LL15 of 2020: A Brief Guide to Bird-Friendly Building Design

New mandates go into effect January 10, 2021

As New York continues in its efforts to go green, one important aspect of environmentally-friendly construction often lost in the frequent discussions about energy conservation is the effect on the wildlife.

Local Law 15 of 2020, going into effect on January 10, 2021, laser-focuses on this aspect, requiring the use of bird-friendly materials on the exteriors of new buildings and select alterations in order to reduce the frequency of bird collisions.

Already being hailed as one of the most broad-reaching bird-friendly building policies in the country yet, here’s what you need to know.

Which projects qualify?

The main focus of these mandates is on the exterior glazing, a building’s glass panels and elements. Since birds cannot see glass, collisions are the main cause of bird fatalities in the metro area.

But don’t think this means you have to run out and replace all your glass panels. For your building project to qualify under these new rules it must be:

• A new building (which by default has all-new glazing), or
• An alteration that is already replacing all exterior glazing.

This does NOT apply to:

• Any alterations not replacing the exterior glazing.
• Storefront replacements of a portion of exterior glazing within the building.

If you have a project already in the filing process, it will fall under LL15 if it hasn’t reached one of the following statuses by the effective date:

• Job Status D in BIS.
• Pending CPE/ACPE Assignment or Pending Prof Cert QA Assignment status in DOB NOW.

What is required?

The entire exterior wall envelope of the qualifying building must be constructed with bird-friendly materials from grade level up to 75 feet. They must also be used:

• Wherever a Fly-Through Condition (two parallel glass walls) is created, up to 75 feet above grade.
• Anyplace on the exterior where a Bird Hazard Installation (such as a glass awning, glass handrails and guards, glass wind break panels or glass acoustic barriers) is proposed, regardless of building height.
• On the exterior adjacent to any green-roof systems.

Said bird-friendly materials are defined as materials or assemblies with a Threat Factor (relative threat level to birds) of 25/100 or under, in accordance with one of the following measures:

• American Bird Conservancy Bird Collision Deterrence Material Threat Factor Reference Standard
• American Bird Conservancy Bird-friendly Materials Evaluation Program at Carnegie Museum’s Avian Research Center Test Protocol, or
• Another relevant ASTM standard

This can comprise of visual markers, glazing treatments that make the glass more visible to birds, and more.

The Importance of Bird-Friendly Construction

According the New York City Audubon Society, 90,000-230,000 birds are killed every year from flying into buildings, particularly into glass. This has resulted in over 3 billion birds lost in North America since 1970, a more than 25% decline of the breeding population.

Aside from the importance of preserving biodiversity in general, birds play an important role in pest control and pollination that must be protected.

The measures being proposed, created in conjunction with stakeholders like the Audubon Society, as well as the American Bird Conservancy and more, have in fact already been proven to work to reduce collisions: when Brooklyn’s Javits Center, considered one of the city’s three deadliest buildings for birds just 10 years ago, was renovated in 2013 to include bird-friendly glass, in reduced bird deaths in the area by a whopping 90 percent.

In addition, the installation of bird-friendly materials comes with the added bonus of reduced energy costs, so in many ways it’s a win-win for birds and humans.

In its November 2020 Service Notice, the NYC Buildings announces that, effective January 10, 2021, new buildings and alterations that replace all exterior glazing of a building must comply with bird friendly design construction requirements.

Exterior glazing refers to a building’s glass panels and elements. Local Law 15 of 2020 does not apply to:

alterations that do not replace all of the exterior glazing of the building

storefront replacements of a portion of exterior glazing within the building.

Bird-Friendly Construction Required as of January 10

Effective January 10, 2021, new buildings and alterations that include replacement of all exterior glazing must comply with Local Law 15 of 2020 , which requires bird-friendly design and construction. The law excludes alterations that do not replace all exterior glazing (a building’s glass panels and elements), including storefront replacements that affect only a portion of the exterior glazing.

The new requirements will also apply to filings made before January 10, 2021, that have not yet received job status “D” in the Buildings Information System (BIS) or that have a pending CPE/ACPE or Prof Cert QA assignment status in DOB NOW.

New Building Code Definitions

The local law aims to reduce the number of avian deaths in New York City—estimated between 90,000 and 230,000 by New York City Audubon. To that end, the legislation has introduced several new definitions to the building code.

Bird-friendly material refers to a material or assembly with a maximum threat factor of 25, based on one of the following standards:

• American Bird Conservancy Bird Collision Deterrence Material Threat Factor Reference Standard
• American Bird Conservancy Bird-friendly Materials Evaluation Program at Carnegie Museum’s Avian Research Center test protocol
• Relevant ASTM standard

Bird Hazard Installations are monolithic glazing installations that offer a clear line of sight on building exteriors, including, but not limited to, the following:

• Glass awnings
• Glass handrails and guards
• Glass wind break panels
• Glass acoustic barriers

Fly-Through Conditions describe one or more panels of glass offering a clear line of sight through such elements, which creates the illusion of a passage to the other side. Such conditions include parallel glass elements positioned within 17 feet of one another, as well as a convergence of glass sides to create a perpendicular, acute, or obtuse corner.

Bird-Friendly Construction Requirements

Affected construction projects must use bird-friendly materials in the exterior wall envelope, as well as any associated openings, up to 75 feet above grade. Use of other materials may not exceed an aggregate area of 10 square feet within any 10’ x 10’ square area of exterior wall below the 75-foot threshold.

The following exceptions apply:

• Where the New York City Zoning Resolution requires ground-floor transparency, transparent bird-friendly material with a UV-reflective pattern and a maximum threat factor of 27 shall be used.
• In areas of special flood hazard and shaded X-Zones where the New York City Zoning Resolution proposes flood-resistant glazing and requires ground-floor transparency, transparent bird-friendly material with a UV-reflective pattern and a maximum threat factor of 36 shall be used.

Bird-friendly materials are required for construction of all bird hazard installations, regardless of their height above grade.

Fly-through conditions located 75 feet or less above grade must also be constructed from bird-friendly materials.

For green roof systems, the adjacent exterior wall envelope and any associated openings must be constructed with bird-friendly materials up to 12 feet above the walking surface.

The Department of Buildings has published a Bird Friendly Building Design & Construction Requirements Guidance Document to assist with compliance.

The time it takes to prepare for your exam depends on the level and topic but can vary from two to 10 weeks of study, two to three hours a day, or two to five full days if you take a prep course.

To pursue ISTQB certification, you must begin with the foundation-level Certified Tester certification, as it is a prerequisite for all other exams. Choose the certificates you want to earn based on your skill level, current position, or the position you hope to advance to on your career path. 

Foundation-level ISTQB certifications

Prerequisites: Everyone can take the Certified Tester Foundation Level (CTFL). Before taking the Agile Tester Foundation Level (CTFL-AT), you must pass the CTFL exam.

Preparation time: Self-study 3–4 weeks at 2–3 hours per day; course prep three full days

Certified Tester (CTFL): Verifies your foundational knowledge in software testing and is for testers, test consultants, software developers, and other software professionals, as well as anyone who wants to show their basic understanding of software testing.

Agile Tester (CTFL-AT): Affirms you have essential software testing skills to participate in Agile projects and is for software professionals working in Agile environments or who plan to.

Advanced-level ISTQB certifications

Prerequisites: Before taking any advanced-level exams, you must pass the CTFL exam and have significant industry experience. To take the advanced-level Agile exams, you must also pass the CTFL-AT first.

Preparation time: Self-study 2–6 weeks at 2–3 hours per day; course prep 2–4 full days

Technical Test Analyst (CTAL-TTA): Validates your technical software testing skills, such as white box testing, testing automation, and static and dynamic analysis, and is for you if you are involved in software testing.

Test Analyst (CTAL-TA): Demonstrates your skills as a test analyst across the software development lifecycle and is for you if you are working in test analysis or test design.

Test Manager (CTAL-TM): This shows you have the skills and knowledge needed to manage all testing phases throughout the software development lifecycle and is for you if you have advanced in your quality assurance career and want to aspire to a management role.

Agile Technical Tester (CTAL-ATT): Measures your technical software testing skills while using the Agile project management approach, including test automation, deployment and delivery, and Agile techniques, and is for you if you're a software tester working in Agile environments or aspire to be. 

Agile Test Leadership at Scale (CTAL-ATLaS): Verifies your advanced knowledge and skills in organizing and improving quality and testing using Lean and Agile processes and is intended for quality coaches, members of an Agile team, project managers, test managers, and others in leadership positions who understand Agile testing or whose organization is moving towards Agile procedures.

Expert-level ISTQB certifications

Prerequisites: To take the test management expert certifications, you must pass the CTFL exam and Advanced Test Manager exam, have sufficient practical experience, and have five years of industry experience.

Preparation time: Self-study 7–10 weeks at 2–3 hours per day

Test Management (CTEL-TM): To receive full certification in Test Management at the expert level, you must pass the exams for the following three certifications. These are for you if you have already advanced in your software testing career and would like to show your expertise in a specific area:

Managing the Test Team (CTEL-TM-MTT): Acknowledges your management skills in building, developing, and leading software testing teams.

Operational Test Management (CTEL-TM-OTM): Validates your ability to manage other managers and teams as well as your skills in project risk management, reporting and interpreting test results, and moderating effective meetings.

Strategic Test Management (CTEL-TM-SM): Ensures you can manage external and internal relationships, evaluate efficiency and effectiveness, and align organizational goals with test policies and strategies.

Improving Test Processes (CTEL-ITP): To receive full CTEL-ITP certification, you must achieve the following certifications. Like the test management certifications, these are for you if you have already advanced in your software testing career and would like to show your expertise in a specific area: 

Assessing Test Processes (CTEL-ITP-ATP): Verifies your skills in evaluating and advising on the test process, including choosing and implementing the right approach.

Certified Software Tester (CSTE)

To qualify for this certification exam, you should have been working in the information services field within the 18 months leading up to the exam and meet one of the following criteria:

Four-year degree plus two years of experience in information services

Three-year degree plus three years of experience in information services

Certified Software Quality Analyst (CSQA)

This certification confirms your expertise as a quality analyst in the software field.  Skills tested include quality principles and concepts, leadership, assessments, planning, internal control and security, outsourcing, work processes, metrics and measurement, and quality control practices. To qualify for the exam, you must meet one of the criteria outlined for the CSTE. 

Certified Associate in Software Quality (CASQ)

The CASQ certification shows that you have a solid understanding of the underlying QA practices and principles. Prerequisites include one of the following:

Three- or four-year degree

Two-year degree plus one year of experience in the information services field

Three years of experience in the information services field

Certified Manager of Software Quality (CMSQ)

This certification shows you have the competency, knowledge, and management skills to work as a software QA manager. To register for the CMSQ certification exam, you must currently work in the software quality assurance field and meet one of the following prerequisites:

Bachelor's degree and four years of experience in the software quality assurance field

Associate degree and six years of experience in the software quality assurance field

Eight years of experience in the software quality assurance field

Why do I see “Pending Assignment”?

Any time you change the profile assignment for an agent host (from the configuration profile or agent summary) you’ll see Pending Assignment until the change is downloaded to the agent. How long this takes is based on the Configuration Download Interval setting in the configuration profile (under performance settings). We recommend you set this to 1 hour (3600 seconds).
