 1865, formally abolished slavery throughout the United States. But ending slavery was only a first step toward securing full freedom and citizenship rights for African Americans. The struggle to fulfill the promises of liberty, equality, and justice for all, which began with the nation’s founding and took on new meaning and momentum during the era of Reconstruction, would continue for generations to come.

Before The 13th Amendment

Freedom, slavery, and the founding of america: 1770s–1780s.

The desire for freedom by enslaved African Americans manifested itself during the early stages of the nation’s development. Their decisions to run away or to publicly express their disdain for slavery in writing or in the courts illustrated the importance of freedom for them. The language contained in the Constitution further reinforced their belief in their right to liberty and freedom despite the decision by the Constitutional Congress to allow for the continued existence of slavery—a decision which created a paradox for the new nation of espousing liberty but depending economically on enslavement.

Early Freedom Movements: 1830s–1850s

Brethren, the time has come when you must act for yourselves … Think how many tears you have poured out upon the soil which you have cultivated with unrequited toil and enriched with your blood; and then go to your lordly enslavers and tell them plainly, that you are determined to be free … Inform them that all you desire is FREEDOM, and that nothing else will suffice. African Americans spoke forcefully and regularly about ending slavery and claiming their rights as citizens. Individuals like David Walker produced powerful essays condemning the institution, appealing for equal rights, and encouraging the enslaved to throw off their enslavement.

The Black convention movement , which began in 1830, was another important national forum that voiced the demands of its participants for abolition, voting rights, and equal treatment. Gaining the right to vote and fair treatment were issues of national concern. In Ohio and Illinois African Americans protested state Black Laws, which, among other things, prevented them from voting, holding public office, or living in the state without paying a minimum bond of $500 to ensure good behavior. In light of this discriminatory treatment, African Americans sought to expand the focus of the abolition movement so it not only looked to end slavery, but to champion equal treatment of all Americans as well.

Civil War and Emancipation

The election of Abraham Lincoln in 1860 threatened the survival of slavery in the eyes of many southern state officials and fueled their decision to secede. The Civil War which resulted did eventually evolve into a war to bring slavery to an end. Enslaved African Americans saw this possibility early in the war and flocked to U.S. Army lines where they believed they would gain their freedom. Fort Monroe in Virginia was one of the first places to have enslaved men arrive there in 1861 seeking freedom.

The District of Columbia instituted compensated emancipation in 1862. President Lincoln followed this action by issuing a preliminary Emancipation Proclamation in the fall of that year and the final Emancipation Proclamation in January of 1863. The 1863 Proclamation offered freedom to the enslaved in Confederate territory and allowed African Americans to enlist in the U.S. Army for the first time. By the end of the Civil War approximately 179,000 African Americans took up arms and made important contributions to the successful conclusion of the conflict for the Union.

The13th Amendment and Reconstruction

Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction. 13th Amendment to the U.S. Constitution, Section 1

The constitutional amendment abolishing slavery in the United States was introduced in Congress in December 1863, midway through the Civil War, and finally passed on January 31, 1865. It would be almost another year before the 13th Amendment was declared ratified by the states, on December 18, 1865. By then, the Civil War had ended with the defeat of the Confederacy, and Vice President Andrew Johnson had become president following the assassination of President Abraham Lincoln.

The 13th Amendment was brief and to the point—in less than 50 words, it proclaimed the demise of slavery, an institution which predated the founding of the United States and had been supported, expanded, and enforced in North America by racist legal and social systems for nearly 250 years. While the amendment outlawed the institution of slavery, it also included a clause that allowed slavery and involuntary servitude to be used as punishment for a crime. This language, originally used in the Northwest Ordinance of 1787 , protected the state’s right to force prisoners to work, a longstanding practice that would drastically expand in the aftermath of slavery.

Section 2 of the 13th Amendment granted Congress the right to pass legislation to enforce the abolition of slavery. This marked a significant shift in power between the federal government and the states by giving Congress new responsibility for protecting civil rights at the federal level. It laid the foundation for the passage of federal laws designed to protect newly freed African Americans from state laws and practices that deprived them of their civil liberties and attempted to return them to a condition of enslavement.

Abolitionists celebrated the ratification of the 13th Amendment as a moral victory over the inhumanity of slavery and a redeeming of the Constitution’s founding promise of freedom. But many African Americans also greeted the new law with wary skepticism. They recognized the outlawing of slavery as not the end, but only the beginning of what would be needed to secure full freedom and equal rights. The enemy still to be defeated was the systemic racism that had justified and supported slavery in the South and restricted the freedom of all Black people throughout the country.

Testing the 13th Amendment: The Black Codes

In order to regain representation in Congress, the former Confederate states agreed to ratify the 13th Amendment and write new state constitutions abolishing slavery. But the southern states also passed new laws, known as Black Codes, that restricted the rights of newly freed people in order to control their labor, maintain the racial status quo, and keep them in conditions as similar to slavery as possible. 

In 1865 and 1866, African Americans held political conventions across the South to protest the Black Codes and demand full civil and political rights, including the right to vote. Congress responded by passing the Civil Rights Act of 1866. Drawing on the authority granted to Congress by the 13th Amendment to enforce the abolition of slavery, this was the first federal civil rights legislation. The Civil Rights Act voided the Black Codes by declaring African Americans to be citizens entitled to the same rights, benefits, and protections under the law as white citizens. While it did not address voting rights, the law defined certain basic rights for all citizens, including the right to make and enforce contracts, give evidence in court, and own property.

Despite the new federal laws, many white Americans continued to resist the idea of Black freedom. President Andrew Johnson, a Democrat from Tennessee and a former enslaver, vetoed the Civil Rights Bill of 1866, but Congress overrode his veto. Less than a month later, violence erupted in Memphis, Tennessee. Mobs of white police and civilians attacked the city’s Black community, burning homes, churches, schools, and businesses. The Memphis Massacre, which lasted from May 1 to May 3, 1866, left 46 African Americans dead and dozens more injured. Soon after the massacre in Memphis, a group of Confederate veterans in Pulaski, Tennessee, formed the Ku Klux Klan, an organization that used violence and intimidation to oppose Black civil rights and promote white supremacy in the South.

African Americans also continued to confront white resistance and discrimination in northern and western states, where slavery had been outlawed before the Civil War but free Black people were still not treated as equal citizens. During the 1860s, the city of Philadelphia became a focal point for civil rights struggles through the efforts of activists such as Octavius Catto, who led a successful movement to end racial segregation in streetcars and other public accommodations.

Civil rights activists viewed segregation, the denial of voting rights, and other restrictions on Black freedom as vestiges of slavery that should also be abolished under the 13th Amendment.

A prominent voice for African American civil rights, Octavius Catto (1839–1871) founded the Philadelphia chapter of the Equal Rights League of Pennsylvania in 1864. He led protests and helped draft legislation to outlaw segregated streetcars. On Election Day in 1871, Catto was shot and killed by a white man who was later acquitted by an all-white jury.

Restricting the 13th Amendment: U.S. Supreme Court

The Thirteenth Amendment … not only struck down the institution of slavery as previously existing in the United States, but it prevents the imposition of any burdens or disabilities that constitute badges of slavery or servitude. During Reconstruction, the push for full freedom continued, supported by additional federal laws that built and expanded on the 13th Amendment of 1865 and the Civil Rights Act of 1866. The 14th Amendment , ratified in 1868, and the 15th Amendment , ratified in 1870, further revised the U.S. Constitution to specify rights that could not be denied on account of race or color, including birthright citizenship, equal protection, due process, and voting rights. In 1875, Congress passed another Civil Rights Act that prohibited racial discrimination in public accommodations such as hotels, theaters, and transportation.

These federal laws drew on the 13th Amendment, which granted Congress the power to enforce the abolition of slavery. This included not only the former system of human bondage and forced labor, but the related system of racial oppression that political and legal discourse referred to as the “badges and incidents of slavery.” In this view, any laws that restricted or impinged on Black people’s freedom and citizenship rights were considered aspects of slavery, and thus prohibited by the 13th Amendment.

But by the late 1870s, the federal government had begun to retreat from supporting Reconstruction and defending Black freedom in the South. White supremacists used violence, fraud, intimidation, and other tactics to suppress Black voting and regain control of southern state governments. Once back in power, they passed state laws that established the system of racial segregation and Black disenfranchisement known as Jim Crow.

Three U.S. Supreme Court rulings ( Civil Rights Cases (1883) ; Plessy v. Ferguson (1896) ; and Hodges v. United States (1906) ) significantly narrowed the definition of freedom granted by the 13th Amendment. These rulings weakened or repealed federal civil rights laws and allowed state Jim Crow laws and other forms of racial discrimination to stand. This revised, restricted view of the 13th Amendment—as only outlawing the institution of chattel slavery itself, rather than securing full freedom for Black people—would continue to hamper civil rights efforts until the 1960s.

The Legacies of Slavery

“except as punishment for a crime”: race and incarceration.

The 13th Amendment sanctioned involuntary servitude if convicted of a crime, which created an opening for the advent of convict leasing.  Under the convict leasing system African Americans were arrested for fabricated reasons such as loitering or failing to sign a work contract. Law officials then leased their labor or used them to create roads, build factories, construct railroads, and perform other tasks without compensation. In many ways convict labor became a substitute for enslavement. Indeed In 1871 the Supreme Court of Appeals of Virginia ruled in Ruffin v. Commonwealth that convicts were “the slave of the state.” This point of view enabled prisons like Angola in Louisiana and Parchman Farm in Mississippi to notoriously exploit prisoners well into the 21st century.

The reinforcement of the courts caused Ida B. Wells and others to view convict leasing as racially oppressive as lynching in its victimization of African Americans. It is impossible to gauge how many men, women and children fell victim to this system, although some estimates suggest several million people were victimized. Not only were they often unfairly arrested, but they lost their rights as citizens while imprisoned and in many instances even after they were released from imprisonment.

One of the largest and longest-lasting of these plantation prisons is the Louisiana State Penitentiary, otherwise known as Angola, established in 1880. Among the largest prisons in the United States, Angola for much of its history has been known as one of the harshest and most inhumane. In the 1950s it was deemed the “bloodiest prison in America.”

“The Vestiges of Slavery”: Racial Discrimination and Violence

Long after the 13th Amendment outlawed slavery in 1865, civil rights advocates continued to call on the nation to abolish the legacies of slavery that persisted in the form of racial discrimination. In a 1953 speech to the National Urban League, Thurgood Marshall—then Special Counsel to the NAACP—spoke of the need for “concerted action to remove many of the remaining vestiges of slavery.” Marshall was referring to the systemic racism that confined Black people to second-class citizenship, including residential segregation, denial of the right of employment, and the threat of physical violence. As long as these vestiges of slavery remained, the 13th Amendment’s promise of freedom would remain unfulfilled.

In 1968, a year after Thurgood Marshall was appointed as the first Black Justice of the U.S. Supreme Court, the Court issued its first major 13th Amendment ruling in over 60 years. In the case of Jones v. Alfred H. Mayer Company , the Court determined that real estate practices that discriminated against Black property buyers could be outlawed by Congress under the 13th Amendment. This decision marked a return to original Reconstruction-era interpretations of the 13th Amendment, which defined it as a law intended to secure Black freedom by eliminating the “badges and incidents of slavery.”

The Jones ruling followed a series of major federal civil rights laws, including the Civil Rights Act of 1964 and the Voting Rights Act of 1965, passed in response to the mass movement for Black freedom during the 1950s and 1960s. Just as Reconstruction was regarded as a “second founding” of the United States—an opportunity to remake the nation without slavery, on a new foundation of freedom and equality—many referred to the modern Civil Rights Movement as a “Second Reconstruction,” another chance to take up the unfinished work of the 13th Amendment and fulfill its promise of freedom.

In the 1960s, Telfair was encouraged by the Student Nonviolent Coordinating Committee’s efforts to register African American voters in Southwest Georgia. Telfair decided to register to vote. When her employers learned of her actions, they fired her from her job as a cafeteria worker at an elementary school in her small community of Parrott, Georgia. The quilt is an affirmation of her personal freedom as well as a statement about the freedoms guaranteed to all American citizens.

Revisiting the 13th Amendment

The 13th Amendment is a touchstone in the struggle to abolish slavery and secure full freedom for African Americans, a struggle that extends from the nation’s founding to Reconstruction, through the modern Civil Rights Movement to today. It is also a catalyst for ongoing debate, activism, and legislation about defining and protecting freedom for all Americans. In recent decades, Congress has applied the 13th Amendment to support the passage of the Trafficking Victims Protection Act (2000), the first federal law targeting modern-day human trafficking, and the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act (2009). In 2020, Democratic members of Congress introduced a joint resolution calling for an Abolition Amendment that would nullify the “except as punishment” clause in the 13th Amendment, as part of efforts to address issues of mass incarceration, human rights abuses, and racial disparities in the U.S. prison system.

Along with highlighting the need to address and eliminate the persisting legacies of slavery, the 13th Amendment inspires questions about how to carry forward the legacy of abolition and build new institutions that promote a more just and equitable democracy.

Reconstruction changed the nation in fundamental ways. Three new amendments to the U.S. Constitution abolished slavery, provided equal protection of the law for all citizens, and banned racial discrimination in voting. But the promise of these laws alone would not secure the visions of freedom that African Americans pursued, if the nation was not willing to uphold and enforce them.

Academic Freedom Is More Important Now Than Ever

A t least since the 1800s, colleges and universities in the United States have emphasized their civic missions. American college students weren’t just supposed to get better at exams and recitations, they were supposed to develop character traits that would make them better citizens . In the last fifty years, whether one attended a large public university or a small private college, chances are the mission statement of your school included language that emphasized the institution’s contribution to the public good. So why today is there a chorus of critics urging higher education leaders to cultivate neutrality , to cede the public sphere to others?

I suppose that in these days of social polarization and hyper-partisanship, some see campus life as a retreat from the bruising realities of political life. You can pursue theater or biology, religion or economics, without worrying too much what the person sitting next to you thinks of the political issue of the day. And if your institution has no political commitments, so the thinking seems to go, you may feel more inclined to form your own, or just not to have any at all. Whether one weds this to a monastic view of higher education, or skills-based vocational one, one can feel that university life provides a respite from the take-a-stand demands of the political. While there is certainly freedom in that, it should be remembered that we only have that freedom because of guarantees established by generations of political struggle.

One of those fundamental guarantees is the ability to choose one’s field of study, to conduct research without political intervention, and to openly discuss the results of one’s work. In his forthcoming book Academic Freedom: From Professional Norm to First Amendment Right , David Rabban argues convincingly that academic freedom is a distinctive first amendment right, one which protects teachers and researchers while enabling society as a whole to benefit from the production and dissemination of knowledge. The American Association of University Professors sketched out this foundational professional norm in 1915. Scholars are free to explore issues and to debate them; they should be able to take positions that might turn out to be very unpopular in the broader political realm. Rabban shows how these protections have been protected in a series of court decisions over the last hundred years. Whether teaching the Bible, a contemporary video, or evolutionary biology, professors should not have to worry that political pressures will force them away from a path of inquiry or a mode of expression.

Today, though, such worries abound. Libraries are banning books at alarming rates, faculty are being disciplined for their political views, and student rights to protest are being curtailed beyond appropriate “time and place” guidelines. Issues around the right to speak one’s mind are front and center on college campuses, thrust there in part because of protests around the war in Gaza and the spectacle of congressional hearings about antisemitism. Ivy League institutions have attracted the most attention for outbursts of Jew hatred even as scores of civilian hostages from Israel are subject to torture, rape, and brutal isolation. But rejecting the vicious tactics of the war in Gaza, doesn’t make one a supporter of terrorist violence; starving Palestinians in Gaza won’t secure freedom for the hostages. In these dire conditions, it’s no wonder that colleges are faced with legitimate protests as well as traditional expressions of prejudice and hate. On campuses across the country, Islamophobia and antisemitic harassment can destroy the conditions for learning, but mass arrests of peaceful protestors and the censorship of speakers for their political views only undermine academic freedom in the long run.

In recent years, some progressives have expressed doubts about free speech , describing it as a neo-liberal disguise of existing power relations. Now, however, as those aligned with pro-Palestinian movements are being censured or arrested, the old liberal approach to freedom of expression seems more attractive to many protestors. Historians Ahmna Khalid and Jeffrey Snyder have been writing about these issues , and recently they gave a powerful presentation to a packed house at Wesleyan. They began with a critical appraisal of Florida’s various attacks on academic freedom, which on my campus was preaching to the choir. But the speakers went on to discuss how many of efforts that fall under the popular rubric of inclusion are also aimed at suppressing speech ostensibly to protect so-called vulnerable communities. Protecting students against speech in the name of harm reduction is almost always a mistake, they argued. Here, the debate got interesting. And this was their point: debates are only interesting when people are free to disagree, listen to opposing views, change their minds. But they also seemed to agree that in some cases intimidation could be intense enough to warrant restrictions on expression. I call this a “safe enough space” approach to speech, but in the discussion following their talk it was clear that they thought my pragmatist position left too much room for unwarranted “ safetyism .” There was a real conversation; students and faculty were fully engaged.

And that, of course, is when learning happens: when we are engaged in deep listening and in trying to think for ourselves in the company of others. This is what I argue in The Student: A Short History : being a student—at whatever age—means being open to others in ways that allow one to expand one’s thinking, to enhance one’s capacities for appreciation, for empathy and for civic participation. That participation energizes a virtuous circle because it’s by engaging with others that one multiplies possibilities for learning (and then for further engagement).

That virtuous circle depends on freedoms in a political context under direct threat from the populist authoritarianism movement led by Donald Trump. When Trump attacks his enemies, when he talks about them as thugs and vermin or proposes his own national university to replace the elites so despised by his base, he is telegraphing his intentions to remake higher education in the image of his MAGA movement. Many academics seem to shrug their shoulders, saying either that “other politicians aren’t so great either,” or to suggest (as elites often have when faced with growing fascist threats) that he doesn’t really mean what he says. This is a grave mistake, as we’ve seen before in history.

Neutrality, whether based on principle, apathy or cynicism, today feeds collaboration . The attack on democracy, the attack on the rule of law, will also sweep away the freedoms that higher education has won over the last 100 years.

We can fight back. Between now and November 5 th , many of our students, faculty, staff and alumni will be practicing freedom by participating in the electoral process. They will work on behalf of candidates and in regard to issues bearing on the future of academic freedom, free speech, and the possibilities for full engagement with others. This is challenging work. In the noise of contemporary politics, it’s hard to practice authentic listening; in the glare of the media’s campaign cameras, it’s hard to see things from someone else’s point of view.

But that is our task. If we are to strengthen our democracy and the educational institutions that depend on it, we must learn to practice freedom, better. We must learn to be better students. Our future depends on it .

American Freedom Essay Winners

Every Fall, in honor of Constitution Day & Citizenship Day, The Constitutional Walking Tour of Philadelphia sponsors its annual American Freedom Essay Contest. The American Freedom Essay Contest challenges educators to have their students write a 100-300 word essay on the importance of freedom in their lives. Entries are judged in Elementary School, Middle School and High School categories with the winner in each category earning a free field trip with The Constitutional Walking Tour for his/her class. The contest generally runs from September through mid-October each year. Check back in September for more details on the next contest.

Freedom for the Wolves

Neoliberal orthodoxy holds that economic freedom is the basis of every other kind. That orthodoxy, a Nobel economist says, is not only false; it is devouring itself.

A ny discussion of freedom must begin with a discussion of whose freedom we’re talking about. The freedom of some to harm others, or the freedom of others not to be harmed? Too often, we have not balanced the equation well: gun owners versus victims of gun violence; chemical companies versus the millions who suffer from toxic pollution; monopolistic drug companies versus patients who die or whose health worsens because they can’t afford to buy medicine.

Understanding the meaning of freedom is central to creating an economic and political system that delivers not only on efficiency, equity, and sustainability but also on moral values. Freedom—understood as having inherent ties to notions of equity, justice, and well-being—is itself a central value. And it is this broad notion of freedom that has been given short shrift by powerful strands in modern economic thinking—notably the one that goes by the shorthand term neoliberalism , the belief that the freedom that matters most, and from which other freedoms indeed flow, is the freedom of unregulated, unfettered markets.

F. A. Hayek and Milton Friedman were the most notable 20th-century defenders of unrestrained capitalism. The idea of “unfettered markets”—markets without rules and regulations—is an oxymoron because without rules and regulations enforced by government, there could and would be little trade. Cheating would be rampant, trust low. A world without restraints would be a jungle in which only power mattered, determining who got what and who did what. It wouldn’t be a market at all.

Nonetheless, Hayek and Friedman argued that capitalism as they interpreted it, with free and unfettered markets, was the best system in terms of efficiency, and that without free markets and free enterprise, we could not and would not have individual freedom. They believed that markets on their own would somehow remain competitive. Remarkably, they had already forgotten—or ignored—the experiences of monopolization and concentration of economic power that had led to the Sherman Antitrust Act (1890) and the Clayton Antitrust Act (1914). As government intervention grew in response to the Great Depression, Hayek worried that we were on “the road to serfdom,” as he put it in his 1944 book of that title; that is, on the road to a society in which individuals would become subservient to the state.

My own conclusions have been radically different. It was because of democratic demands that democratic governments, such as that of the U.S., responded to the Great Depression through collective action. The failure of governments to respond adequately to soaring unemployment in Germany led to the rise of Hitler. Today, it is neoliberalism that has brought massive inequalities and provided fertile ground for dangerous populists. Neoliberalism’s grim record includes freeing financial markets to precipitate the largest financial crisis in three-quarters of a century, freeing international trade to accelerate deindustrialization, and freeing corporations to exploit consumers, workers, and the environment alike. Contrary to what Friedman suggested in his 1962 book, Capitalism and Freedom , this form of capitalism does not enhance freedom in our society. Instead, it has led to the freedom of a few at the expense of the many. As Isaiah Berlin would have it: Freedom for the wolves; death for the sheep.

I t is remarkable that , in spite of all the failures and inequities of the current system, so many people still champion the idea of an unfettered free-market economy. This despite the daily frustrations of dealing with health-care companies, insurance companies, credit-card companies, telephone companies, landlords, airlines, and every other manifestation of modern society. When there’s a problem, ordinary citizens are told by prominent voices to “leave it to the market.” They’ve even been told that the market can solve problems that one might have thought would require society-wide action and coordination, some larger sense of the public good, and some measure of compulsion. It’s purely wishful thinking. And it’s only one side of the fairy tale. The other side is that the market is efficient and wise, and that government is inefficient and rapacious.

Mindsets, once created, are hard to change. Many Americans still think of the United States as a land of opportunity. They still believe in something called the American dream, even though for decades the statistics have painted a darker picture. The rate of absolute income mobility—that is, the percentage of children who earn more than their parents—has been declining steadily since the Second World War. Of course, America should aspire to be a land of opportunity, but clinging to beliefs that are not supported by today’s realities—and that hold that markets by themselves are a solution to today’s problems—is not helpful. Economic conditions bear this out, as more Americans are coming to understand. Unfettered markets have created, or helped create, many of the central problems we face, including manifold inequalities, the climate crisis, and the opioid crisis. And markets by themselves cannot solve any of our large, collective problems. They cannot manage the massive structural changes that we are going through—including global warming, artificial intelligence, and the realignment of geopolitics.

All of these issues present inconvenient truths to the free-market mindset. If externalities such as these are important, then collective action is important. But how to come to collective agreement about the regulations that govern society? Small communities can sometimes achieve a broad consensus, though typically far from unanimity. Larger societies have a harder go of it. Many of the crucial values and presumptions at play are what economists, philosophers, and mathematicians refer to as “primitives”—underlying assumptions that, although they can be debated, cannot be resolved. In America today we are divided over such assumptions, and the divisions have widened.

The consequences of neoliberalism point to part of the reason: specifically, growing income and wealth disparities and the polarization caused by the media. In theory, economic freedom was supposed to be the bedrock basis for political freedom and democratic health. The opposite has proved to be true. The rich and the elites have a disproportionate voice in shaping both government policies and societal narratives. All of which leads to an enhanced sense by those who are not wealthy that the system is rigged and unfair, which makes healing divisions all the more difficult.

Chris Murphy: The wreckage of neoliberalism

As income inequalities grow, people wind up living in different worlds. They don’t interact. A large body of evidence shows that economic segregation is widening and has consequences, for instance, with regard to how each side thinks and feels about the other. The poorest members of society see the world as stacked against them and give up on their aspirations; the wealthiest develop a sense of entitlement, and their wealth helps ensure that the system stays as it is.

The media, including social media, provide another source of division. More and more in the hands of a very few, the media have immense power to shape societal narratives and have played an obvious role in polarization. The business model of much of the media entails stoking divides. Fox News, for instance, discovered that it was better to have a devoted right-wing audience that watched only Fox than to have a broader audience attracted to more balanced reporting. Social-media companies have discovered that it’s profitable to get engagement through enragement. Social-media sites can develop their algorithms to effectively refine whom to target even if that means providing different information to different users.

N eoliberal theorists and their beneficiaries may be happy to live with all this. They are doing very well by it. They forget that, for all the rhetoric, free markets can’t function without strong democracies beneath them—the kind of democracies that neoliberalism puts under threat. In a very direct way, neoliberal capitalism is devouring itself.

Not only are neoliberal economies inefficient at dealing with collective issues, but neoliberalism as an economic system is not sustainable on its own. To take one fundamental element: A market economy runs on trust. Adam Smith himself emphasized the importance of trust, recognizing that society couldn’t survive if people brazenly followed their own self-interest rather than good codes of conduct:

The regard to those general rules of conduct, is what is properly called a sense of duty, a principle of the greatest consequence in human life, and the only principle by which the bulk of mankind are capable of directing their actions … Upon the tolerable observance of these duties, depends the very existence of human society, which would crumble into nothing if mankind were not generally impressed with a reverence for those important rules of conduct.

For instance, contracts have to be honored. The cost of enforcing every single contract through the courts would be unbearable. And with no trust in the future, why would anybody save or invest? The incentives of neoliberal capitalism focus on self-interest and material well-being, and have done much to weaken trust. Without adequate regulation, too many people, in the pursuit of their own self-interest, will conduct themselves in an untrustworthy way, sliding to the edge of what is legal, overstepping the bounds of what is moral. Neoliberalism helps create selfish and untrustworthy people. A “businessman” like Donald Trump can flourish for years, even decades, taking advantage of others. If Trump were the norm rather than the exception, commerce and industry would grind to a halt.

We also need regulations and laws to make sure that there are no concentrations of economic power. Business seeks to collude and would do so even more in the absence of antitrust laws. But even playing within current guardrails, there’s a strong tendency for the agglomeration of power. The neoliberal ideal of free, competitive markets would, without government intervention, be evanescent.

We’ve also seen that those with power too often do whatever they can to maintain it. They write the rules to sustain and enhance power, not to curb or diminish it. Competition laws are eviscerated. Enforcement of banking and environmental laws is weakened. In this world of neoliberal capitalism, wealth and power are ever ascendant.

Neoliberalism undermines the sustainability of democracy—the opposite of what Hayek and Friedman intended or claimed. We have created a vicious circle of economic and political inequality, one that locks in more freedom for the rich and leaves less for the poor, at least in the United States, where money plays such a large role in politics.

There are many ways in which economic power gets translated into political power and undermines the fundamental democratic value of one person casting one vote. The reality is that some people’s voices are much louder than others. In some countries, accruing power is as crude as literally buying votes, with the wealthy having more money to buy more votes. In advanced countries, the wealthy use their influence in the media and elsewhere to create self-serving narratives that in turn become the conventional wisdom. For instance, certain rules and regulations and government interventions—tax cuts for the wealthiest Americans, deregulation of key industries—that are purely in the interest of the rich and powerful are also, it is said, in the national interest. Too often that viewpoint is swallowed wholesale. If persuasion doesn’t work, there is always fear: If the banks are not bailed out, the economic system will collapse, and everyone will be worse off. If the corporate tax rate is not cut, firms will leave and go to other jurisdictions that are more business-friendly.

Is a free society one in which a few dictate the terms of engagement? In which a few control the major media and use that control to decide what the populace sees and hears? We now inhabit a polarized world in which different groups live in different universes, disagreeing not only on values but on facts.

A strong democracy can’t be sustained by neoliberal economics for a further reason. Neoliberalism has given rise to enormous “rents”—the monopoly profits that are a major source of today’s inequalities. Much is at stake, especially for many in the top one percent, centered on the enormous accretion of wealth that the system has allowed. Democracy requires compromise if it is to remain functional, but compromise is difficult when there is so much at stake in terms of both economic and political power.

A free-market, competitive, neoliberal economy combined with a liberal democracy does not constitute a stable equilibrium—not without strong guardrails and a broad societal consensus on the need to curb wealth inequality and money’s role in politics. The guardrails come in many forms, such as competition policy, to prevent the creation, maintenance, and abuse of market power. We need checks and balances, not just within government, as every schoolchild in the U.S. learns, but more broadly within society. Strong democracy, with widespread participation, is also part of what is required, which means working to strike down laws intended to decrease democratic participation or to gerrymander districts where politicians will never lose their seats.

Whether America’s political and economic system today has enough safeguards to sustain economic and political freedoms is open to serious question.

U nder the very name of freedom, neoliberals and their allies on the radical right have advocated policies that restrict the opportunities and freedoms, both political and economic, of the many in favor of the few. All these failures have hurt large numbers of people around the world, many of whom have responded by turning to populism, drawn to authoritarian figures like Trump, Jair Bolsonaro, Vladimir Putin, and Narendra Modi.

Perhaps we should not be surprised by where the U.S. has landed. It is a country now so divided that even a peaceful transition of power is difficult, where life expectancy is the lowest among advanced nations, and where we can’t agree about truth or how it might best be ascertained or verified. Conspiracy theories abound. The values of the Enlightenment have to be relitigated daily.

There are good reasons to worry whether America’s form of ersatz capitalism and flawed democracy is sustainable. The incongruities between lofty ideals and stark realities are too great. It’s a political system that claims to cherish freedom above all else but in many ways is structured to deny or restrict freedoms for many of its citizens.

I do believe that there is broad consensus on key elements of what constitutes a good and decent society, and on what kind of economic system supports that society. A good society, for instance, must live in harmony with nature. Our current capitalism has made a mess of this. A good society allows individuals to flourish and live up to their potential. In terms of education alone, our current capitalism is failing large portions of the population. A good economic system would encourage people to be honest and empathetic, and foster the ability to cooperate with others. The current capitalist system encourages the antithesis.

But the key first step is changing our mindset. Friedman and Hayek argued that economic and political freedoms are intimately connected, with the former necessary for the latter. But the economic system that has evolved—largely under the influence of these thinkers and others like them—undermines meaningful democracy and political freedom. In the end, it will undermine the very neoliberalism that has served them so well.

For a long time, the right has tried to establish a monopoly over the invocation of freedom , almost as a trademark. It’s time to reclaim the word.

Columbia, Free Speech and the Coddling of the American Right

​​​​As a journalist, you usually go to the front line to find the news. But sometimes the front line finds you. This happened to me not once but twice on Thursday, as an epic battle over freedom of expression on college campuses unfolded from one end of Manhattan to another.

The first was when I happened to be on the campus of Columbia University, speaking at a class. While leaving the classroom, I came upon a tent camp that had sprung up on one of the campus’s lush lawns. It was, as college protests often are, an earnest but peaceful affair. A few dozen tents had been pitched, and students hung a sign reading “Gaza solidarity encampment.” Their tactics were a mild echo of those of an earlier generation of students, who effectively shut down the campus in April 1985 to demand that Columbia divest from South Africa — protests that were in turn an echo of the 1968 student takeover of the university amid the broad cultural rebellion against the Vietnam War.

On Thursday morning the students marched in a circle, their chants demanding that Columbia divest from Israel in protest of the ongoing slaughter in Gaza, in which around 34,000 people — more than 1 percent of Gaza’s population — have died , most of them women and children. The protesters were taking up a good bit of space and making a fair bit of noise. They were, according to the university, trespassing on the grounds of the school they pay dearly to attend. But they didn’t seem to be targeting, much less harming, any of their fellow students. The campus was closed to outsiders; the protest seemed unlikely to escalate. I took in the scene, then hopped on the subway to get back to my office.

I was stunned to learn, less than an hour later, that Columbia’s president, Nemat Shafik, had asked the New York Police Department to clear the camp, which had been established less than 48 hours earlier. What followed was the largest arrest of students at Columbia since 1968.

I knew that I would run into those students again: I live a block from the headquarters of the N.Y.P.D., where protesters are often booked and processed. Since Oct. 7 there have been regular demonstrations on my block as pro-Palestinian activists await the release of their friends. When I got home from the office, a huge crowd had already gathered.

Most of the students I tried to talk to did not want to be interviewed. Some had harsh criticisms of mainstream media coverage of the war in Gaza. Others were afraid that being associated with the protest movement could harm their career prospects. (These are Ivy League students, after all.) But eventually, many told me of their determination to keep protesting for a cause they feel is the defining moral challenge of their lives.

A quasi-encampment quickly sprung up down the block from my apartment, where students waited for their friends to be released. It took on a festive air: There were plenty of pizzas and boxes of doughnuts, cases of Gatorade and bottles of water. People guzzled coffee and used hand warmers to stave off the unusually chilly mid-April air as dusk approached. I didn’t see a drop of alcohol or smell a whiff of marijuana, usually an omnipresent scent on the streets of Lower Manhattan. I spotted a man braiding a woman’s hair into tidy pigtails. People bedded down on towels and blankets, settling in for a long wait.

The students were especially angry about the email they had received from Shafik, which, in the bureaucratic language of academic officialdom, informed them that their classmates were about to be bodily dragged from campus by police officers in riot gear: “I have always said that the safety of our community was my top priority and that we needed to preserve an environment where everyone could learn in a supportive context,” she wrote.

Shafik wrote to the N.Y.P.D . requesting that officers clear the quad, declaring the protests “a clear and present danger” to the university. If there was danger, the police seemed to struggle to find it. In remarks reported by The Columbia Daily Spectator , the Police Department’s chief of patrol, John Chell, said that there were no reports of violence or injury. “To put this in perspective, the students that were arrested were peaceful, offered no resistance whatsoever, and were saying what they wanted to say in a peaceful manner,” he said.

For the students I spoke to, the invocation of safety was especially galling because the arrests themselves were an act of violence, and the fact that many students reported receiving emails informing them that they were suspended and temporarily barred from their dorms, effectively rendering them homeless.

“The only violence on campus was the police carrying people away to jail,” one student told me. “It was an absolutely peaceful protest. Last night we had a dance circle. There has been nothing aggressive or violent.”

Others told me they felt Shafik’s message was clear and chilling.

“Some people have space to have pain,” one student at the protest outside police headquarters told me. “Others don’t get to have pain.” She said Muslim students, along with Arab and Palestinian students of all faiths, had been unfairly targeted on campus, describing an incident in which a private detective showed up at the dorm room door of a Palestinian American student.

Another student chimed in: “There is no hearing in Congress about Islamophobia.”

The previous day, Shafik had prostrated herself before the bad faith brigade that is the Republican-led House of Representatives. In testimony before the House’s education committee, Shafik seemed determined to avoid the fate of two other Ivy League presidents whose shaky performances led to their ousters. She intimated that she would not hesitate to discipline pro-Palestine professors and students for speech, and suggested that using the contested chant “from the river to the sea” could be cause for disciplinary action on its own.

In a world where almost any kind of advocacy on behalf of Palestinian self-determination risks being interpreted as antisemitism or a call for the destruction of Israel, her statements cast quite a pall. Her actions on Thursday drew instant rebuke from professors and other defenders of free speech on campus.

Columbia’s president seemed to believe that Republican Ivy League opportunists like Elise Stefanik would be satisfied with her willingness to throw students under the bus. Fat chance. On Thursday The New York Post reported that pro-Israel groups were unimpressed: They hired trucks with mobile billboards urging her to resign. “We’re here to help you move,” the billboards read.

I am old enough to remember when our public conversation was preoccupied with the coddling of college students, their unwillingness to confront hard truths and their desire for safe spaces, shielded from challenging ideas. Many of the voices who for years ridiculed the safety concerns of Black, brown, Indigenous and queer students are notably silent as an iron-fisted university leader sends in cops in riot gear to arrest college students for passionately engaging with political life and taking a stand on an important moral issue. If our richest universities, cosseted by tenure and plumped with their ample endowments, cannot be citadels of free speech and forums for wrestling with the most difficult ideas, what hope is there for any other institution in our country?

The right-wing culture war on America’s campuses has been unfolding for some time. Recently, legitimate concerns about rising antisemitism have helped push those forces into an uneasy alliance that threatens all kinds of speech. University administrators, trembling in the face of their powerful trustees and MAGA politicians, have fallen into a trap in which they must be ready to call in the troops at the slightest sign of discord involving politics they deem dangerous in the name of “safety.” These forces are an existential threat to the long tradition of free assembly in American universities.

But these students are not going to go quietly.

“The more they try to silence us, the louder we get,” one Columbia graduate student told me.

Late into the night on Thursday, despite the bone-deep cold, the crowd outside police headquarters remained thick, whooping and cheering as each batch of arrested students was released. Back on campus, dozens more students had already taken up residence on a neighboring lawn in Columbia’s quad, daring the university to try again.

Key facts about the abortion debate in America

The U.S. Supreme Court’s June 2022 ruling to overturn Roe v. Wade – the decision that had guaranteed a constitutional right to an abortion for nearly 50 years – has shifted the legal battle over abortion to the states, with some prohibiting the procedure and others moving to safeguard it.

As the nation’s post-Roe chapter begins, here are key facts about Americans’ views on abortion, based on two Pew Research Center polls: one conducted from June 25-July 4 , just after this year’s high court ruling, and one conducted in March , before an earlier leaked draft of the opinion became public.

This analysis primarily draws from two Pew Research Center surveys, one surveying 10,441 U.S. adults conducted March 7-13, 2022, and another surveying 6,174 U.S. adults conducted June 27-July 4, 2022. Here are the questions used for the March survey , along with responses, and the questions used for the survey from June and July , along with responses.

Everyone who took part in these surveys is a member of the Center’s American Trends Panel (ATP), an online survey panel that is recruited through national, random sampling of residential addresses. This way nearly all U.S. adults have a chance of selection. The survey is weighted to be representative of the U.S. adult population by gender, race, ethnicity, partisan affiliation, education and other categories.  Read more about the ATP’s methodology .

A majority of the U.S. public disapproves of the Supreme Court’s decision to overturn Roe. About six-in-ten adults (57%) disapprove of the court’s decision that the U.S. Constitution does not guarantee a right to abortion and that abortion laws can be set by states, including 43% who strongly disapprove, according to the summer survey. About four-in-ten (41%) approve, including 25% who strongly approve.

About eight-in-ten Democrats and Democratic-leaning independents (82%) disapprove of the court’s decision, including nearly two-thirds (66%) who strongly disapprove. Most Republicans and GOP leaners (70%) approve , including 48% who strongly approve.

Most women (62%) disapprove of the decision to end the federal right to an abortion. More than twice as many women strongly disapprove of the court’s decision (47%) as strongly approve of it (21%). Opinion among men is more divided: 52% disapprove (37% strongly), while 47% approve (28% strongly).

About six-in-ten Americans (62%) say abortion should be legal in all or most cases, according to the summer survey – little changed since the March survey conducted just before the ruling. That includes 29% of Americans who say it should be legal in all cases and 33% who say it should be legal in most cases. About a third of U.S. adults (36%) say abortion should be illegal in all (8%) or most (28%) cases.

Generally, Americans’ views of whether abortion should be legal remained relatively unchanged in the past few years , though support fluctuated somewhat in previous decades.

Relatively few Americans take an absolutist view on the legality of abortion – either supporting or opposing it at all times, regardless of circumstances. The March survey found that support or opposition to abortion varies substantially depending on such circumstances as when an abortion takes place during a pregnancy, whether the pregnancy is life-threatening or whether a baby would have severe health problems.

While Republicans’ and Democrats’ views on the legality of abortion have long differed, the 46 percentage point partisan gap today is considerably larger than it was in the recent past, according to the survey conducted after the court’s ruling. The wider gap has been largely driven by Democrats: Today, 84% of Democrats say abortion should be legal in all or most cases, up from 72% in 2016 and 63% in 2007. Republicans’ views have shown far less change over time: Currently, 38% of Republicans say abortion should be legal in all or most cases, nearly identical to the 39% who said this in 2007.

However, the partisan divisions over whether abortion should generally be legal tell only part of the story. According to the March survey, sizable shares of Democrats favor restrictions on abortion under certain circumstances, while majorities of Republicans favor abortion being legal in some situations , such as in cases of rape or when the pregnancy is life-threatening.

There are wide religious divides in views of whether abortion should be legal , the summer survey found. An overwhelming share of religiously unaffiliated adults (83%) say abortion should be legal in all or most cases, as do six-in-ten Catholics. Protestants are divided in their views: 48% say it should be legal in all or most cases, while 50% say it should be illegal in all or most cases. Majorities of Black Protestants (71%) and White non-evangelical Protestants (61%) take the position that abortion should be legal in all or most cases, while about three-quarters of White evangelicals (73%) say it should be illegal in all (20%) or most cases (53%).

In the March survey, 72% of White evangelicals said that the statement “human life begins at conception, so a fetus is a person with rights” reflected their views extremely or very well . That’s much greater than the share of White non-evangelical Protestants (32%), Black Protestants (38%) and Catholics (44%) who said the same. Overall, 38% of Americans said that statement matched their views extremely or very well.

Catholics, meanwhile, are divided along religious and political lines in their attitudes about abortion, according to the same survey. Catholics who attend Mass regularly are among the country’s strongest opponents of abortion being legal, and they are also more likely than those who attend less frequently to believe that life begins at conception and that a fetus has rights. Catholic Republicans, meanwhile, are far more conservative on a range of abortion questions than are Catholic Democrats.

Women (66%) are more likely than men (57%) to say abortion should be legal in most or all cases, according to the survey conducted after the court’s ruling.

More than half of U.S. adults – including 60% of women and 51% of men – said in March that women should have a greater say than men in setting abortion policy . Just 3% of U.S. adults said men should have more influence over abortion policy than women, with the remainder (39%) saying women and men should have equal say.

The March survey also found that by some measures, women report being closer to the abortion issue than men . For example, women were more likely than men to say they had given “a lot” of thought to issues around abortion prior to taking the survey (40% vs. 30%). They were also considerably more likely than men to say they personally knew someone (such as a close friend, family member or themselves) who had had an abortion (66% vs. 51%) – a gender gap that was evident across age groups, political parties and religious groups.

Relatively few Americans view the morality of abortion in stark terms , the March survey found. Overall, just 7% of all U.S. adults say having an abortion is morally acceptable in all cases, and 13% say it is morally wrong in all cases. A third say that having an abortion is morally wrong in most cases, while about a quarter (24%) say it is morally acceptable in most cases. An additional 21% do not consider having an abortion a moral issue.

Among Republicans, most (68%) say that having an abortion is morally wrong either in most (48%) or all cases (20%). Only about three-in-ten Democrats (29%) hold a similar view. Instead, about four-in-ten Democrats say having an abortion is morally  acceptable  in most (32%) or all (11%) cases, while an additional 28% say it is not a moral issue. 

White evangelical Protestants overwhelmingly say having an abortion is morally wrong in most (51%) or all cases (30%). A slim majority of Catholics (53%) also view having an abortion as morally wrong, but many also say it is morally acceptable in most (24%) or all cases (4%), or that it is not a moral issue (17%). Among religiously unaffiliated Americans, about three-quarters see having an abortion as morally acceptable (45%) or not a moral issue (32%).
