A citizen of a foreign country who wishes to work in the United States must first get the right visa.  If the employment is for a fixed period, the applicant can apply for a temporary employment visa.  There are 11 temporary worker visa categories.  Most applicants for temporary worker visas must have an approved petition.  The prospective employer must file the petition on behalf of the applicant.  U.S. Citizenship and Immigration Services (USCIS) reviews the petition.

Labor certification.

Certain visa categories need an approved labor certification. First, the prospective employer must apply for the labor certification with the Department of Labor .  Then, the prospective employer can file the Petition for a Nonimmigrant Worker, Form I-129, with USCIS.  Please refer to the Instructions for Form I-129   on the USCIS website to confirm if you need  the labor certification.

Petition Approval

Some temporary worker categories are limited in the total number of petitions which can be approved on a yearly basis. Before an applicant can apply for a temporary worker visa, USCIS must first approve the Petition for a Nonimmigrant Worker, Form I-129 .    For more information about the petition process, see Working in the U.S. and Temporary (Nonimmigrant) Workers on the USCIS website.  Once USCIS approves the petition, it will send the prospective employer a Notice of Action, Form I-797.

How to Apply

You may apply for a visa when USCIS has approved your petition. There are several steps in the visa application process. The order of these steps and how you complete them may vary at the U.S. embassy or consulate where you apply. Please visit the embassy or consulate website for instructions on how to apply.

Complete The Online Visa ApplicationComplete The Online Visa Application

  • Online Nonimmigrant Visa Application, Form DS-160 – Learn more about completing the DS-160 . You must: 1) complete the online visa application and 2) print the application form confirmation page to bring to your interview.
  • Photo –You will upload your photo while completing the online Form DS-160. Your photo must be in the format explained in the Photograph Requirements .

Schedule an Interview

Applpicants of a certain age may not need to have an interview. Consular officers have the discretion to  interview any applicant, regardless of age.

You must schedule an appointment for your visa interview at any U.S. Embassy or Consulate where you live.  However, it may be difficult to qualify for a visa outside of your place of permanent residence.

Wait times for interview appointments vary by location, season, and visa category.  You should apply for your visa early.  Review the interview wait time for the location where you will apply:

Applicants scheduling visa appointments in a location different from their place of residence should check post websites for nonresident wait times.

You will need to provide the receipt number to schedule an interview.  The receipt number is printed on your approved Petition for a Nonimmigrant Worker, Form I-129, or Notice of Action, Form I-797.

Prepare for your Interview

  • Fees - Pay the non-refundable visa application fee , if you are required to pay it before your interview. When your visa is approved, you may also pay a visa issuance fee, if applicable to your nationality. Fee information is provided below:

Reciprocity Fees

Nonimmigrant visa applicants from certain countries*/areas of authority may be required to pay a visa issuance fee after their application is approved. These fees are based on the principle of reciprocity:  when a foreign government imposes fees on U.S. citizens for certain types of visas, the United States will impose a reciprocal fee on citizens of that country*/area of authority for similar types of visas.

  • L visa applicants included in a L blanket petition : must also pay the Fraud Prevention and Detection fee and may need to pay the Border Security Act fee. Select  All Fees  to learn more.

Gather Required Documentation

Gather and prepare the following required documents before your visa interview:

  • Passport  valid for at least six months beyond your period of stay in the United States (unless exempt by country-specific agreements ).  Each person included in a single passport needs a separate visa application.
  • Nonimmigrant Visa Application, Form DS-160 confirmation page .
  • Application fee payment receipt, if you are required to pay before your interview.
  • Photo – You will upload your photo while completing the online Form DS-160. If the photo upload fails, you must bring one printed photo in the format explained in the Photograph Requirements . 
  • Petition Receipt Number as it appears on your Petition for a Nonimmigrant Worker, Form I-129, or Notice of Action, Form I-797.
  • L Visa Applicants  included in an L blanket petition, must bring Form I-129S to the interview.

Legal Rights and Protections

H-1B, H-2A, and H-2B visa applicants should read the Legal Rights and Protections pamphlet before applying for a visa.  The pamphlet includes information on your rights in the United States and protection available to you.

Additional Documentation May Be Required

Review the instructions on how to apply for a visa on the website of the embassy or consulate where you will apply. Additional documents may be requested to establish if you are qualified.  

Most visa applicants, except H-1B and L, need to show their intent to return to their home country after their temporary stay in the United States. They can do so by showing proof of compelling ties to the home country, which may include:

  • A residence abroad which you do not intend to abandon
  • Your family relationships
  • Your economic situation
  • Your long term plans

Attend your Visa Interview

During the visa interview, a consular officer will determine if you are eligible for the visa.  The consular officer will also determine if the visa category is appropriate for your purpose of travel. You will need to establish that you meet the requirements under U.S. law to receive the category of visa for which you are applying.

Ink-free, digital fingerprint scans will be taken as part of your application process. They are usually taken during your interview, but this varies based on location.

After your visa interview, your application may need further administrative processing . A consular officer will inform you if further processing is necessary for your application.

Depending on your nationality, you may need to pay a visa issuance fee.  You must pay this fee when the visa is approved.  The embassy will explain how your passport with visa will be returned to you.  Review the visa processing time , to learn how soon your passport with visa will generally be ready for pick-up or delivery by the courier.

Entering the United States

A visa allows a foreign citizen to travel to a U.S. port-of-entry (generally an airport).  A visa also allows you to request permission to enter the United States.  A visa does not guarantee entry into the United States.  U.S. Customs and Border Protection (CBP) officials at the port-of-entry have authority to permit or deny admission to the United States.  When admitted, you may get an admission stamp or  Form I-94, Arrival/Departure Record. Extending Your Stay

You must leave the United States on or before the date indicated on your admission stamp or Form I-94.  You can request to extend your stay by contacting USCIS.  Visit USCIS's Extend Your Stay website for more information.

Failure to leave the United States on time will result in you being out of status . Under U.S. law, visas of travelers who are out of status are automatically voided ( Section 222(g) of the Immigration and Nationality Act ). If you had a multiple-entry visa and it was voided due to you being out of status, it will not be valid for future entries into the United States.

Change of Status

While in the United States, you may be able to request a change to another nonimmigrant category.  See Change My Nonimmigrant Status on the USCIS website to learn more.

Requesting a change of status does not require that you apply for a new visa, as long as you remain in status. If you cannot remain in status while USCIS processes your change of status request, you must apply for a visa at a U.S. embassy or consulate.

Additional Information

  • The approval of a petition does not guarantee that you will get a visa. Do not make final travel plans or buy tickets until you have a visa.
  • Spouse and Children –
  • Your spouse and unmarried, minor children may also apply for the same visa category as you to accompany or join you.  The only exception is for Cultural Exchange Visitor Q-1 visa applicants.  You must be able to show that you will be able to financially support your family in the United States.

  • Unless canceled or revoked, a visa is valid until its expiration date.  Therefore, a valid U.S. visa in an expired passport is still valid. If you have a valid visa in your expired passport, do not remove it from your expired passport. You may use your valid visa in your expired passport along with a new valid passport for travel and admission to the United States.

Formatting Your Letter

Step 1 Type your letter on a computer.

  • Use a standard word-processing application , even if you plan to deliver the letter using email . It typically is better to send an attachment than to write your letter in the body of an email. However, you should probably check with the embassy first to see what is preferred.
  • Most word-processing applications have a template that you can use to create a business letter. These templates typically will set your margins and paragraph styles for you.
  • Use a standard, readable font such as Times New Roman or Helvetica, in a 12-point size. Do not use script fonts.


Step 2 Search for templates.

  • These templates give you suggested language to use so you can more easily write and address your letter. Don't copy them verbatim, though. Read them carefully and make sure the suggested language suits your situation. If any of it doesn't apply, don't include it.
  • Look into the background of the website before you use their suggested language. Most of these websites have an "about" page where you can find out who is in charge of the website. Make sure it's an individual or organization you can trust.

Step 3 Use block paragraphs.

  • If you're writing in a language that is read from right to left, such as Arabic or Hebrew, your paragraphs would be right-justified.

Step 4 Put the date at the top.

  • Generally, you shouldn't worry if you end up being a day off. For example, you could finish your letter intending to mail it that day, but not make it to the post office until after the close of business. That would mean you'd have to mail your letter the next day, but you wouldn't have to print up a new letter with the different date.
  • However, while delaying a day or two is fine, if you end up not being able to mail the letter for a week or longer, you probably want to print a fresh copy with an adjusted date. Your reader will expect the date on the letter to be identical or close to the date of the postmark.

Step 5 Find the appropriate address.

  • Keep in mind that many larger embassies will have different addresses for you to use depending on the reason for your letter.
  • If you don't already know, you'll also need to find out the correct person to address who can help you with your issue. Internet sites, such as Project Visa or Embassy World, as well as Internet searches for the country and the word "embassy" can help you identify the right person. You also can call the embassy directly to identify the best contact.
  • Type the name of the person you are addressing, the name of the embassy and the address of the embassy to which you are writing. Write this in the same format as you would write it on an envelope for mailing.
  • For example, if you're writing to an embassy staff member at the Canadian embassy, you would write "Mr. Potter, Canadian Embassy" on the first line of the address block, followed by the physical address. If Mr. Potter is the ambassador, you would write "The Honorable Mr. Potter, Ambassador of Canada, Canadian Embassy." Note that for many countries the correct title for an ambassador is "Excellency," as in "His Excellency Mr. Potter, Ambassador of Canada, Canadian Embassy."

Step 6 Write a subject line.

  • For example, you might write "Request for tourist visa for parents" or "Invitation to French Consulate party."
  • If you're writing in English, the subject line typically is preceded by the letters "RE," a Latin abbreviation that essentially means "regarding."
  • Your subject line enables the person who receives your letter to direct it to the right member of embassy staff, in the event that you've sent it to the wrong person. With a subject line, they can do this quickly without having to read the whole letter. For this reason, a subject line is particularly important if you haven't been able to identify a specific person.

Writing Your Letter

Step 1 Research the etiquette used in the country to which you are writing.

  • You may be able to find this information on the embassy's website, or by doing a quick internet search using the country's name with words such as "etiquette," "diplomatic protocol" or "forms of address."
  • Keep in mind that in countries that have a monarchy and recognize nobility, there may be nobles who serve as ambassadors or in other embassy positions. These titles may supersede any general title for members of embassy staff.
  • Your letter should be written in a formal tone, using the utmost in politeness and courtesy. If you're writing in a language that has a formal "you," such as French or Spanish, you should use that.
  • Pay careful attention when writing to the ambassador specifically, as the title differs depending on whether you are a citizen of the country for which the individual is serving as an ambassador. If you are a citizen of the same country as the ambassador, you may address them as "The Honorable." However, if you are a citizen of a different country, you typically must call them "Her [or His] Excellency," following diplomatic custom. Make sure you have the correct gender – don't just assume based on the name.

Step 2 Start with your greeting.

  • To address the person correctly, you'll need to follow the correct etiquette or diplomatic protocol based on your research.
  • If you're addressing the consul general or any other embassy employee, you'll generally use their full name. For example, you might write "Dear Mr. Potter." However, pay attention to any other titles the person might have, such as if they are a member of the nobility or have a doctorate.
  • Use "Dear Honorable Ambassador" if you are addressing the ambassador directly.
  • If you don't know the name or gender of the person to whom you're writing, you can begin your letter "Dear Sir or Madam." However, you should make every effort to address your letter to a specific person. If you get the wrong person, it can always be rerouted.
  • Follow the greeting with the punctuation customary in the embassy's country. In some, a comma is appropriate, while others follow the greeting with a colon.

Step 3 Introduce yourself.

  • The first sentence should state your name and your country of citizenship. Follow that with any additional identification information that is relevant to your reason for writing.
  • Follow the first sentence with a brief description of your reason for writing. This should be no longer than a sentence or two.

Step 4 Explain your reason for writing.

  • The length of your letter, and the contents of the remaining paragraphs, will depend on your reason for writing. If you need to give an extended background or timeline of a situation to which you want the ambassador or another embassy official to respond, this may be lengthy.
  • If you're writing for a procedural reason, such as to request a visitor visa, your letter typically shouldn't be more than three paragraphs long, and shouldn't go for more than a page or two at most.
  • Keep your writing clear and concise, and use formal language throughout. If you address the person to whom you're writing anywhere in the body of your letter, use their official title and follow any other rules of etiquette you gleaned from your research.

Step 5 Add your closing.

  • If you need something specific from the person, state what that is and the timeframe within which you need it. Remember to allow for time for mailing.
  • Be careful giving a deadline, particularly if you're writing to the ambassador or a higher-ranking staff member. Instead of making a demand, say something like "Please be advised that I must have the document I requested within one month or I'll not be able to complete my application," or "Please respond by the end of this month so I can meet my deadline."
  • Follow that with a sentence thanking the recipient for their time and attention. For example, you might write "I appreciate that you have many demands on your time. Thank you for your prompt attention to this matter."
  • If you are unsure whether you sent your letter to the correct person, you may want to include a note to that effect. For example, you might write "If there is someone else at the embassy better capable of handling my issue, I ask that you kindly forward this letter to them."

Sending Your Letter

Step 1 Finalize your letter.

  • End your letter with a closing greeting such as "Sincerely yours," and leave a few blank lines for your signature. Below that, type your name and address, along with any other identification or contact information you think is necessary, such as your phone number or email address.
  • If you're including any other documents with your letter, list them at the bottom of your letter so the reader knows what attachments to expect. You also can use this list as a checklist for yourself to make sure you've included everything necessary.
  • Print your final letter and sign it using a pen with blue or black ink. Check the date on your letter before you send it and make sure you don't need to adjust it forward.
  • When you've signed your letter, make a copy of the signed letter for your own records.

Step 2 Gather any attachments.

  • If you're sending original documents, it's generally best to use a larger manilla envelope that will allow you to mail them without folding them.
  • For copies, use a standard letter-sized envelope unless you have more than three or four sheets, in which case it's generally better to use a larger manilla envelope and leave them flat rather than folding them.
  • Mark each copy or document carefully in case they get separated from each other.

Step 3 Mail...

  • Include your name and the return address on the envelope. This will be written either on the back of the envelope or on the upper-right-hand corner, depending on the country's custom.
  • The name and address of your recipient should be written in the middle or lower-right portion of the envelope, again depending on the country's custom. Use the recipient's formal title if applicable.
  • You may want to wait until you get to the post office to address your envelope, or research formatting ahead of time.
  • If you're handwriting the addresses on the envelope, use a ballpoint pen so the ink won't smear, and print carefully or write in all caps. Don't write in cursive or script on the envelope, as it is difficult to read.

‘Exhausted and insulted’: how harsh visa-application policies are hobbling global research

In February, I was meant to speak at the European Conference of Tropical Ecology in Lisbon, providing evidence of extinction risks to some frog species used as bushmeat in West Africa, and highlighting the need for policies that regulate hunting pressures.

In January, I duly applied at the Dutch embassy in Accra for a business visa to the European Union Schengen area. My application included the invitation from the conference organizers, a letter from my sponsors — the Center for International Forestry Research and World Agroforestry, and the UK Global Challenges Research Fund’s Trade, Development and the Environment Hub — and an introductory letter from the dean of graduate studies at the University of Ghana, confirming my status as a final-year PhD candidate. It also included current and old passports that showed my extensive travels, mostly to the United Kingdom.

Tear down visa barriers that block scholarship

Almost three weeks later, my passport was returned with a rejection note, stating that I had not provided justification for the purpose and conditions of my intended stay, and that there were reasonable doubts about my intention to leave the EU before the visa expired.

I wasn’t the only one. Of the ten speakers from low- and middle-income countries (LMICs) invited to present at the conference’s “Wildmeat: opportunities and risks” session, only four got visas. Another person withdrew voluntarily.

The participation of researchers from LMICs at international conferences on biodiversity is of the utmost importance. Earth’s biodiversity is richest in these nations, and includes ecosystems that provide important services, such as carbon sequestration, that benefit people globally. Our participation is not a matter of simply ticking the inclusivity boxes, but a deliberate effort to ensure that the voices of people for whom some of these conservation policies are formulated are heard, and their opinions sought.

However, whereas colleagues from wealthy nations, even as undergraduate students, can easily go to LMICs to participate in conferences and do research, the same cannot be said for those going the other way. The same documentation that scientists from high-income countries present at embassies — sponsorship, invitation and introductory letters — are apparently inadequate when submitted by people from LMICs. According to a global survey in 2018 by the research organization RAND, African and Asian researchers are the most likely to have visa-related challenges for short-term visits (see go.nature.com/2z9dabp ). A 2023 analysis by the Royal Society in London showed that in 2022, of the 30 territories for which the United Kingdom refused visitor visas most often, 22 were in Africa (see go.nature.com/3vxruba ).

Battles over funding could threaten historic effort to save species

These refusals come at a huge cost to individual researchers. Visa applications require scientists to be studious with paperwork, commit often large sums of money and make several trips to embassies that are sometimes outside their home country. My experience left me feeling demoralized, embarrassed and insulted by the implication that I and people like me couldn’t be trusted to attend a conference without outstaying our welcome.

This broken situation also comes at a cost to institutions. My sponsor spent approximately US$1,500 on my visa fee, return flight, insurance and conference registration (all non-refundable). Conference organizers and host institutions in wealthy countries spend a lot of time and effort searching for and inviting credible and accomplished researchers from LMICs to be part of the global conservation effort — time and money that is often wasted, which then discourages meeting organizers from prioritizing speakers from those nations.

Moreover, it comes at a cost to global efforts to prevent further biodiversity loss. Many high-income countries say that they are committed to global biodiversity conservation, and governments are pledging billions of dollars in support . Their visa policies for researchers should reflect this priority.

It’s time for countries to honour their million-dollar biodiversity pledges

I am not suggesting that embassies should operate without caution and issue visas without due diligence. But they should ensure that eligible candidates who meet the criteria are not prevented from participating in international discourse. This requires a distinct form of short-term visa review for scientists attending conferences, seminars, workshops and research programmes, and a commitment to improve communication channels between visa-issuing authorities, conference organizers and academic institutions, both in the countries hosting the events and in those that researchers are travelling from.

Part of this is ensuring that entry-clearance officers do not fixate on a scientist’s financial worth as a measure of the credibility of their intent to return to their home countries. Bank statements are often required to support visa applications. Mine show the grants I have received from the Rufford Foundation, Synchronicity Earth and the BaNGA-Africa/Carnegie Corporation of New York. Others are not so fortunate, and this approach risks allowing only well-off, established scientists to obtain short-stay visas — automatically preventing many early-career researchers from participating in global research conversations.

Conferences are where research collaborations are formed and where decisions on funding, publishing and policymaking are made. It is imperative that visa issues do not block scientists from LMICs benefiting from the opportunities they provide.

TIPS: What you'll need to apply for a US tourist visa

Thinking of going to the United States for a vacation?

Acquiring a visa can be quite taxing as it requires a lot of work, but that shouldn’t hinder you from visiting its picturesque landscapes and vibrant cities.

There are two types of visas that you could apply for in the States. There's the migrant visa for those who are looking to live there permanently, but if you simply want to go for a visit and explore its beauty, the nonimmigrant visa is for you.

Before you pack your bags and book a flight, here's everything you would need to apply for a US tourist visa.

  • A valid Philippine passport with a validity longer than your planned trip to the US;
  • An accomplished Nonimmigrant Visa Electronic Application or DS-160 form that you can submit online;
  • To complete the DS-160 form, you would need a travel itinerary, a national ID from the Philippines, and a social security number.
  • Note that the form should be filled out in English. 
  • Upon completion, you will receive an alpha-numeric barcode confirmation page that you must print for the interview.  
  • A recent 2x2 photo; 
  • Receipt of your nonimmigrant visa application processing fee paid in local currency;
  • If you are employed, present a letter from your employer indicating your position, time you spent working with the company, authorized vacation, and other business purposes.
  • Criminal and court records, if any.

After completing and submitting your DS-160 form online, you would need to create an account or profile in their system that you can access here . Once done, you can schedule an appointment at the US Embassy via a tab that will appear in the dashboard.

You'd be required to present your printed DS-160 form with the confirmation page, the receipt of your visa application fee for application verification, and the ten-digit barcode provided on your confirmation page on the day of your chosen slot.  

Other documents like your valid passport and previous passports and recent 2x2 photo will also be required. Incomplete requirements can cause your application to be void.

Visa interview and processing

Note that the US Embassy and Consulate are not accepting walk-ins. Applicants are also advised to complete their application early so they would have ample time to prepare and process their visas.

The visa interview questions will revolve around your itinerary, the purpose of your travel, and other personal information to justify the accuracy of your documents. It's necessary to answer all their questions as honestly as possible.

The decision by the consular officer regarding your application will be given on the day of your interview, and " only after all of your documents have been furnished and the results of the medical examination received."

The visa processing fee is non-refundable and non-transferable. Payment transactions can be done through Rizal Commercial Banking Corporation (RCBC) or PesoNet for an online option. Tourist visas usually cost $185 or over P10,000.  

The process time for a visa usually takes three business days, though it may vary depending on the case.

Call for Ukraine-style visa scheme for Palestinians in Gaza with family in UK

Charities and law firms sign letter to home secretary saying existing immigration routes are not working

A letter signed by almost 60 charities, law firms and organisations will be sent to the home secretary calling for the creation of a Ukraine-style visa scheme for Palestinians trapped in Gaza who have family in the UK.

The letter, signed by the Refugee Council, Care4Calais and the Helen Bamber Foundation, says “existing immigration routes are insufficient and not working” and describes how a Gaza family scheme would “enable Palestinians in Gaza to reunite with their immediate and extended family members in the UK”.

More than 30,000 people have been killed in Gaza since the 7 October attack on Israeli civilians, when 1,200 people were killed and about 250 people taken hostage by Hamas militants.

The letter, organised by the Gaza Families Reunited campaign and addressed to the home secretary, James Cleverly, will be sent on Tuesday. It calls for the Home Office to urgently create a Gaza family scheme “to protect human life and the right to family unity until it is safe for Palestinians to return”, especially as fears grow of an impending Israeli ground assault in Rafah .

The Home Office has said it does not have plans to establish a separate route for Palestinians to come to the UK.

Last week, Scotland’s first minister, Humza Yousaf, backed the Gaza Families Reunited campaign calling for a family reunion scheme.

The letter, whose signatories include the law firms Birnberg Peirce and Duncan Lewis, says eligible Palestinians have been unable to apply for family reunion visas due to the Home Office’s requirement to enrol biometric data, including fingerprints.

Although the Home Office does offer the ability to defer the requirement of biometrics, the letter says most of these applications have been rejected and two people have been killed in Gaza while waiting for a decision.

The letter reads: “Palestinians in Gaza are thus trapped in a catch-22: the British government is demanding that they register biometrics, but it is denying them a viable way of doing so … It is in this context that Palestinian families in the UK have called for a Gaza family scheme alongside a permanent and immediate ceasefire.”

The home secretary’s refusal to make decisions on the reunion applications of three families who were trapped in Gaza, due to their inability to provide biometrics, was found to be unlawful and breached their rights under article 8 of the European convention on human rights, in an upper tribunal in early March.

Hundreds of Palestinian families in the UK have resorted to raising tens of thousands of pounds via fundraisers to facilitate the evacuation of their families through a private company in Egypt.

Since the October attack, 55,000 donations have been made and 430 funds set up in the UK mentioning “evacuate” or “evacuation” in relation to the crisis in Gaza, according to exclusive figures shared with the Guardian by GoFundMe.

A petition calling for a Palestinian family visa scheme has been signed by more than 54,000 people so far. It requires 100,000 signatures in order to be considered for debate in parliament.

A Home Office spokesperson said: “We are working around the clock to get British nationals who want to leave out of Gaza. We have a team on the ground in Cairo and at the Rafah crossing providing consular assistance. Any dependents of British citizens who need a visa can apply for one.”
