Doe defendants used false identities —

Every isp in the us has been ordered to block three pirate streaming services, isps ordered to block the pirate websites "by any technological means available.".

A federal judge has ordered all Internet service providers in the United States to block three pirate streaming services operated by Doe defendants who never showed up to court and hid behind false identities.

The blocking orders affect Israel.tv, Israeli-tv.com, and Sdarot.tv, as well as related domains listed in the rulings and any other domains where the copyright-infringing websites may resurface in the future. The orders came in three essentially identical rulings (see here , here , and here ) issued on April 26 in US District Court for the Southern District of New York.

Each ruling provides a list of 96 ISPs that are expected to block the websites, including Comcast, Charter, AT&T, Verizon, and T-Mobile. But the rulings say that all ISPs must comply even if they aren't on the list:

It is further ordered that all ISPs (including without limitation those set forth in Exhibit B hereto) and any other ISPs providing services in the United States shall block access to the Website at any domain address known today (including but not limited to those set forth in Exhibit A hereto) or to be used in the future by the Defendants ("Newly Detected Websites") by any technological means available on the ISPs' systems. The domain addresses and any Newly Detected Websites shall be channeled in such a way that users will be unable to connect and/or use the Website, and will be diverted by the ISPs' DNS servers to a landing page operated and controlled by Plaintiffs (the "Landing Page").

That landing page is available here and cites US District Judge Katherine Polk Failla's "order to block all access to this website/service due to copyright infringement."

"If you were harmed in any way by the Court's decision you may file a motion to the Federal Court in the Southern District of New York in the above case," the landing page also says.

“Gone to great lengths to conceal themselves”

The three lawsuits were filed by Israeli TV and movie producers and providers against Doe defendants who operate the websites. Each of the three rulings awarded damages of $7.65 million. TorrentFreak pointed out the rulings in an article Monday .

In all three cases, none of the defendants responded to the complaints and did not appear in court, the judge's rulings said. "Defendants have gone to great lengths to conceal themselves and their ill-gotten proceeds from Plaintiffs' and this Court's detection, including by using multiple false identities and addresses associated with their operations and purposely deceptive contact information for the infringing Website," the rulings say.

The defendants are liable for copyright infringement and violated the anti-circumvention provision of the Digital Millennium Copyright Act (DMCA), the judge wrote, describing the infringement as follows:

Through the Website, Defendants have been re-broadcasting and streaming Plaintiffs' original content, broadcasting channels and TV services which are only authorized for broadcasting and/or viewing in the territory of the State of Israel and under a license. The Infringing Broadcasting includes original content produced and owned by Plaintiffs, mostly in Hebrew, and also from major studios in the United States and elsewhere, licensed to Plaintiffs for broadcasting exclusively in Israel (except as expressly licensed for broadcast in the United States).

Rulings further target web hosts and banks

The plaintiffs are United King Film Distribution, D.B.S. Satellite Services (1998), HOT Communication Systems, Reshet Media, and Keshet Broadcasting. While the plaintiffs "transmit their programming in an encrypted form," the defendants' "various services and hardware permit end-user consumers to bypass the Plaintiffs' encryption to view Plaintiffs' content," the rulings said.

The judge ordered domain registrars and registries to transfer the domain names to the plaintiffs. The rulings include injunctions against "third parties providing services used in connection with Defendants' operations," including web hosts, content delivery networks, DNS providers, VPN providers, web designers, search-based online advertising services, and others.

Financial institutions face similar bans on doing business with the blocked websites. The rulings directly target the defendants' monetary accounts, saying that plaintiffs "shall have the ongoing authority to serve this Order on any party controlling or otherwise holding such accounts" until they have "recovered the full payment of monies owed to them by any Defendant under this Order." This applies to PayPal, banks, and payment providers in general.

With more people stuck at home as a result of lockdown orders, visits to illegal streaming sites have increased significantly over the past few months according to new research from FACT.

The UK's intellectual property protection organization revealed that links to illegal streaming sites doubled between February and April. However, links to recently released films trebled during the same period.

CEO of FACT, Kieron Sharp explained to the BBC how this increase in illegal streaming could prevent new films from being financed in the future, saying:

"It's essential to remember that the only legal way of watching films is through the official providers. Every pirated link that we detect denies the rights holder of revenue they are entitled to, and also threatens investment in future content."

Illegal streaming

While FACT did not reveal the names of the recently released films that were streamed illegally online in large numbers, the organization did encourage people to report any illegal streaming sites to Crimestoppers.

Since the beginning of the coronavirus outbreak, more users have turned to illegal downloading and streaming sites. Back in March for instance, the piracy-tracking firm Muso revealed that traffic to illegal streaming and download sites rose by almost 60 percent. However, just as demand for online piracy grew, so too did demand for legal online streaming services with Netflix adding a record 15.8m subscribers during Q1 2020. 

When it came to illegally streaming new releases, the Oscar-winning film Parasite saw demand rise by 240 percent at the start of the pandemic. The 2011 film Contagion , about a virus outbreak, also saw a rise in illegal streaming visits of 151 percent.

I n the 2000s, I arrived at university to vast libraries, thousands of strangers and the riches of academic life – plus a gigabit broadband connection that would be used on downloading pirated versions of every piece of entertainment ever made. In between essays, I watched classic movies, listened to vast discographies, and binged the entire run of Buffy the Vampire Slayer . That particular choice might mark this story out as one that belongs firmly in the past, but piracy itself is far from dead.

We are living in a golden age of streaming. Netflix , Disney+, Amazon Prime Video and Apple TV+ are pumping out award-winning shows. Britain’s public service broadcasters have more box sets than you can consume in a lifetime. If you have a niche interest, someone is streaming it for you somewhere: Sony’s Crunchyroll for anime fans, BFI Player for film buffs, Sky’s History Play for those who really like ancient aliens. And even before the pandemic forced film studios to experiment with simultaneous cinema and home releases, we had access to more films and shows than any other point in history.

But as the new releases keep coming, the bills start growing. If your interests are decidedly mainstream, the basic tiers of the five largest paid-for streaming services in the UK – the aforementioned US giants, plus Sky’s Now TV – will cost you almost £40 a month. Drop any one of them, and you will inevitably miss out on the pop culture craze of the month: no Now TV means no The White Lotus ; no Disney+ means no Marvel.

So it is no wonder that an increasing number of viewers are turning, or returning, to less legitimate services. In 2021, we’re no longer reminded that we “wouldn’t steal a car” on anti-piracy adverts, but piracy never went away – and it’s now more appealing than ever.

This wasn’t how it was supposed to be. Piracy was meant to follow the path set by the music industry: where technological change initially enabled new forms of copyright infringement, then spurred rejuvenation, settling into a new equilibrium.

Napster, and then peer-to-peer filesharing, were the innovations that rocked music. Global recorded music sales peaked in 1999, at $25.2bn, then bottomed out 14 years later at barely half that. Illegal downloading wasn’t just cheaper than buying CDs, it was also more convenient than traipsing to the high street. But music streaming, arriving with the launch of Spotify, changed everything. Streaming meant instant access and a better user experience than piracy. Where legal downloads peaked at 27% of the industry’s total revenue in 2014, last year streaming made up 62% of music revenue , with 2020 seeing the highest earnings since 2003.

The hope was that the film industry would repeat music’s success in tackling piracy. The shift from VHS to DVDs to Blu-rays wasn’t as phenomenally successful for film and television as the CD boom was for music; cinema and broadcast rights still made the lion’s share of revenue. But when download speeds increased, piracy became an ever bigger problem.

“In any phase of technological development, you see rapid changes in the illegal market, which are quicker than the changes in the legal market,” says Kieron Sharp, chief executive of the UK anti-piracy group Fact (it of the “You wouldn’t steal a car” adverts). “If you don’t continually fight the pirates and those stealing your content, it’s going to be a bit of a free-for-all.”

Video piracy, which had been a matter of low-level criminal gangs selling counterfeit DVDs on the street when Sharp joined Fact, boomed in the late 00s. The legal market quickly responded: former DVD-subscription service Netflix began streaming in January 2007, while BBC’s iPlayer launched by the end of the same year. It seemed the video industry would follow music’s path: disruption, response, equilibrium. But over the last decade, the differences between the two sectors have become clear, and the blame could lie with House of Cards.

Netflix’s 2013 adaptation of the Michael Dobbs novel starring Kevin Spacey was the streaming service’s first in-house production, and an enormous hit. Winning three Emmys, it suggested a future for the streaming service very different from that of Spotify, still two years from facing its first serious competition in the form of Apple Music. Where music streaming services competed to have the fullest libraries possible, Netflix leaned hard on having exclusive, acclaimed shows. As a business strategy, it paid off. For Netflix, and the other streaming services that followed, the upfront cost of an exclusive show is huge – but so is the incentive for new users to hop on board.

That is until the system breaks down. Andy Chatterley, chief executive of the piracy analytics firm Muso, thinks this began in the pandemic: “In 2020 there was this massive increase in piracy at the start of the pandemic, where everyone suddenly found themselves working from home. That’s unusual – we normally see big spikes up on things like 1 January, holidays, but the average is smooth.”

Chatterley’s data, gathered across a range of piracy sites, shows a prominent bump in the first few months of lockdown (driven, interestingly, by a huge increase in weekday piracy as the days of the week blurred into one). But the real change came in 2021, when studios and channels began to realise they couldn’t hold all their new releases for cinemas to reopen.

The tale is less one of demand than of supply. For movies, piracy had typically been kept at bay while the film was in cinemas, and viewers had to either pay, or settle for a fuzzy version recorded on a hidden camera. But the pandemic broke that pattern: films such as Black Widow , Godzilla vs King Kong and Wonder Woman 1984 , released on streaming days after they hit the few cinemas left open, drove incredible traffic to piracy sites.

But if the pandemic and a fragmented market are driving people to piracy, it is having less of an impact on what they’re watching. Muso’s data shows that the most popular pirated shows in the UK in July included a few that are available on free-to-air TV, such as Rick and Morty and Love Island . Yes, Disney+ exclusives such as Loki and Star Wars: The Bad Batch are in the Top 10, as is the CW hit Superman & Lois, which is still yet to be legally available in the UK. But the data suggests people are choosing to pirate first, and what to watch second. That’s not surprising, Chatterley says, given the ease of modern piracy. “When people actually apply piracy, they’re completely satisfied in their viewing experience. They’re using a streaming platform with extremely sophisticated user experience.”

And after just a few years of streaming, we now have streaming fatigue: too many different services and not enough time. The problem is particularly acute in the US, where many big broadcasters have brought out their own streaming services – HBO Max, Paramount+ and NBC’s Peacock – each with monthly fees to pay. Analysts are predicting a wave of failures and consolidation over the next few years, likely to drive even more piracy.

Until then, over at Fact, Sharp will continue to fight against a seemingly unending tide. Where the industry has had some success in the courts shutting down large piracy sites, the breadth of the problem film and TV are facing can been seen in another corner of the streaming world: sport. According to an Office for National Statistics (ONS) survey, more than a third of those who watch live sports online do so illegally. The time pressure for finding and stopping such streams when a match is on is intense. “You’d send takedown notices to people whose services were offering the live sport, and the live sport was over by the time they were down,” Sharp says. “So things have got to improve there.”

When there are things to pay for, there will always be people looking for ways to get them for nothing. The question now is whether, having come so close to being pushed underground, piracy could rear its head not as the only option for thieves but as the simpler alternative for everyone.

In 2021, hundreds of people received letters from lawyers demanding fines of £800 after watching Ava, a Hollywood movie, via Virgin Media. The film was only available exclusively on Netflix.

This scenario shows the legal consequences of watching copyrighted movies on unauthorized or free sites.

Japan’s Revised Copyright Act on Watching and Downloading Illegal Streams

The Copyright Act was revised in 2020 . The new law cracks down on leech websites, which are simply sites that do not host illegal content but rather contain links to pirate websites.

Specifically, operating leech websites and posting URLs to pirated content on a leech website and app is illegal.

The consequences are severe: A leech website operator can face up to five years in prison, up to Y5 million in fines, or both. Also, providing URLs to pirated sites can lead to up to three years in jail, up to Y3 million in fines, or both.

According to this new law, watching pirated content online isn’t illegal.

The Criminal and Non-Criminal Downloads

What does the Copyright Act amendment say about the downloading of pirated content? Well, the new law makes it illegal to download online content except videos or music. However, other forms of downloading are exempted, including:

• Downloading pirated content unintentionally
• Downloading parodies and derivative works
• Screenshotting or downloading minor sections of pirated works, like a few panels of manga
• Downloading pirated works under unique circumstances that don’t unfairly prejudice the copyright owner’s interests

Notably, other forms of downloading are criminal, and copyright infringement occurs when a user downloads pirated content repeatedly or offers it to the public at a fee.

Italy is among the first nations to take the harshest stance against people who use illegal streams. From August 8, 2023, if you are an Italian resident caught watching pirated streams, you risk paying up to 5,000 euros as a fine.

The copyright law supports this fine, and Authority Communications (AGCOM), the country’s telecom regulator, approves it.

The law now gives AGCOM more powers to crack down on illegal streams. The telecom regulator no longer needs the judge’s approval to block them.

Instead, it can order internet service providers (ISPs), social media platforms, and search engines to block domain names and network traffic to sites streaming content illegally.

After getting these orders, ISPs must block users from accessing these sites within 30 minutes or risk fines.

The amendment raises the fine for unauthorized access to copyrighted content to 5,000 euros for users who do it repeatedly. First offenders are charged 154 euros as a fine.

These charges apply to both distributors and viewers of pirated content. In 2022, for example, the Italian financial police located the homes of pirate IPTV services subscribers , sending them letters to pay 154 euros for committing an offense the first time or 1.032 euros for repeated violations.
